Blink Fitness, a budget-friendly gym chain owned by luxury fitness company Equinox Group, has filed for Chapter 11 bankruptcy protection. The fitness brand, with more than 100 centers in the U.S., is the latest chain to seek bankruptcy post-pandemic, following companies such as New York Sports Club, 24 Hour Fitness and Gold's Gym. Earlier this year, Equinox also launched a $40,000 annual gym membership aimed at its most affluent member base in an effort to improve its finances as well. Unlike Blink, Planet Fitness reported strong membership growth of 7% year over year in its second quarter to reach a total of 19.7 million members. Planet Fitness shares recently hit a 52-week high, reaching levels not seen since May 2023.

WASHINGTON, Sept 26 (Reuters) - U.S. auto suppliers on Tuesday urged President Joe Biden to provide federal assistance to help auto parts companies impacted by the ongoing United Auto Workers strike against the Detroit Three automakers. MEMA, the Vehicle Suppliers Association, in a letter seen by Reuters urged Biden to "effectuate federal assistance to ensure the viability of this critical industry sector. Without federal assistance, the ability of the automotive industry to resume full manufacturing capacity is at risk." The group wants the Biden administration to provide low-interest loans and consider loan forgiveness for struggling small suppliers. The White House did not immediately comment and has previously declined to comment on whether it is considering programs to support auto suppliers.

SACRAMENTO, Calif. (AP) — Sacramento’s top prosecutor is suing the city’s leaders over failure to cleanup homeless encampments, escalating a monthslong dispute with leaders in California’s capital city. A group of residents and business owners also filed a companion lawsuit against the city. The lawsuit includes accounts from dozens of city residents living around 14 encampments. Roughly three-quarters of the county’s homeless population is unsheltered, and the majority of that group are living on Sacramento streets. City Attorney Susana Alcala Wood's office has also repeatedly urged Ho to work with the city to address the issue, she said.

A sweeping change sought by the Securities and Exchange Commission would take fund managers' culpability a step further than current standards if they don't effectuate a greater standard of care. The rule change involves lowering the bar for indemnification of fund managers to "ordinary negligence" from "gross negligence." "It would monumentally change the relationship between fund managers and investors," said Marc Elovitz, partner and chair of the regulatory practice at Schulte Roth & Zabel, in an interview for the Delivering Alpha Newsletter. And investment managers are going to have a hard time protecting themselves from being on the hook for those risks." However, ILPA said that, "an ordinary negligence standard as applied to breach of contract would assure meaningful progress."

Bed Bath & Beyond on Sunday filed for Chapter 11 bankruptcy protection after a series of last-ditch efforts to raise enough equity to keep the business alive failed at the eleventh hour. Bed Bath has been hanging on by a thread ever since but has refused to go down without a fight. Days after the second stock offering was announced, Bed Bath said it had partnered with liquidator Hilco Global to boost its inventory levels. Soon, though, Bed Bath revealed in a securities filing that it didn't have enough cash to pay its debts and had defaulted on its credit line with JPMorgan. Under the reduced credit agreements, Bed Bath was on the hook for monthly interest payments.

Nov 29 (Reuters) - U.S. cryptocurrency brokerage Genesis said it was seeking to avoid bankruptcy after Bloomberg news reported on Tuesday that creditors to the firm are organizing with restructuring lawyers to prevent insolvency. "Our goal is to resolve the current situation in the lending business without the need for any bankruptcy filing," a Genesis spokesperson said. Genesis has hired investment bank Moelis & Company "to evaluate the best possible asset preservation strategy and effectuate a roadmap," the firm said in the letter. The crypto lending arm of U.S. digital asset broker Genesis Trading suspended customer redemptions earlier this month, citing the sudden failure of FTX, where its derivatives business has approximately $175 million in locked funds, the company had said. Venture capital company Digital Currency Group, which owns Genesis Trading and cryptocurrency asset manager Grayscale, owes $575 million to Genesis' crypto lending arm, Digital Currency Chief Executive Barry Silbert told shareholders this month.
