"QAnon Shaman" Jacob Chansley will regain possession of the makeshift spear and horned helmet that he carried as he stormed the U.S. Capitol during the Jan. 6, 2021, riot with other Trump supporters, a federal judge ruled Monday. "Since the government has not established that it still needs these items as evidence and has not sought their forfeiture, the Court will GRANT Mr. Chansley's motion," Lamberth wrote. The DOJ last month said it wanted to hold on to Chansley's property, because despite having expressed remorse at his criminal sentencing, he has since challenged his conviction and sentence. "Even if the government may need to reprove Mr. Chansley's guilt, the government has not explained why it would need his property," the judge wrote in Monday's order. "He was like thousands of others that day," Lamberth wrote in Monday's order.

More than four years after the coronavirus upended life in New York City, some of the most visible vestiges of the pandemic — outdoor dining structures erected outside thousands of restaurants — are facing a deadline that could see many of them razed. Restaurants that currently offer outdoor dining in sheds on sidewalks or in roadways and wish to continue doing so must apply to the city’s new outdoor dining program by Saturday night and comply with new guidelines, which some owners say will be costly. Business owners who do not apply must take down their existing setups or face fines. As of Friday afternoon, more than 1,900 restaurants had applied to take part in the new program, which is known as Dining Out N.Y.C. The volume of applications represented a significant drop from the number of restaurants that applied to take part in the temporary outdoor dining program that sprang up at the height of the pandemic.

Oklahoma City AP —A third set of remains with a gunshot wound has been found at a Tulsa cemetery in the search for graves of victims of the 1921 Tulsa Race Massacre, according to a state official. “We have exhumed him, he is in the forensic lab and undergoing analysis,” on-site at Tulsa’s Oaklawn Cemetery, Stackelbeck said. The discovery comes nearly a month after the first identification of remains previously exhumed during the search for massacre victims were identified as World War I veteran C.L. Forensic anthropologist Phoebe Stubblefield said no gunshot wound was found in Daniel’s remains, but said the remains were fragmented and a cause of death could not be determined. The remains exhumed during the current search are among 40 graves found, Stackelbeck said, and meet the criteria for how massacre victims were buried, based on newspaper articles at the time, death certificates and funeral home records.
