Embattled New York City Mayor Eric Adams said Monday that he's accepted the resignation of his deputy mayor for public safety, Philip Banks, the latest senior official to leave as the mayor fends off an indictment and calls to step down. All three Banks brothers have denied wrongdoing. An attorney for Philip Banks, Benjamin Brafman, said Monday that federal prosecutors had assured him his client was not a target of the investigation. In addition to seizing the phones of the three Banks brothers, federal investigators also took devices from the city's police commissioner, Edward Caban, and one of Adams' closest aides, Timothy Pearson. At a press briefing last month, Adams spoke of his close ties to the Banks brothers.

CNN —Members of the grand jury in Arizona that indicted 18 allies of Donald Trump earlier this year for their alleged roles in attempting to overturn the 2020 election had also expressed interest in charging the former president, according to a new court filing. The interest was strong enough that it prompted the state’s lead prosecutor to request that the grand jury not indict the former president and give a PowerPoint presentation to explain his reasoning. Prosecutors cited two primary reasons for why the grand jury should not charge Trump: a lack of evidence and a US Justice Department policy they believe would hamper charges against a former president. The policy cited by prosecutors deals with DOJ guidelines limiting how the federal government can prosecute individuals already charged with similar crimes at the state level. Epshteyn, who appeared in court Tuesday via phone, is one of 18 defendants who, according to the indictment, “schemed to prevent the lawful transfer of the presidency to keep Unindicted Coconspirator 1 in office against the will of Arizona’s voters.”While Trump is not among those charged in Arizona, the details in the indictment suggest he is “Unindicted Coconspirator 1.”The scheme, according to the indictment, called for the fake electors to fraudulently vote for Trump, “falsely claiming to be the duly elected and qualified Electors for President and Vice President of the United States from the State of Arizona.”Epshteyn joined the Trump campaign in 2016 and is considered one of the former president’s most loyal advisers, speaking with him regularly. CNN —A former Trump 2020 campaign official has been subpoenaed by officials in Arizona as part of the criminal investigation focused on efforts to overturn Joe Biden’s win, according to two sources familiar with the matter. Woodbury County election officials became aware of possible voter fraud in September 2020, when two Iowa State University students from Sioux City requested absentee ballots, only to learn ballots had already been cast in their name. When processing absentee ballots on election night, election workers notified Gill that the handwriting on a number of them appeared to be similar. Most voter fraud cases involve one voter casting a single ballot in another person’s name, said Assistant U.S. Attorney Richard Evans, who helped prosecute Taylor’s case. “Despite what’s in the media, voter fraud is extremely rare,” Evans said.
