REUTERS/Gonzalo Fuentes/File Photo Acquire Licensing RightsAug 30 (Reuters) - A California federal judge has refused to dismiss a lawsuit accusing X, the social media service formerly called Twitter, of disproportionately laying off older workers when Elon Musk acquired the company last year. Zeman, for example, claims X laid off 60% of workers who were 50 or older and nearly three-quarters of those who were over 60, compared with 54% of employees younger than 50. The judge dismissed a claim that X intentionally targeted older workers for layoffs, but gave Zeman a month to file an amended lawsuit fleshing out that claim. The lawsuit is one of about a dozen X is facing stemming from Musk's decision to lay off about half of Twitter's workforce beginning last November. Liss-Riordan also represents about 2,000 former Twitter employees who have filed similar legal claims against the company in arbitration.

Matsumoto accepted a July 21 recommendation by U.S. Magistrate Judge Sanket Bulsara to let the lawsuit proceed. A panel of judges in the District of Columbia Court of Appeals in Washington said the securities regulator's denial of Grayscale's proposal was arbitrary and capricious because the SEC failed to explain its different treatment between bitcoin futures ETFs and spot bitcoin ETFs. CRYPTO WINThe SEC rejected Grayscale's application for a spot bitcoin ETF in June 2022, arguing the proposal did not meet anti-fraud and investor protection standards. The court said in its ruling that the SEC failed to explain why it disagreed with Grayscale's assertion that the bitcoin spot and futures markets are 99.9% correlated. If the SEC chooses not to appeal, the court would issue a mandate specifying how its decision should be executed. That could include instructing the SEC to approve the application, or to revisit Grayscale's application, in which case the SEC could still reject the proposal on other grounds.

State law would still apply if the case is moved to federal court. The federal officer removal law protects people from state prosecution for carrying out official federal duties. It says that if a person were carrying out duties placed on them by federal law, they cannot be prosecuted for committing a state crime. Legal experts said Jones could allow the case to proceed in federal court and address immunity at a later hearing. If he determines immunity did not apply to the accused actions, the jury trial would take place in federal court, with the broader jury pool.

Trump, who on Thursday appeared at a Georgia jail to face state criminal charges of trying to overturn his defeat there, is not expected to attend Monday's hearing. Trump has previously lashed out at U.S. District Judge Tanya Chutkan, saying, without evidence, that she is biased against him. In Georgia, where Trump faces racketeering and other state charges related to his alleged efforts to overturn his 2020 presidential election defeat there, District Attorney Fani Willis has asked the court to set a March 4, 2024 date. Last week, a judge agreed to set a trial date of Oct. 23 for Trump co-defendant, attorney Kenneth Chesebro, after he requested a speedy trial. The judge has not yet set a trial date for the other defendants, though Sidney Powell, an attorney who advised Trump and promoted false fraud claims after the election, has also requested a speedy trial.

Fulton County Sheriff's Acquire Licensing Rights Read moreATLANTA, Aug 28 (Reuters) - Lawyers for Donald Trump’s onetime chief of staff Mark Meadows are set to argue in court Monday that a federal judge should take over a Georgia criminal case alleging he and the former U.S. president conspired to subvert the 2020 election. Meadows is seeking to move his case to federal court, where he would face a larger and more politically diverse jury pool than in Fulton County, Georgia, the Atlanta-area Democratic stronghold where he was indicted. U.S. District Judge Steven Jones’ decision on the matter could have broad implications for Trump and his co-defendants, some of whom also have sought to move their cases to federal court. State law would still apply if the case is moved to federal court. Prosecutors say Meadows furthered the alleged scheme by arranging calls and meetings where Trump pressured election officials to change the vote count in his favor.

Circuit Court of Appeals found that the U.S. Nuclear Regulatory Commission lacked the authority under federal law to issue permits for private, temporary nuclear waste storage sites. Circuit Judge James Ho, writing for the court, agreed with Texas that the Atomic Energy Act does not give the agency the broad authority "to license a private, away-from-reactor storage facility for spent nuclear fuel." Abbott opposed the plan, saying he would not let Texas become "America's nuclear waste dumping ground." The plan for a temporary facility was devised in order to address a growing nuclear waste problem in the United States. Export control laws restrict companies from sharing sensitive information and technology with certain individuals from other countries. Rebecca Bernhard, a Minneapolis-based labor lawyer who represents companies, said employers subject to export control laws often ignore the ban on citizenship-based bias in the federal Immigration and Nationality Act (INA), exposing them to legal action. Out of more than 10,000 hires, SpaceX only hired one asylee during that period, according to the lawsuit. The DOJ did not directly cite its guidance in the SpaceX lawsuit, but used nearly identical language to describe the company's alleged violations. "Export control laws and regulations do not prohibit or restrict employers from hiring asylees and refugees; those laws treat asylees and refugees just like U.S. citizens," the department said.
