New York CNN —Wendy’s and McDonald’s have emerged victorious from a lawsuit that accused the fast food chains of false advertising. Major fast food chains, including Burger King, Arby’s and Taco Bell, have all been targets lately for lawsuits that allege they’re misrepresenting food in their marketing. The explosion has been largely driven by the efforts of a handful of lawyers arguing that food in ads appears more bountiful than what customers actually get. In response, the fast food chains deny the accusations. Burger King, for example, said about a similar lawsuit that “reasonable consumers viewing food advertising know” that food in ads “has been styled to make it look as appetizing as possible.”

Taco Bell is finally selling breakfast tacos

New York CNN —Taco Bell is synonymous with tacos, just perhaps not in the mornings. For the first time, Taco Bell is adding breakfast tacos to its menu beginning October 12 for a limited time. Taco Bell even enlisted comedian Pete Davidson to apologize for some of its past breakfast food flops, like the much-maligned Waffle Taco. Breakfast sales have jumped 9% since the ads aired, with Taco Bell praising the campaign and Davidson for the turnaround. Taco Bell also announced that in celebration of National Taco Day that it’s bringing back its Taco Lover’s Pass subscription program for two days only.

New York CNN —Comedian John Oliver returned to his HBO show “Last Week Tonight” on Sunday, becoming the latest late night host to air a new program following the end of the writers’ strike. (Oliver’s show airs on HBO, which like CNN, is owned by Warner Bros. Bill Maher returned to his show last Friday and the network hosts, such as Jimmy Kimmel and Jimmy Fallon, will air new programs Monday. Now the focus turns to negotiations between SAG-AFTRA, the union representing about 160,000 actors, and the AMPTP. New York CNN —Blue Apron shares soared more than 130% Friday after the once-hot meal kit delivery service announced it was being acquired. Wonder Group, a food delivery startup led by former Walmart and Jet executive Marc Lore, is buying Blue Apron in a deal that gives shareholders $13 per share, valuing Blue Apron at $103 million — a far cry from its $2 billion valuation just six years ago. Since Blue Apron went public in 2017, its fortunes have dwindled with a number of problems, including layoffs, failing to grow its customer base and competition from larger companies, such as Amazon and Kroger. The Blue Apron (APRN) name will continue to be used following the close of the transaction. In June, Blue Apron sold its assets, such as its fulfillment centers, to fellow meal company FreshRealm, giving it a $50 million cash infusion.

Sixty-seven percent of Americans drink coffee every day — more than any other beverage, including water — according to National Coffee Association (NCA). A recently released NCA report also said that coffee consumption continues to “bounce back” from the Covid-19 pandemic, notably with at-work consumption growing as companies compel their workers return to the office. In fact, enjoying an in-office coffee has “rebounded to pre-pandemic levels” with 36% of Americans participating. People drinking coffee at home are still above their pre-pandemic levels at 82%.

McDonald’s is adding two new sauces

Beginning October 9, the fast food chain is adding two new dipping sauces to its menu for a limited time, joining its lineup of six sauces that include barbecue, ranch and sweet and sour. Some celebrity meals also came with re-branded dipping sauces, or ones that had previously only been available in certain regions. And while other chains struggle to bring more customers into restaurant locations, McDonald’s is reporting growth in US traffic. McDonald’s is partnering with its chefs and influencers to show off the number of combinations the new sauces can be paired with. That followed the news that McDonald’s was adding more of the sauce to its Big Mac sandwiches as part of a broader shakeup to its menu.

New York CNN —Amazon is joining other streaming services and inserting ads into its programming. Beginning next year, shows and movies on its Prime Video service will “include limited advertisements,” the company announced Friday. Prime Video, which is home to “The Marvelous Mrs. Maisel” and “Citadel,” is included in the $139 yearly Prime subscription. Streaming services are no long chasing subscribers, but rather investors are pressuring them to make money off the services, even if it comes at the expense of losing subscriptions. Hulu, in which Disney owns a majority stake, will also hike its monthly ad-free subscription $3 to $17.99.

Face of the iconic Hawaiian Airlines logo has died

New York CNN —The “face” of the Hawaiian Airlines logo, which has decorated the tails of its airplanes for decades, has passed away. Leina’ala Ann Teruya Drummond, Miss Hawaii 1964, died of cancer Monday at the age of 77 in Hilo, Hawaii. The face is a “promise to our guests that we offer something no other airline can — the warmth, care and generosity that are hallmarks of our Hawaiian culture,” the airline explains its on website. The Miss Hawaii organization said in a statement that Drummond’s “iconic smile, elegance and grace will always be remembered” and noted she placed in the top ten of the Miss America Pageant. “Hawaii lost a talented, poised and gracious woman who touched the hearts of many across the globe,” the organization said.

New York CNN —McDonald’s is being sued over a hot coffee spill, again. Childress also said in the lawsuit that the restaurant employees “refused” to help her, a point that the McDonald’s denied. Third-degree burns are the most severe and penetrate through the entire skin. The coffee was “30 to 40 degrees hotter than coffee served by other companies,” the law museum said. Earlier this year, McDonald’s was found liable in another case involving hot food.

New York CNN —Instacart started trading Tuesday, opening at $42 per share and propelling the grocery-delivery company to a market valuation of just over $11 billion. Trading under the ticker CART, Instacart had set a price of $30 per share for its initial public offering. The company might get a warm response from investors, who gave UK-based chip designer Arm a successful Nasdaq debut last week. That stock finished its first day of trading 25% higher, landing the company with a market cap of around $65 billion. Arm was the largest public offering in two years, after Rivian made its trading debut.

Cyberattack at Clorox is disrupting production

New York CNN —A cyberattack at Clorox is causing wide-scale disruption of the company’s operations, hampering its ability to make its cleaning materials, Clorox said Monday. Clorox said some of its products are now in short supply as it has struggled to meet consumer demand during the disruption. Clorox said it immediately took action to stop the attack, including reducing its operations. Still, Clorox has not been able to get its manufacturing operations back up to full speed. “Clorox has already resumed production at the vast majority of its manufacturing sites and expects the ramp up to full production to occur over time,” the company said.

New York CNN —General Motors CEO Mary Barra said she’s “frustrated” with the autoworker strike that began overnight, and said that her company has a “very compelling offer” for the union. “I think we have an offer that resonates with our people,” Barra told CNN’s Vanessa Yurkevich, saying that the offer includes pay raises up to 21%, job security and healthcare. “If you’re asking for more than the company made, I think that’s not a good position,” Barra pointedly said. New York CNN —Johnson & Johnson is replacing its instantly recognizable logo that’s been in use for 135 years. Although it’s a big change, shoppers likely won’t notice it since the cursive logo will still be used on its consumer products, like Band-Aid and Tylenol. Johnson & Johnson recently split into two companies — one focused on medical devices and medications and the other on consumer health products, which operates under a brand called Kenvue. The name Kenvue reflects J&J’s desire for the new consumer company identity to take a backseat to well-known brands. Still, ditching the signature J&J logo marks an end of era since the company once stated that its “one of the longest-used company emblems in the world.” The new logo will roll out over time on J&J’s medical equipment and pharmaceutical products.
