In Trump's case, Electric Avenue was used for a commercial purpose, not for an allowable non-profit, research, or educational purpose, the judge wrote. The second factor looks at whether the copyrighted work was "creative" or "factual." The third factor weighs how much of the copyrighted work was taken for an unauthorized use. AdvertisementThe final factor asks "whether, if the challenged use becomes widespread, it will adversely affect the potential market for the copyrighted work," the judge wrote. "In this case, there is no public benefit as a result of the defendants' use of 'Electric Avenue'" the judge wrote.

How Did JD Vance Get Here? - The New York Times
  + stars: | 2024-07-29 | by ( Paul Krugman | ) www.nytimes.com   time to read: +1 min
There are talented politicians, there are untalented politicians, and then there’s JD Vance — I mean, he tried to calm the furor over his “childless cat ladies” remarks by feebly deadpanning that he’s “got nothing against cats.”Now he’s just gaslighting, claiming that Kamala Harris called for an end to the child tax credit, even though as part of the Biden administration, she of course supported a major expansion of the tax credit that greatly reduced child poverty but expired in 2022 in the face of unified Republican opposition. So how did this guy end up as the Republican vice-presidential nominee? Who’s his constituency? Despite the “Handmaid’s Tale” vibe of his views on women and reproductive rights, he doesn’t have deep roots in the religious right. And he’s a late adopter of the MAGA worldview, having once fretted that Donald Trump could wind up being “America’s Hitler.”Vance’s ascent has, to a significant degree, been powered by a small group of technology billionaires with Peter Thiel, who poured millions into Vance’s 2022 Senate race, at the center.

Opinion | Netanyahu Must Go
  + stars: | 2024-04-09 | by ( Bret Stephens | ) www.nytimes.com   time to read: +2 min
Israel must destroy Hamas as a military and political force in the territory while minimizing harm to civilians. And for all of that to happen effectively, Benjamin Netanyahu must go. Why — to paraphrase Scarborough and his co-hosts — was Netanyahu asking Qatar to fund Hamas to the tune of hundreds of millions just weeks before the massacre? Why was the bulk of the Israeli military nowhere near Gaza in the first hours of the attack? When an Israeli minister is forced to humiliate himself on American TV because he can muster neither the sophistry nor the servility that a smoother answer would require, it’s a sign he’s in the wrong government.

CNN —The White House is disgusted with Fox News — even more so than usual. Which is why, perhaps, the White House felt the need to formally respond, even though, typically, the Biden administration opts not to get in the mud with the network. Asked about the “dictator” charge on Wednesday, White House press secretary Karine Jean-Pierre replied, “There are probably about 787 million things that I can say about this. Meanwhile, White House deputy press secretary Andrew Bates went nuclear on the outlet for its story about the pride flag. No such statement was released about the story Fox News published about the supposed “controversial new transgender flag” the White House flew over the weekend for Pride Month.

In “The Sportswriter,” the first novel in this series, Frank started out as a sensitive young literary man who had published a book of stories. Though the Bascombe novels are set mostly in New Jersey’s wealthier suburbs, they are, oddly, road novels. Springsteen went from “Darkness on the Edge of Town” to “Letter to You.” Holy moly. Ford went from “Independence Day” and “The Lay of the Land” to “Let Me Be Frank With You” and “Be Mine.” Good Lord. The Bascombe novels are road novels, as well, because they are set during holidays, when families are in flux.

HBO's hit show "Succession" airs its series finale Sunday night, with Waystar Royco's future in the balance. It captures the spirit of boardroom drama, but takes some liberties with corporate law, experts said. On HBO's hit show "Succession," the beats of a proxy fight are sometimes just as intense as a scheming betrayal from a once loyal lackey. Over four seasons, the show has laid out a thesis about the all-encompassing gravitational force of Logan Roy, the media mogul behind the fictional news and entertainment conglomerate Waystar Royco. "But the failure of the board to engage in any succession planning at all, is a first thing to note," she said.
Credit Suisse has been flailing for years, hurt by risk-management missteps that tarnished its reputation with clients and investors, and cost several top executives their jobs. The question on everyone’s mind is: What will happen to Credit Suisse, and who will be the next to fall? Fitch Ratings and S&P on Wednesday both downgraded the bank’s credit rating over concerns that depositors could pull their cash despite federal intervention. PacWest Bank (PACW) was down 12%, and shares of other regional banks fell again, too. Bottom line: Credit Suisse will probably need to be taken over (the most likely outcome, according to JPMorgan) or bailed out.
