CNN —Former special prosecutor Nathan Wade says he believes Donald Trump will “absolutely” be put on trial in Georgia in the 2020 election subversion case – even if he wins a second term and he’s in the White House at the time. The question of whether a sitting US president can be forced to stand trial for state-level criminal charges has never been litigated. Wade said in the interview Wednesday that he expects prosecutors and defense attorneys will have to confront that unprecedented scenario if Trump wins the 2024 election. Nathan Wade was asked if he thinks Trump can still be on trial as president. Trial court Judge Scott McAfee had previously ruled that Willis could remain on the case if Wade stepped away, prompting his resignation.

CNN —Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. In her seven years as a Justice Department attorney, Cannon participated on the trial teams of just four criminal cases. Still, Cannon has asked questions in the Trump case that appear out of left field. Her orientation toward such legal rabbit holes is not distinct to the Trump case, veterans of her courtroom say. Ultimately, nearly every attorney CNN spoke to said that Cannon, despite the criticism, is unwavering in her beliefs about how each case in her courtroom should proceed.

US District Judge Aileen Cannon will hear arguments from defense attorneys on two separate bids to throw out charges in the case. Trump is accused by special counsel Jack Smith of taking classified national defense documents from the White House after he left office and of resisting the government’s attempts to retrieve the materials. Trump has obtained permission from the judge to skip Wednesday’s proceedings, which will start at 10 a.m. On Tuesday, hundreds of pages of previously sealed court filings were posted publicly as part of efforts by the former president to have the charges against him thrown out. She expressed “concern” the special counsel’s office had sought redactions of information in the newly unsealed filings after previously giving its OK for that information to be published in full in earlier court filings.

CNN —Months before Donald Trump was indicted for mishandling classified documents, a federal judge said that investigators had “strong evidence” that the former president “intended” to hide classified documents at his Mar-a-Lago resort, according to newly released court documents. Judge Beryl Howell cited, among other things, the discovery of additional classified documents found at Mar-a-Lago months after the FBI’s search of the property in the summer of 2022. The ruling was among hundreds of pages of previously sealed filings that were publicly docketed Tuesday in the criminal classified documents case against Trump. Nauta has been charged alongside Trump and Mar-a-Lago property manager Carlos De Oliveira in the case, facing charges of mishandling sensitive or classified materials and obstruction. The case against Trump, brought last summer, is currently in front of Judge Aileen Cannon in Fort Pierce, Florida.

The longer it takes for Cannon to decide these issues, the more likely a trial would need to wait until after the November presidential election. But Cannon’s critics view the pace of the Trump prosecution with added suspicion because of how she handled a separate, 2022 lawsuit Trump brought attacking the FBI’s documents investigation. In that lawsuit, Cannon granted an extraordinary Trump request for a third-party review of the FBI’s 2022 search of his Mar-a-Lago resort for the classified documents. Now, critics accuse Cannon of – purposely or not – playing into Trump’s strategy of delaying the trial until after the election. WASHINGTON (AP) — Justice Department special counsel Jack Smith warned Tuesday that former President Donald Trump's “daily” statements risk tainting a jury pool in Washington in the criminal case charging him with scheming to overturn the results of the 2020 presidential election. Trump's provocative comments about both Smith's team and U.S. District Judge Tanya Chutkan — who is presiding over the case — have been a central issue since the indictment was filed last month. Prosecutors have repeatedly signaled their concerns about the impact of Trump's social media posts and Chutkan explicitly warned Trump against inflammatory remarks that could intimidate witnesses or contaminate potential jurors. Chutkan agreed with the Trump team that it should have time to respond to the Justice Department's filings and set deadlines for next week. Trump faces three other prosecutions besides the federal election subversion case.

CNN —Federal prosecutors in Manhattan filed another indictment against FTX co-founder Sam Bankman-Fried Monday, dropping another count against him. Prosecutors had previously indicated their plans to drop the one count of conspiracy to make unlawful campaign contributions against Bankman-Fried last month in a letter to the court. Prosecutors maintain that Bankman-Fried conducted an illegal campaign finance scheme in connection to the charges that are moving forward to trial. “The defendant’s use of customer deposits to conduct a political influence campaign was part of the wire fraud scheme charged in the original indictment. Bankman-Fried’s attorneys said they reserve the right to challenge evidence prosecutors may seek to use.

The plaintiff’s filing accuses JPMorgan of intentionally slow-walking its document production to avoid questioning on certain topics during depositions that occurred over the last few months. The plaintiff attorneys want to ask Dimon about an extensive JPMC internal review related to Epstein conducted in the fall of 2019. The financial institution produced “key documents” related to that review days after Dimon’s deposition, according to the motion. “These documents demonstrate that JPMC was fully capable of learning the full extent of Epstein and Staley’s personal relationship,” the filing says. “We do not believe there is any basis to reopen any of these depositions,” a spokesperson for JPMC told CNN on Friday afternoon.

Trump golfed in Ireland rather than attend two significant Manhattan court cases docketed Thursday. He continued to skip the E. Jean Carroll rape-defamation case now wrapping in federal court. "I will probably attend," he told reporters of the Carroll trial. When Irish reporters asked Trump why he wasn't attending his Manhattan civil trial, he responded, "Because we have a longstanding agreement to come here." When one reporter asked whether he was showing "disrespect" to the court, Trump walked away.
