CNN —After the suicide of a nonbinary student last February spurred a monthslong federal investigation, the US Department of Education found Title IX violations in an Oklahoma public school district including multiple failures to respond to notices of sexual harassment. The DOE’s Office of Civil Rights announced a resolution Wednesday with the Owasso Public School District to remedy Title IX violations linked to sexual harassment in district schools. The OCR investigation began last March, weeks after the death of nonbinary teen, Nex Benedict. The investigation also identified several other instances in the last three years when district staff failed to properly respond to sexual harassment complaints. The agreement between the DOE and the school district requires the district to implement new policies and procedures and additional training for staff and students.

CNN —Donald Trump’s lawyers and the Manhattan district attorney’s office have agreed to delay activity in the hush money case until November 19 to give the president-elect’s lawyers time to make new arguments on how his election victory impacts the case. CNN —A Manhattan grand jury has indicted Harvey Weinstein on new sex crime charges, according to his attorney Arthur Aidala. “The grand jury has indicted Mr. Weinstein,” prosecutor Nicole Blumberg said during a court hearing on Thursday. It could include sexual assault allegations from three women, prosecutors said at a separate hearing last week. One alleged assault occurred at a residential building in lower Manhattan in the winter months between 2005 and 2006. CNN —Harvey Weinstein was “rushed” to Bellevue Hospital in New York on Sunday night “due to several medical conditions,” according to representatives for the disgraced former movie producer. “We can confirm that Mr. Weinstein had a procedure and surgery on his heart today,” Weinstein’s spokesman Juda Engelmayer and prison consultant Craig Rothfeld said in a statement to CNN on Monday. “As we have extensively stated before, Mr. Weinstein suffers a plethora of significant health issues that need ongoing treatment,” they added. Weinstein has experienced a number of health problems in recent years and has appeared in court in a wheelchair. He was sentenced to 23 years in prison, but his conviction was overturned on appeal in April.

CNN —A New York appeals court has rejected Donald Trump’s attempt to lift a gag order that continues to restrict his public statements in the wake of his New York criminal conviction. As it stands, the gag order bars Trump from publicly discussing the prosecutors, court staff and their families. In the decision filed Thursday, a panel of judges from the Appellate Division First Department said Judge Juan Merchan can keep the gag order in place through Trump’s sentencing. “Contrary to petitioner’s contentions, the People’s evidentiary submissions in opposition to his motion in Supreme Court demonstrate that threats received by District Attorney staff after the jury verdict continued to pose a significant and imminent threat,” the appeals court ruled. Trump’s sentencing, which was originally scheduled for July, was delayed to mid-September while Merchan considers his motion to toss the conviction in the wake of the US Supreme Court’s presidential immunity decision.

CNN —New York’s attorney general urged the Supreme Court on Wednesday to stay out of Donald Trump’s hush money criminal case, arguing the nation’s highest court should not grant a novel request by Missouri to pause his sentencing hearing and lift the gag order imposed on the former president in the case. Earlier this month, Missouri Attorney General Andrew Bailey, a Republican, asked the Supreme Court for permission to file a complaint against New York to pause Trump’s September sentencing hearing and lift the restrictions on his speech – arguing in part that New York was infringing on the right of Missouri voters to hear from presidential candidates. “Allowing Missouri to file this suit for such relief against New York would permit an extraordinary and dangerous end-run around former President Trump’s ongoing state court proceedings and the statutory limitations on this Court’s jurisdiction to review state court decisions,” she wrote.
