U.S. and Canadian banks reported a tenfold surge in digital scams this year as criminals flock to techniques that rely on duping customers into sending them money, according to cybersecurity firm BioCatch. Banks are under pressure to kick criminals off their platforms and compensate more victims as regulators and lawmakers focus on the harm done by digital scams. Customers of the three banks reported a combined $166 million in Zelle transactions were fraudulent in 2023. BioCatch declined to provide a specific number for reported scams, citing client confidentiality. In another sign of the cat-and-mouse dynamic of cybercrime, BioCatch clients reported 59% fewer fraudulent account openings.

Buying a knockoff used to be a consumer's dirty little secret, largely because a "fake" was considered inferior to the real thing, not to mention the economic cost and intellectual property rights infringement. But brand imitators, also known as dupes — short for duplicates — have elbowed their way into the mainstream and are now even cool. "It's not a direct knockoff, it's kind of revising something that's very chic from a designer world into a more accessible product," Walker said. Even when consumers can get the real thing, nearly 33% of adults intentionally purchased a dupe of a premium product at some point, according to a report by Morning Consult.

CNN —Alleged Sinaloa cartel co-founder Ismael “El Mayo” Zambada, in a statement released by his attorney, reiterated the claim he was “ambushed” and “kidnapped” by a son of notorious drug lord Joaquin “El Chapo” Guzmán and hand-delivered to US authorities. In a room with a table topped with fruit, Zambada said, Joaquín Guzmán gestured for the cartel boss to follow him to a dark room nearby. He said he was driven to a landing strip and forced onto a private plane, where Joaquín Guzmán removed his hood and bound him to a seat using zip ties. One version has Joaquín Guzmán duping Zambada to orchestrate their arrest, US law enforcement officials have told CNN. Zambada is expected to be transferred to New York from Texas, one official told CNN.

CNN —Russia has promised to discharge Indian nationals who were “misled” into joining its army to fight in Ukraine, India’s foreign secretary said Tuesday. “The Russian side promised the early discharge of all Indian nationals from the service of the Russian army,” he said. “The trafficked Indian Nationals were trained in combat roles and deployed at front bases in Russia-Ukraine War Zone against their wishes,” the CBI statement said. Three people were indicted for an identity theft conspiracy that allegedly included the $400 million hack from FTX on the same day in November 2022 that the doomed cryptocurrency exchange filed for bankruptcy protection, court records show. A source familiar with the case confirmed that FTX was the victim mentioned in the indictment. Later on Nov. 11 and continuing into the next day, "co-conspirators transferred over $400 million in virtual currency from [FTX's] virtual currency walls to virtual currency wallets controlled by the co-conspirators. The indictment says that several weeks before the FTX hack, the scheme looted $293,000 in virtual currency from one victim, and days later, stole more than $1 million in crypto from another person. A day after the FTX hack, the conspirators stole about $590,000 in crypto from an individual's virtual wallet.

Assistant U.S. Attorney Adam Deitch said in court that Waithe's scheme victimized at least 50 women. Waithe worked at Northeastern from October 2018 to February 2019, when the university fired him, and had previously coached at Penn State University, Illinois Institute of Technology, University of Tennessee and Concordia University Chicago. Trevor Milton's lawyers say he should avoid prison because his fraud conviction is not like that of Elizabeth Holmes. Holmes was convicted on charges that she defrauded investors in blood-testing company Theranos. Milton was convicted on charges that he duped investors with exaggerated claims about zero-emission Nikola trucks. Court officials have calculated federal sentencing guidelines to recommend between 17 1/2 years and 22 years in prison, although Milton's lawyers object to the calculations, saying they substantially overstate the seriousness of the crimes. "Unlike Holmes, Trevor never put Nikola's customers at risk, whereas Holmes touted and used blood-testing technology that she knew to be unreliable, thus putting human beings at medical risk," the lawyers said.

Holmes, 39, is serving an 11-year sentence for defrauding investors in the blood-testing company Theranos. “Unlike Holmes, Trevor never put Nikola's customers at risk, whereas Holmes touted and used blood-testing technology that she knew to be unreliable, thus putting human beings at medical risk,” the lawyers said. The decision about which contract prevails, in turn, would determine if the dispute proceeds in arbitration or in court. Upon creating their Coinbase accounts, users agreed to resolve any disputes with Coinbase in arbitration. But a subsequent agreement that related specifically to the sweepstakes said disputes over the contest should be heard in court in California. A federal judge in California refused Coinbase's request to force the dispute into arbitration, as the company argued the user agreements required.
