CNN —The Supreme Court will likely produce thousands of words when it decides this year whether former President Donald Trump may claim immunity from special counsel Jack Smith’s election subversion charges. Every time the Supreme Court grants an appeal it settles on a specific legal question to resolve. In the immunity matter, the court didn’t embrace Trump’s framing – nor the question Smith posed when he sought review on the same issue in December. “The question implicitly rejects Trump’s position of absolute immunity because of that language ‘whether…and to what extent,’” Eisen said. By taking the appeal, the Supreme Court has effectively pushed back the start of a trial in the federal election subversion case by weeks, at least.

The entertainment mogul has been the most prominent spokeswoman for Weight Watchers since joining its board in 2015, helping it weather competition from other weight loss companies while opening up a broader conversation around obesity and diet. Her endorsement of Weight Watchers — she has said she lost 40 pounds using the company’s point system — convinced many others to sign up, analysts said. The announcement sent Weight Watchers shares into a tailspin, with stock falling 25 percent in early trading Thursday.

But the retail giant backpedaled this week, saying higher prices on many grocery items and household staples like paper goods have stuck. Food prices climbed 2.6%, fueled by a 5.1% jump in prices for food away from home, a category that includes restaurant meals and vending machine purchases. That gives their makers the ability to keep raising prices to mitigate higher costs, even as their volume drops. Even some of the biggest U.S. brands have signaled that consumers' tolerance of higher prices has worn thin.

Capital One 's blockbuster takeover proposal for Discover Financial includes a $1.38 billion breakup fee if Discover decides to go with another buyer, but no such fee if U.S. regulators kill the deal, people with knowledge of the matter told CNBC. Capital One said late Monday it had an agreement to purchase rival credit card player Discover in an all-stock transaction valued at $35.3 billion. Watchers of the Capital One agreement are taking particular interest in whether U.S. banking regulators will allow it to happen. Neither side will owe the other a breakup fee if regulators block the acquisition, which is said to be typical for bank deals. The deal happened after Capital One approached Discover, and didn't include a wide search for all possible bidders, according to one of the people.
