Hannah Gutierrez-Reed will remain behind bars, according to a decision filed by the judge overseeing the “Rust” movie armorer's case on Monday. Judge Sommer ruled that Reed’s conviction still holds even though the judge previously determined that the prosecution suppressed evidence in the involuntary manslaughter case against “Rust” star and producer Alec Baldwin. For this reason, Judge Mary Marlowe Sommer dismissed Baldwin's case, saying New Mexico prosecutors failed to disclose the evidence — a violation of the Brady Law. The sanction of dismissal is the only warranted remedy,” Sommer said of her decision at the time. Morrissey has since asked the judge to reconsider dismissing the case against Baldwin.

CNN —A New Mexico judge on Thursday is set to consider the “Rust” movie armorer’s motion to be released from prison, months after similar charges against actor Alec Baldwin were dismissed due to prosecutorial misconduct. At her trial, prosecutors argued she repeatedly violated safety protocol and was negligent in performing her duties, allowing six live rounds on to the set. Her defense attorney argued she was scapegoated for the safety failures of film set management and other crew members. But just days after his trial began, Judge Mary Marlowe Sommer threw out the charges and ruled prosecutors did not properly turn over evidence to the defense. The judge called the withholding of evidence “intentional and deliberate” and dismissed the case with prejudice, meaning it cannot be brought again.

A lawyer who represented Boston gangster James “Whitey” Bulger will prosecute Karen Read, whose murder trial in the death of her Boston police officer boyfriend ended with a hung jury, when the case is retried, officials said Wednesday. In a statement, Norfolk County District Attorney Michael Morrissey said he appointed attorney Hank Brennan to lead the effort to retry Read as special assistant district attorney. Morrissey described Brennan as a skilled former prosecutor and a long-time defense attorney with an expertise in complex law enforcement matters. Brennan was a longtime lawyer for Bulger before the crime boss was killed in a federal prison in West Virginia in 2018. The lead prosecutor in the case, assistant district attorney Adam Lally, will remain on the team that will retry Read, according to Morrissey’s statement.
