Smartmatic and Newsmax have reached a settlement in the voting technology company’s election defamation lawsuit against the right-wing news outlet shortly before the case was set to go to trial. The lawsuit focused on Newsmax's false claims that Smartmatic's machines rigged the 2020 presidential election for Joe Biden. Smartmatic sued Newsmax Media in 2021, alleging it claimed Smartmatic’s devices rigged the 2020 election. Former President Donald Trump and his allies have continued to promote false claims that the 2020 election results were manipulated to favor Biden. Smartmatic in April settled a similar defamation lawsuit against One America News for a sum that was not disclosed publicly.

Two in three voters say the country is on the “wrong track,” as voters weigh whether Vice President Kamala Harris or former President Donald Trump would be better able to change that less than two months from Election Day. The latest NBC News national poll finds 65% of registered voters surveyed earlier this month say the country is on the wrong track, while 28% say it’s on the right track. “While the wrong track data is now under 70% for the first time since September 2022, it is still a terrible 65% for the party in power,” Horwitt said. NBC News surveys have found steadily high rates of voters saying the country is on the wrong track for years — and especially since the coronavirus pandemic began in March 2020. But Harris does have an advantage over Trump when voters were asked which candidate better represents change, with 47% saying Harris and 38% saying Trump in the poll.

WASHINGTON — Former New York City Mayor Rudy Giuliani has been disbarred from practicing law in Washington, D.C., according to an order filed Thursday by the Court of Appeals for the District of Columbia. Both panels had pointed to Giuliani trying to get thousands of votes for President Joe Biden tossed out in the battleground state of Pennsylvania that year. The D.C. Bar's Board on Professional Responsibility said in a report in June that there was "clear and convincing evidence" that Giuliani "violated Pennsylvania Rules of Professional Conduct" and therefore "should be disbarred." Giuliani also lost his law license in New York state in July over his actions to disseminate lies about voter fraud in the 2020 election. Separately, he faces charges in Arizona and Georgia over his efforts to overturn the 2020 election results in those states.

According to a UBS survey of investors with at least $1 million of investible assets, 57% plan to vote for Harris and 43% plan to vote for Trump. Harris wins 91% of Democratic millionaires surveyed, 12% of Republicans and 60% of independents. Trump wins 88% of Republican millionaires, 9% of Democrats and 40% of independents. While they support Harris more broadly, the investors who were surveyed give Trump slightly higher marks on the economy and taxes. If Trump wins, they said defense and energy stocks look attractive, but if Harris wins, they said health care, sustainable investing and tech stocks look best, according to the survey.

CNN —Former New York City Mayor Rudy Giuliani is disbarred in Washington, DC, the district’s highest local court said Thursday, a move stemming from the ethics proceedings Giuliani faced in New York because of his efforts to help former President Donald Trump try to overturn the 2020 election. Those New York proceedings led to Giuliani losing his license to practice there this summer, and because the DC Bar has a reciprocal relationship with the New York Bar, he is now being disbarred in the district. According to the new order from the DC Court of Appeals, Giuliani did not respond to an opportunity to object to his disbarment in Washington. Meanwhile, two Georgia election workers obtained a $148 million defamation judgment against him for false allegations he made about them after the 2020 election. The pro-Trump cable outlet Newsmax and voting technology company Smartmatic settled a major 2020 election defamation lawsuit Thursday in a last-minute agreement to avoid a high-stakes trial. But in the run-up to the trial, Smartmatic’s hand weakened significantly, further raising the possibility of a settlement. Smartmatic has claimed that the lies promoted by Newsmax, Fox News, and other Trump allies destroyed its reputation and cost the company billions of dollars. However, as the Newsmax trial approached, Smartmatic’s lawyers reduced the company’s damages claim to approximately $370 million, according to statements in court. It often makes sense to settle rather than pay the expenses of a trial and possible appeals.”The settlement is the latest in a string of 2020 election defamation cases to reach an out-of-court agreement before trial.

The Newsmax case revolves around the same false claims, championed by former President Donald Trump and his Republican allies, that the 2020 election was rigged by Smartmatic software and others. The Florida-based company sued Newsmax and other right-wing outlets and figures in 2021, alleging that its reputation was destroyed by the lies. A settlement has been reached in a defamation lawsuit pitting an electronic voting machine manufacturer targeted by allies of former President Donald Trump against a conservative news outlet that aired accusations of vote manipulation in the 2020 election. The Delaware lawsuit, which takes issue with Newsmax reports over a five-week period in late 2020, is one of several stemming from reports by conservative news outlets following the election. Smartmatic also is suing Fox News for defamation in New York and recently settled a lawsuit in the District of Columbia against the One America News Network, another conservative outlet. Dominion Voting Systems similarly filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Trump's loss. Last year, in a case presided over by Davis, Fox News settled with Dominion for $787 million.

A Democratic group is launching a legal fund to help secretaries of state in key states defend against an anticipated post-election deluge of lawsuits. The group began aggressively raising money and campaigning to elect Democratic secretaries of state, who oversee elections in many states, in the wake of former President Donald Trump's false claims of voter fraud in 2020. It first funneled money to deal with postelection litigation to then-Arizona Secretary of State Katie Hobbs in 2022 to deal with postelection litigation. “We have a bunch of pro-democracy secretaries of state that we want to support. The initial four states were chosen in part because the group believes state laws will allow it to effectively send money to boost the secretaries of state.

While it was an asset to Biden in polling against Trump, it appears to be a much bigger advantage for Harris. And in this new NBC poll, Harris’ advantage was just under 20 points. It’s obvious at this point that Trump will win men by close to double digits, ditto with Harris among women. But many voters have seen "Vice President Kamala Harris" as a fresher candidate, including those who previously viewed Trump as a better steward of the economy. That would spell doom for Democrats' Senate majority.

Why Trump is polling better in Georgia than North CarolinaBy Steve KornackiThe latest round of New York Times/Siena College state polls is a continuation of what has become a pattern: Donald Trump seems to be faring slightly better in Georgia than in North Carolina. And Trump is up by 2 points in North Carolina, where he prevailed by 1.3 points four years ago. And yet — at least in polling — it’s Georgia, not North Carolina, where Trump seems better positioned. According to exit polling, Trump won the noncollege white vote in each state by roughly the same margin in 2020: 59 points in Georgia and 57 points in North Carolina. It’s a smaller lead among a slightly smaller share of the electorate than Harris has over those early voters.

The poll showed that 66% of Asian American voters plan on backing Harris, while 28% say they’ll be voting for Trump. It featured 1,105 Asian American registered voter respondents, and reported a margin of error of plus or minus 5.1 percentage points. Before Harris entered the race, 46% of Asian American voters said they would choose Biden. Meanwhile, 28% of Asian American voters have a favorable opinion of Donald Trump, slightly down from previous polling. Tim Walz was found to be favorable among 56% of Asian American voters, more than twice the percentage that found Republican Sen. JD Vance favorable.
