Fourteen Democratic senators will introduce an amendment Monday evening to remove language from Congress’ massive defense spending bill that seeks to ban coverage of gender-affirming care for transgender children of servicemembers, the office of Sen. Tammy Baldwin, D-Wis., told NBC News. I trust our servicemembers and their doctors to make the best healthcare decisions for their kids, not politicians,” Baldwin said in a statement. In a statement following the House vote last week, Johnson said the legislation prioritizes “military lethality, not radical woke ideology. A draft of a media release shared with NBC News — and scheduled to be made public Monday evening — from Baldwin’s office said that if the transgender health care provision survives, it could affect 6,000 to 7,000 children of U.S. servicemembers. The amendment to remove the trans health provision from the defense bill will be co-sponsored by Democratic Sens.

The House passed a massive defense spending bill Wednesday with a provision that bars the military’s health care program from covering transition-related care for minors. Johnson did not return a request for comment regarding the potential effects of the provision on some military families. “[B]lanketly denying health care to people who need it — just because of a biased notion against transgender people — is wrong,” Smith said in a statement Tuesday. She said the Tricare restriction would further affect where service members can live and how long they serve. “Military families with trans kids have been serving for decades and it’s never been an issue,” she said.

A UCLA student is suing multiple California health care providers and hospitals for medical negligence, alleging she was wrongly diagnosed with gender dysphoria and then “fast-tracked onto the conveyor belt of irreversibly damaging” puberty blockers, cross-sex hormones and surgery, according to her lawsuit. “There is strong consensus among the most prominent medical organizations worldwide that evidence-based, gender-affirming care for transgender children and adolescents is medically necessary and appropriate. Surgical gender-affirming care is rarely performed on minors, and these procedures are illegal in dozens of states, though California is not among them. Research suggests that regretting treatment for gender dysphoria is “extremely rare,” according to the World Professional Association for Transgender Health, or WPATH. Transition-related care for minors has been a divisive political issue, with Republicans in 26 states passing measures to ban or restrict gender-affirming care for minors in recent years, according to the Movement Advancement Project, an LGBTQ think tank.

The Montana Supreme Court on Wednesday affirmed a lower court ruling that temporarily blocked a state law prohibiting transition-related health care for minors. “Fortunately, the Montana Supreme Court understands the danger of the state interfering with critical healthcare,” Kell Olson, an attorney for Lambda Legal, said in a statement. The law also prohibits Medicaid from covering such treatments for trans minors. In upholding the injunction, Montana Supreme Court Justice Beth Baker wrote in the majority opinion that the Legislature “did not make gender-affirming care unlawful,” nor “did it make the treatments unlawful for all minors,” as minors can still receive the treatments for other reasons. The U.S. Supreme Court took up such restrictions for the first time last week, when it heard arguments over a similar law in Tennessee.

CNN —Pete Hegseth, President-elect Donald Trump’s pick for secretary of defense, has repeatedly criticized policies allowing gay people to serve openly in the US military, calling them part of a “Marxist” agenda to prioritize social justice over combat readiness. “But because I naïvely believed that’s what ending Don’t Ask Don’t Tell was all about. “It started with Clinton under ‘don’t ask, don’t tell,’” he said. “So it started, you know, we saw it under Clinton with the tinkering of ‘don’t ask, don’t tell’ and the reasons for those changes,” Hegseth said on a podcast promoting his book. “It was stuff like, ‘don’t ask, don’t tell,’ which was their immediate target, right?

The United Kingdom on Wednesday indefinitely banned new prescriptions of puberty blockers to treat minors for gender dysphoria. The announcement comes a week after the U.S. Supreme Court heard oral arguments in a case involving state bans on puberty-suppressing medication and other forms of transition-related care for minors. Puberty blockers are commonly prescribed to transgender children in countries throughout the Western world to delay the onset of puberty or pause it as it is transpiring. A temporary ban on new puberty-blocker prescriptions for British minors experiencing gender dysphoria was already put in place over the summer. The U.K. ban comes as the U.S. Supreme Court weighs the constitutionality of a Tennessee ban on gender-affirming care for minors.

WASHINGTON — A massive defense policy bill on track to clear the House on Wednesday includes a ban on gender-affirming care for children of servicemembers — a provision that sparked opposition from the top Democrat on the House Armed Services Committee. The sweeping must-pass bill — known as the National Defense Authorization Act or NDAA — was negotiated between senior House and Senate lawmakers. “[B]lanketly denying health care to people who need it — just because of a biased notion against transgender people — is wrong,” Smith said in a statement Tuesday. The NDAA, which authorizes appropriations for the Defense Department and sets defense policies, expires at the end of the year. However, House and Senate negotiators couldn't reach agreement on "sufficient pro-life protections," the speaker's office said.

“The litany of things that will start to topple is profound,” said James Hodge, a public health law expert at Arizona State University’s Sandra Day O’Connor College of Law. “One in 3,000 kids who gets measles is going to die. The U.S. has seen 16 measles outbreaks this year — 89% of cases are in unvaccinated people — and a whooping cough epidemic is the worst since 2012. “If you overturn the administrative state, the impact on public health will be long-term and serious,” said Dorit Reiss, a professor at the University of California’s Hastings College of Law. It would take years before enough children died before people said, ‘I guess measles is a bad thing,’” she said.

“Just who do we think we are?” Roberts said in the memorable 2015 dissent, when he similarly argued against judges intervening to protect individual rights. Roberts brushed aside arguments that Tennessee’s ban on gender-affirming care amounted to sex discrimination and said decisions regarding medical treatment were best left to state legislatures. When Roberts previously dissented from the decision declaring a constitutional right to same-sex marriage, he said the five-justice majority had hijacked the democratic process. “Stealing this issue from the people will for many cast a cloud over same-sex marriage, making a dramatic social change that much more difficult to accept. Same-sex marriage, on the other hand, has faded as a campaign issue in the decade after Obergefell.

WASHINGTON — The conservative-majority Supreme Court on Wednesday dives into the culture war issue of transgender rights as it weighs whether states can restrict gender transition care for minors. Democrats, including the Biden administration in the case now at the court, have sought to increase protections for transgender people. The surgery ban is not at issue in the Supreme Court case after a lower court judge said the plaintiffs did not have legal standing to challenge it. The case being argued Wednesday reached the Supreme Court after the Cincinnati-based 6th U.S. Circuit Court of Appeals issued a ruling last year rejecting challenges to the Tennessee law and a similar measure in Kentucky.

CNN —Montana lawmakers, including several Republicans, voted down a measure to ban the state’s first transgender legislator from using women’s restrooms at the State Capitol Tuesday. Democratic state Rep. Zooey Zephyr, who was first elected in 2022, applauded the legislators who voted against the bathroom ban in a post to social media. All Democrats, as well as several Republicans, voted against the measure. Republican state Rep. David Bedey, who did not support the bathroom ban, said while he has his own views on “the issue of gender dysphoria and how widespread it is,” he thought the measure was a distraction. The proposed bathroom ban in Montana follows an effort by national Republicans to ban Democratic Rep.-elect Sarah McBride, the first out transgender woman elected to Congress, from using women’s bathrooms in the US Capitol.

The Supreme Court will consider a law restricting transition-related health care for minors for the first time Wednesday, and legal experts say the court’s decision could affect access to transition-related care nationwide for both minors and adults for decades to come. The Supreme Court granted the Biden administration’s appeal of a 6th U.S. The court won’t consider the part of the law that bans surgery, which wasn’t covered by the lower court’s injunction. The ACLU and Lambda Legal noted in their petition to the Supreme Court that circuit courts have become split on the restrictions. Many families with trans kids have had to work around care restrictions to continue care for their children.

Strangio, an attorney for the ACLU, is set to make history Wednesday as the first known transgender person to argue before the US Supreme Court. With hindsight, Strangio’s career can appear like it’s been hurtling toward this week’s Supreme Court appearance. Esseks often gets asked, he said, whether the ACLU tapped Strangio to present its case before the Supreme Court because he’s trans. The Supreme Court ruling also could be life-altering for physicians like Dr. Izzy Lowell, whose telehealth practice, QueerMed, provides hormone therapy and other services for transgender and nonbinary people. “I think about all of the arguments that have that have been held in the Supreme Court over just the basic dignity of people.

It would be another 12 years before the NCAA made a major revision to its rules on transgender athletes. The Independent Council on Women’s Sports is financing a class-action lawsuit against the NCAA over its policy on transgender women athletes. But the rules of World Aquatics bar transgender athletes from competition unless they have not experienced biological puberty. And like cisgender athletes, trans athlete’s abilities vary.

But the Supreme Court’s upcoming and potentially explosive transgender care case is dividing conservatives, with many of those same groups backing Tennessee’s ban on puberty blockers and hormone treatments, which critics say injects the state into family medical decisions and overrides parental rights. Tennessee, and many conservatives who support the state’s position, argues parental rights aren’t a factor in the case. Conservative groups have lined up in federal courts to make nearly identical parental rights arguments in other cases. That separate lawsuit specifically asked whether the state law violates the “fundamental right of parents” to make decisions about the medical care of their children. In allowing the Tennessee ban to take effect last year, a divided 6th US Circuit Court of Appeals brushed aside the parental rights arguments.

The Summary Trump plans to tap Robert F. Kennedy Jr. to be his health and human services secretary. Kennedy has spread misinformation about vaccines, fluoride, raw milk and other topics. Kennedy has also referred to the Covid vaccine as “the deadliest vaccine ever made,” despite data showing it’s overwhelmingly safe. As many as 30 states allow raw milk to be sold, but the FDA regulates its sale across state lines. But Kennedy has cast doubt on those findings, claiming without evidence that the drugs were discredited because various groups stood to make money off Covid vaccines.

Circuit Court of Appeals on Wednesday comes as the U.S. Supreme Court prepares to hear a challenge to a similar law in Tennessee, which may ultimately determine whether all such state laws around the country can be enforced. Texas Attorney General Ken Paxton sued an El Paso doctor on Tuesday, accusing him of providing transition-related medical care to nearly two dozen minors in violation of state law. Texas enacted a law, Senate Bill 14, last year banning gender-affirming care for anyone under 18. Laws restricting access to transition-related care for minors exist in 26 states, according to the Movement Advancement Project, an LGBTQ think tank. The Texas lawsuits come just ahead of the presidential election, where transition-related care has become somewhat of a flashpoint. CNN —Former President Donald Trump continues to repeat his lie that US schools are sending children for gender-affirming surgeries without their parents’ consent — even though his own presidential campaign could not find a single example of this having happened. Without parental consent.” He added, “At first, when I was told that was actually happening, I said, you know, it’s an exaggeration. There is no evidence that schools in any part of the United States have sent children for gender-affirming surgeries without their parents’ approval, or performed unapproved gender-affirming surgeries on site; none of that is “allowed” anywhere in the country. Even in the states where gender-affirming surgery is legal for people under age 18, parental consent is required before a minor can undergo such a procedure. Some advocates for gender-affirming care for youth say the report mischaracterizes the normal caution being taken by researchers to carefully present and interpret scientific data. “They’re in really good shape when they come in, and they’re in really good shape after two years,” Olson-Kennedy told the Times. Her description appears to contradict the baseline characteristics of the 95 study participants, which were published in 2022. Numerous studies have documented high rates of suicide and suicidal thoughts in transgender children and teenagers, and the physical changes of puberty can greatly increase the distress of feeling trapped in the wrong body. Nine children – about 4% of the sample – expressed regret over puberty blockers or hormones, and four discontinued their therapy.

First openly transgender lawyer to argue at Supreme Court
  + stars: | 2024-10-21 | by ( ) www.nbcnews.com   time to read: +4 min
An American Civil Liberties Union lawyer will make history in December as the first openly transgender attorney to argue before the U.S. Supreme Court, opposing Tennessee’s Republican-backed law banning gender-affirming medical care for transgender minors. The Supreme Court on Monday ordered that the argument time for the ban’s challengers be divided between the Justice Department and attorneys representing the original plaintiffs who sued the state. Several plaintiffs — including two transgender boys, a transgender girl and their parents — sued in Tennessee to defend the treatments they have said improved their happiness and wellbeing. The Supreme Court has confronted several cases in the past decade implicating LGBTQ rights. In 2020, it ruled that a landmark federal law forbidding workplace discrimination protects gay and transgender employees.

Former President Donald Trump repeated his false claim that children are undergoing transition-related surgery during their school day, worsening fears among some conservatives that educators are pushing children to become transgender and aiding transitions without parental awareness. What the hell is wrong with our country?” Trump said Saturday at a campaign rally in Wisconsin, a vital swing state. About half the states ban transition-related surgery for minors, and even in states where such care is still legal, it is rare. The law limits the instruction of sexual orientation and gender identity in school and has been replicated in states across the country. Half of all teachers polled, including 62% of elementary school teachers, said elementary school students should not learn about gender identity in school.
