Tesla CEO and X owner Elon Musk, who supports Republican presidential nominee former U.S. President Donald Trump, gestures as he speaks about voting during an America PAC Town Hall in Folsom, Pennsylvania, U.S., October 17, 2024. A federal judge in Pennsylvania on Friday sent back to state court a lawsuit against billionaire Elon Musk and his political action committee seeking to halt their $1 million daily giveaway to voters in the swing state. The order returning the case to state court in Philadelphia came a day after the suit by the city's District Attorney Larry Krasner was removed to federal court at the request of the Tesla CEO Musk and his America PAC. Krasner's lawsuit accuses Musk and the PAC of running an illegal lottery by offering a random cash prize to registered voters in Pennsylvania. Friday's ruling sets the stage for Krasner to potentially obtain a quick order in the Philadelphia Court of Common Pleas blocking America PAC from awarding any more $1 million prizes to registered voters in the state.

AdvertisementRussia's retaking territory in Kursk, but efforts to drive the Ukrainian forces out of the country will likely only get more difficult. Ukrainian troops invaded the Kursk region in southwestern Russia in August, and at one point, they held roughly 500 square miles of Russian territory. Russia's response to the shock assault was slow, but a larger effort to drive the Ukrainians out is now underway. Michael Bohnert, a warfare expert at RAND Corporation, told BI Ukraine doesn't have to defend Russian cities. Elon Musk's ownership has shifted X's political stance, affecting Democratic ad spending. X switched political ads back on last year as it looked to recoup lost revenue after a brand exodus. It ceased taking political advertising in 2019 under former CEO Jack Dorsey; Musk reversed that decision last year. Elon Musk and his political action committee are seeking to move the Philadelphia District Attorney's lawsuit targeting their $1 million swing state voter daily lottery to federal court from a state-level court. It is not clear what will happen at the hearing, given the notice of removal in federal court. As a rule, federal law bars a state court proceeding from taking place if a party in the case has filed a notice of removal to federal court and a copy of that notice is filed with the state court. The notice filed in federal court by lawyers for Musk and his America PAC argue that because that PAC is registered as a federal entity, it is not subject to state law. Krasner's lawsuit, which claims Musk's $1 million giveaway is an illegal, unregulated lottery, was filed in Court of Common Pleas on Monday.

“We have to reduce spending to live within our means,” Musk said. That gives Musk’s frankness about reductions — and his track record of making large, painful cuts at his own companies — added weight. The Trump campaign didn’t immediately comment but has previously said that the GOP agenda wouldn’t cause short-term economic hardship. There’s some skepticism on Wall Street that a new Trump administration could implement spending cuts on the scale Musk has proposed. “They’re both indicating they intend to maintain substantial deficits and elevated government spending, certainly compared with the strength of the economy,” Elliott said.
