☆ KFC sues Church’s over ‘Original Recipe’

Last week, KFC accused Church’s Texas Chicken of violating its trademark rights when its fried chicken competitor began using the words “Original Recipe” in its advertising and promotions. KFC claimed in a lawsuit that beginning September 30, it noticed Church’s “abruptly” began using the phrase and ignored KFC’s October 24 letter objecting to the ads. In the disputed promotions, Church’s posted photos of its fried chicken deals with text above reading: “our original recipe is back.”The phrase, which KFC has been using for over half a century, “is likely to create confusion in the marketplace and dilute the ORIGINAL RECIPE® Mark,” the lawsuit, which was filed in US District Court in Texas, said. But when it comes to fried chicken, KFC also has to compete with Church’s Texas Chicken, Popeyes, Raising Cane’s, Zaxby’s and more. KFC’s “Original Recipe” trademark, which it says is a secret blend of 11 herbs and spices, has long been part of the company’s branding.

A brand-new Disney cruise ship rushed to the aid of a catamaran taking on water in the Atlantic on Sunday and plucked four people to safety, authorities said. TOKYO — Lawmakers in Japan voted Monday to retain the embattled Shigeru Ishiba as prime minister despite his long-governing party’s dismal showing in parliamentary elections last month. Ishiba, a straight-talking former defense minister, received 221 votes compared with 160 for Yoshihiko Noda, leader of the opposition Constitutional Democratic Party. Many Japanese officials assume Trump is going to be “more straightforwardly anti-China,” and that Japan will be “somehow miraculously left off the hook,” he said. CNN —Republicans flipped the Senate, but Democratic candidates often outran the top of the ticket, winning at least four battleground states that Vice President Kamala Harris lost. Harris lost all seven swing states to President-elect Donald Trump, while her party’s Senate candidates narrowly held Wisconsin, Nevada and open seats in Michigan and Arizona. In some races, the differences between the Senate candidates’ and Harris’ performances were more pronounced among subsections of the Democratic coalition. While Trump won independents by 2 points, Rosen won the group by 6. Overall, Democratic Senate candidates received more votes than Harris in about half of this year’s races, including in less competitive states such as Minnesota, Virginia and Missouri.

Appearing Monday on Fox News, Homan said Trump 2.0 will be like his first term but with more deportations. During his first term, Trump also promised mass deportations. But that’s about half the 2.9 million deportations undertaken during Barack Obama’s first term and fewer than the 1.9 million deportations during Obama’s second term. Analysts said tariffs on cars imported from Mexico would have dire consequences for US automakers. Tesla announced in March 2023 that it was planning to build its seventh gigafactory near the industrial hub of Monterrey, Mexico. Trump vowed to clamp down on automakers building cars in Mexico on the campaign trail, and the prospect of new tariffs could force US automakers such as Tesla to make some hard choices about operational or planned factories in Mexico. Analysts told BI that the tariffs floated by Trump would deter automakers such as Tesla from investing in Mexico. Other automakers have expanded their presence in Mexico, despite the uncertainty of the election and the prospect of tariffs under a second Trump term.
