Trump only spoke three times during Monday’s session, acknowledging to the judge he understood his rights as a criminal defendant. Throughout the day Trump often engaged with his attorneys, whispering to them and sharing notes as they debated motions with the Manhattan District Attorney’s Office. Trump looked toward Merchan as the judge addressed the prospective jurors to explain the case and their instructions as potential jurors. Entering and exiting the courtroom, Trump had to walk right past Manhattan District Attorney Alvin Bragg, who brought this case against Trump and was seated in the fourth row behind his prosecutors. Trump will be back at the defendant’s table on Tuesday, when Merchan will continue questioning the prospective jurors who could ultimately decide whether to convict Trump in the first criminal trial of a former president.

New York Supreme Court Judge Juan Merchan is a seasoned jurist who is no stranger to Trump’s orbit. In the lead-up to the start of the trial, Trump fanned the flames on social media with his views on the judge. “Judge Merchan was always well-prepared, accessible, and – most importantly in the Weisselberg matter – a man of his word. Trump also claimed Judge Merchan has ruled against him in pretrial motions “because his daughter makes money by working to ‘Get Trump.’”Loren Merchan has not commented publicly on the case. David Paterson appointed him to the New York State Court of Claims in 2009, the same year he began serving as an acting New York Supreme Court judge.

CNN —On Monday, jury selection for the first-ever criminal trial of a former US president begins in Manhattan. The process may take longer than the usual jury selection and the pool of persons questioned will be larger. There is something to be said for Trump’s claim that he faces an uphill battle in jury selection. True, another New York jury found Trump liable of defaming and sexually abusing E. Jean Carroll in 2023 and again this year. There is a famous quip of unknown origin that goes: “In England, the trial starts when jury selection is over.

Of the first group of 96 potential jurors who crammed into the courtroom, more than half were immediately excused for saying they could not be fair and impartial. A Manhattan jury also found Trump’s business, the Trump Organization, guilty of tax evasion, although Trump was not personally named in that case. And here is an excellent visual timeline of the entire hush money scandal. It was Cohen who orchestrated the hush money payments and who pleaded guilty to federal charges of violating campaign finance law, for which he served time in prison. Trump is accused by New York of falsifying business records when he paid Cohen back for the hush money scheme.

“I’ve done a lot of cases that are considered no-win,” Bragg told CNN at the time, in December 2021. Though Bragg’s ambitions are widely considered to be less lofty than some of his predecessors, the Trump trial will likely write both his political future and legacy. Two months into office, Bragg was confronted by two senior attorneys leading the Trump investigation. When Bragg refused to authorize them to seek an indictment they abruptly and noisily resigned, putting additional pressure on the new district attorney. Trump eventually paid $2 million of his own money to a group of charities, and the foundation was dissolved.

CNN —The first criminal trial of former President Donald Trump is here. Trump has complained that he cannot get a fair jury in Manhattan, where the jurors must live. He was fined twice for violating a gag order imposed by New York Judge Arthur Engoron in his civil fraud trial. This payment is not part of the charges against Trump, but prosecutors have said that the testimony would help establish a pattern of payments. Merchan also denied prosecutors’ request to show E. Jean Carroll’s deposition from her defamation case against Trump because it would be “building in a trial into a trial.”

The United States, unlike democracies that have been historically less stable, is not a nation accustomed to seeing its former heads of state on trial. This is one reason why Trump’s 2024 campaign is running as much through the courtrooms as according to the traditional rhythms of a White House bid. It’s very unfair that I’m having a trial there,” Trump said on Friday, alluding to New York City’s liberal lean. The deteriorating situation could bolster Trump’s claims the world is spinning out of control under his successor’s watch. Merchan has declined efforts by the president’s attorneys to get the trial relocated to a jurisdiction where voters may be more favorable to Trump.

With Trump’s trial scheduled to start Monday, here is a fact check of some of Trump’s remarks. Trump’s baseless claims that Biden is secretly running the caseTrump has repeatedly claimed that the Manhattan case has been secretly orchestrated by President Joe Biden, Biden’s White House or the Biden-era federal Justice Department. Third, there is no basis for the claim that Colangelo oversees Bragg; Bragg is Colangelo’s boss. Prosecutors allege Trump falsified business records to hide the reimbursement of hush money payments that were made to influence the election outcome. And it may feature at least one audio recording of Trump and Cohen allegedly discussing a catch and kill deal. Necheles represented Trump’s business at its tax fraud trial in 2022. It was the third “catch and kill” deal to come after a key meeting at Trump Tower in August 2015 between Trump, Cohen and Pecker. On October 27, 2016, Cohen wired the money to Daniels and 12 days later Trump won the election.

If Trump were sent to prison, would he still have his presidential Secret Service protecting him in jail? The judicial process is built around the idea that defendants are there to answer charges, and New York law requires that a defendant be present at trial. The felony charge here, which is the lowest level felony under New York law, is falsifying business records to further some other crime. His federal trial on classified documents is proceeding slowly in Miami. While Trump, under New York law, has a right to know their names, their identities will be kept from public view.

Donald Trump on Saturday took aim at two likely witnesses in his upcoming New York hush money trial, testing the boundaries of a gag order that prohibits such public statements. The social media post is the latest challenge to the limits of a gag order that forbids Trump from making public statements about likely witnesses and jurors. In the weeks since, Trump has repeatedly gambled on the limits of the gag order. It would not be the first time Trump has faced consequences for disobeying a gag order. In a separate trial in October, Judge Arthur Engoron fined Trump $10,000 for gag order violations.

CNN —Former President Donald Trump is set to go on trial this month in Manhattan for his alleged role in a hush money scheme to silence his alleged mistresses before the 2016 election. Here’s what to know to get up to speed on this first criminal trial:What’s the general outline of the hush money case? The judge overseeing the hush money case, Juan Merchan, expanded a gag order on Trump after the former president attacked Merchan’s daughter on social media. And the witness list for this hush money case includes former Trump aides such as Hope Hicks. So that’s why this New York case about hush money paid eight years ago is the one that’s going to trial first.

Former President Donald Trump has run out of legal options to delay Monday's start of his Manhattan hush-money trial, legal experts predict. Trump's lawyers struck out 0-3 this week, when three Manhattan appellate judges rejected three separate emergency delay bids during arguments on Monday, on Tuesday, and Wednesday. Barring an unforeseen, nonlegal emergency, jury selection in Trump's first of four criminal cases will begin as scheduled on Monday morning in Supreme Court in lower Manhattan, experts said. Ditto the US Supreme Court, where Trump could ultimately end up, given that all three appellate efforts raise Constitutional issues, Schechtman said. AdvertisementBut though Trump's lawyers failed to stop the trial, their efforts may not be wasted down the road.

Donald Trump said Friday that he would testify under oath in his criminal hush money trial, which is set to begin in New York on Monday. The presumptive Republican presidential nominee spoke at a press conference with House Speaker Mike Johnson, R-La., at Trump's Florida resort home Mar-a-Lago. The trial — the first ever against a former president — centers on a hush money payment in late 2016 to porn star Stormy Daniels, who says she had an extramarital affair with Trump years earlier. Trump is expected to be in court throughout the trial, which could last over six weeks. Asked at Mar-a-Lago what he will be looking for when the jury selection process begins Monday, Trump said, "Jury selection is largely luck.

Read previewDonald Trump's hush money trial remained on track for Monday jury selection after the judge on Friday night denied — in no uncertain terms — a defense bid to delay the trial indefinitely due to prejudicial pretrial publicity. "This is not tenable," the trial judge, New York Supreme Court Justice Juan Merchan , said in his decision, noting that much of the pretrial publicity has been caused by Trump himself. "Defendant appears to take the position that his situation and this case are unique and that the pre-trial publicity will never subside," the judge wrote in Friday's decision. The poll "provides no information about how it obtained the contact information of respondents or how it ensured its samples were actually random or representative," the judge wrote. Last week, Trump lost a Manhattan appellate court bid for an emergency delay of the trial on pretrial publicity grounds.

How Donald Trump has handled juries so far

CNN —Three months ago, Donald Trump took the stand before a jury of nine in a New York courtroom without his typical bombast or ranting. “The record will reflect that Mr. Trump just rose and walked out of the courtroom,” Judge Lewis Kaplan announced, in case any jurors had missed it. “I mean, our whole case was about the fact that Donald Trump is unable to follow the law, unable to follow the rules. But just having political views about Trump, for or against, won’t be a reason for potential jurors to be dismissed. When Kaplan asked jurors a series of questions individually, Trump turned in his chair to watch each person speak.

He is a graduate of Yale Law School, a fellow of the American College of Trial Lawyers and a retired Illinois attorney. In rejecting Trump’s contention that the gag orders violate his First Amendment rights, Merchan pointed to Trump’s social media posts. Merchan was aware of the Sheppard opinion justifying his initial gag order, citing it in the ruling. A leading lawyers’ organization, the American College of Trial Lawyers, wrote that Trump’s statements about judges and prosecutors “puts our very democracy at risk. It should be universally condemned.”That’s why Merchan’s gag order is indispensable.

CNN —Lawyers for Donald Trump have filed another appeal in the hush money case to challenge the order by the trial’s judge denying him from arguing he has presidential immunity. Trump’s attorneys also are challenging Judge Juan Merchan’s “refusal” to recuse himself from the trial and a previous ruling related to how dockets are made publicly. In a brief two-page notice of petition filed on Wednesday, Trump’s lawyers alleged the judge exceeded his authority in those rulings and have asked the appeals court to hold a hearing on May 6. The court filing posted on the public docket does not indicate that Trump is seeking an emergency hearing before the appeals court to delay the trial in this notice of petition. Trump’s lawyers earlier this week asked the appeals court to stop the trial over pretrial publicity and the gag order.
