New York State’s corrections department agreed on Thursday to allow six men who had sued to be able to view Monday’s total solar eclipse to do so at the upstate prison where they are held, but the department stopped short of lifting a statewide prison lockdown during the eclipse. The men, inmates at Woodbourne Correctional Facility in Sullivan County, filed a federal lawsuit last week arguing that the lockdown during the eclipse violated their constitutional right to practice their religion. Though they come from varying religious backgrounds, the men all believe that the eclipse “is a religious event that they must witness and reflect on to observe their faiths,” according to court documents. “This is a huge win for them — they are all ecstatic,” said Chris McArdle, one of the lawyers who represented the men. “Keeping our fingers crossed that it’s not cloudy or raining, they are going to be able to practice their sincerely held religious beliefs, which is the outcome we always wanted for them.”

CNN —An attorney defending Texas’ controversial immigration law told a federal appeals court on Wednesday that state legislators may have gone “too far” when they passed the law last year. The law, known as SB4, makes entering Texas illegally a state crime and allows state judges to order immigrants to be deported. Nielson sought to downplay how sweeping the law was and argued it did not interfere with federal authority on immigration. An attorney for the Justice Department, which brought one of the lawsuits challenging the Texas statute, urged the appeals court not to depart from its previous ruling blocking the law. “Of course, we know that presidents come and go, and different administrations might very well enforce federal law differently,” he said, arguing that the law may not be necessary under a different presidential administration.

NEW YORK (AP) — The Federal Trade Commission is investigating TikTok over its data and security practices, a probe that could lead to a settlement or a lawsuit against the company, according to a person familiar with the matter. In its investigation, the FTC has been looking into whether TikTok violated a portion of federal law that prohibits “unfair and deceptive” business practices by denying that individuals in China had access to U.S. user data, said the person, who is not authorized to discuss the investigation. FTC spokesperson Nicole Drayton and TikTok declined to comment on the investigation, which was first reported by Politico. The agency is nearing the conclusion of its investigation and could settle with TikTok in the coming weeks.
