Legal experts told NBC News that the disclosure could have legal fallout for Musk across multiple jurisdictions under laws designed to protect consumers from deceptive practices. Chris Gober, a lawyer for America PAC, made the disclosure at a hearing about the giveaways. Elon Musk awarded Kristine Fishell a $1 million check at a town hall in Pittsburgh on Oct. 20. Typically under state law, “this is actually bread and butter stuff for them,” he said in a direct message. The Justice Department, which had warned Musk’s super PAC that its offer may run afoul of federal election law, did not immediately respond to a request for comment.

A Pennsylvania judge on Monday declined an effort by the Philadelphia district attorney to stop Elon Musk’s America PAC from doling out cash prizes to registered voters. The judge's injunction means Musk's PAC will be able to do one last giveaway on Tuesday, the last day of the offer. The America PAC giveaway has promised million-dollar checks to some voters and $47 and $100 payments to other registered voters who signed a political pledge in swing states. Philadelphia District Attorney Larry Krasner sued Musk and America PAC last month, alleging that the giveaways were an illegal, unregulated lottery, but at a hearing Monday, America PAC attorney Chris Gober said it wasn’t a lottery because winners aren’t determined by chance. Musk’s legal team delayed this hearing last week, filing to move the case to federal court.

Philadelphia District Attorney Larry Krasner on Monday testified that Tesla CEO Elon Musk and his political action committee know they are conducting an "illegal" lottery by giving away $1 million to registered voters in Pennsylvania and other swing states before Election Day. "They know what they're doing is illegal and they are doing everything under the sun to clean it up," Krasner said. "There is no First Amendment right to commit crimes," the DA testified in the Philadelphia County Court of Common Pleas. "There is no First Amendment right to commit fraud."
