A panel of Washington, D.C. federal appeals court judges was highly skeptical of arguments Monday by a lawyer for Donald Trump that the former president is being unconstitutionally silenced by a gag order in his criminal election interference case. Sauer replied that "the showing would have to be extraordinarily compelling" in order to justify restricting Trump's speech. Trump was slapped with the gag order last month by U.S. District Judge Tanya Chutkan, who said his statements targeting people involved in the case posed "sufficiently grave threats to the integrity of these proceedings." Chutkan's gag order barred Trump from making public statements targeting his prosecutors and "reasonably foreseeable" witnesses regarding the substance of their testimony. Trump has pleaded not guilty to the four-count indictment charging him with crimes including conspiracy to defraud the United States.

The 102-page decision was a win for Trump, but it read more like a condemnation. The Colorado ruling isn’t binding on other courts, but it’s the most comprehensive fact-finding to date by a judge about Trump’s attempts to overturn the 2020 election. CNN —Nevada’s attorney general is investigating individuals who acted as fake electors in the state following the 2020 election, a source close to the investigation told CNN. Attorney General Aaron Ford’s office declined to comment. In Georgia, Fulton County District Attorney Fani Willis has charged multiple individuals involved in the plot to put forth fake electors in that state, along with Trump. Michigan Attorney General Dana Nessel in July charged more than a dozen individuals who acted as fake electors. And Arizona Attorney General Kris Mayes has launched an investigation into the fake elector scheme there.

Perot is a bit of an exception in that independent or third-party candidates usually fade as an election nears. George Wallace topped out at 21% in pre-election polling as a third-party candidate before picking up 14% when the votes were cast. Given all that, it’s no surprise we’re seeing other independent and third-party candidates jumping or potentially jumping into the 2024 race. He was entertaining the idea of running as a third-party candidate earlier this year.

Despite the concerning top-line numbers, the Times/Siena College polls do offer some hope and a road map to Biden’s victory. The other issue Biden wins more trust than Trump on is the handling of “democracy,” according to the new polls. Biden made democracy a key issue in the closing weeks of the 2022 midterms. For those who want Biden to win in 2024, you can’t ignore the polls but shouldn’t be panicked by them. The Biden campaign needs to do its part in terms of campaigning on the key issues and building an effective ground game.
