When Oregon embarked on a landmark plan three years ago to decriminalize hard drugs, it wagered that a focus on treatment over punishment would create a new model for drug policy around the country. But after a deluge of overdose deaths and frequent chaos in the streets of Portland, Gov. Tina Kotek signed into law on Monday a measure to restore criminal penalties for drug possession. The rollback has supporters among a wide range of public officials, including Mayor Ted Wheeler of Portland, who found himself presiding over a series of crises since taking office in 2016. He has battled in court to ban daytime camping and tried to establish mass shelter locations (known in Portland as TASS sites) for those without housing.

(AP) — The Oregon Court of Appeals on Monday asked the state's highest court to decide whether Republican state senators who carried out a record-setting GOP walkout this year can run for reelection. Oregon voters last year overwhelmingly approved the ballot measure that created the amendment following GOP walkouts in the Legislature in 2019, 2020 and 2021. They and Oregon Department of Justice attorneys on the opposite side of the case jointly last month asked the appeals court to send the matter straight to the state Supreme Court. The appeals court on Monday formally asked the Oregon Supreme Court to take the case, said Todd Sprague, spokesman for the Oregon Judicial Department. The senators insist that the way the amendment to the state constitution is written means they can seek another term.

When Oregon was getting ready to vote on whether to decriminalize all drugs in 2020, I was covering the story for Vox. During my interviews with the leaders of the decriminalization campaign, they often cited Portugal. Even as Portugal ended prison time for drug possession, it created a unique system that pushed people to stop using drugs — sometimes with the continued threat of penalties, like the revocation of a person’s professional license. Oregon didn’t plan to enact similarly tough penalties, and advocates for decriminalization did not have a clear explanation for why their law would work as well as Portugal’s. Our conversations left me wondering whether Oregon could repeat Portugal’s successes if the decriminalization initiative passed.
