But holding the White House and Senate majority for another few weeks doesn’t guarantee Democrats will have an easy time processing the final batch of Biden appointees. “There is a push across the board from the White House and the Senate for Democrats to show up and do the job they were elected to do,” a senior White House official, asking for anonymity to speak candidly, told CNN. The White House official pointed to how Republican Texas Sen. John Cornyn on Saturday promised “no weekends, no breaks” to confirm Trump’s Cabinet once he took power, and the White House official encouraged Democrats to show that dedication to judges in Biden’s final stretch. “Regardless of party, the American people expect their leaders to prioritize the rule of law and ensuring the criminal justice system can function effectively in every stated,” said White House spokesperson Andrew Bates. There are around nine – depending on what the calendar will allow – other Biden nominees who could still come through committee.

"Look at which tax cuts were getting the most focus on the campaign trail. A traditional GOP tax policy might be thought of as favoring business tax cuts. "The top priority is extending the Trump tax cuts and the signature part of his program. Jim Justice won the state’s open Senate seat Tuesday, NBC News projects, moving Republicans one step closer to flipping the balance of power in the chamber. Justice faced little competition from Wheeling Mayor Glenn Elliott, a Democrat, in a race that Republicans were heavily favored to win after the retirement of independent Sen. Joe Manchin, who left the Democratic Party in May. Justice won election as governor in 2016, the year Trump won the state by more than 42 percentage points. After months of publicly clashing with his party, Manchin announced he wouldn’t seek re-election. But Justice cruised to victory, defeating Mooney by 35 points in May, and faced little political opposition since.

And although Republicans are well positioned to win the majority, Democrats cannot be counted out entirely. Senate seats in the three states that Donald Trump won twice (West Virginia, Montana and Ohio) have always been the most likely to flip. Democrats aren’t trying to defend West Virginia. The three “blue wall” states of Michigan, Pennsylvania and Wisconsin – which are also crucial presidential battlegrounds – started the cycle looking more comfortable for Senate Democrats. Keep reading here about the Senate seats that are expected to flip.

GOP senators and top aides say the race could go either way. Scott, who is a McConnell critic, has been more willing to fall in line with Trump than Cornyn or Thune over the last several years. Both Thune and Cornyn are closely politically aligned with the longtime GOP leader. Asked if he would like to get more public endorsements from GOP senators, Thune said he is not asking anyone to do that. They also point out his remarkable ascent – he defeated then-Senate Democratic Leader Tom Daschle in 2004 and is now on a path to possibly becoming GOP leader.

Democratic congressional leaders had remained quiet so far — but there were signs that could soon change. Massachusetts Rep. Katherine Clark and California Rep. Pete Aguilar, the second- and third-ranking House Democrats, endorsed Harris on Monday morning. The Clintons, in a statement Sunday, endorsed Harris; Obama did not, deferring to the party’s process. In those phone calls, Harris made clear that while she was grateful for Biden’s endorsement, she planned to earn the Democratic nomination in her own right. Longtime Democratic operative Donna Brazile said that she was in the process of gathering delegates to support Harris.

Sen. Joe Manchin, D-W.Va., is seen in the U.S. Capitol on Wednesday, September 6, 2023. Independent Sen. Joe Manchin on Sunday called on President Joe Biden to exit the race against former President Donald Trump. Along with Manchin, 36 Democratic lawmakers, including four senators, have called on Biden to exit the race and allow a new nominee to take the helm of the ticket. Over the past week, Manchin had been hinting at his slipping support for Biden as the presumptive Democratic nominee. Throughout the Biden administration, Manchin has positioned himself as a conservative Democrat, sometimes opposing large parts of the president's agenda.

Washington CNN —President Joe Biden’s struggle to prove he’s got the strength and cognitive capacity for a second term is becoming an excruciating personal and national ordeal. While his interview performance was far stronger than the president’s often incoherent showing at the CNN debate in Atlanta, that’s not saying much. He appeared more composed and fluent than at the CNN debate. But Democratic Rep. Brad Sherman of California told CNN that the president needed to do a prolonged and live television interview unlike the recorded one on ABC. But increasingly, it seems as though the fear of a Trump term may be overwhelming satisfaction with Biden’s achievements.

CNN —West Virginia Gov. Jim Justice will win the state’s Republican US Senate primary, CNN projects, positioning the two-term governor as the clear favorite to succeed retiring Democratic Sen. Joe Manchin in the deep-red state. The West Virginia Senate seat has long been seen as the most likely to flip this cycle and will be key to GOP hopes of winning the Senate this November. National Republicans, including former President Donald Trump, largely coalesced in the West Virginia Republican primary around Justice, who was barred by term limits from seeking reelection as governor. Still, in the closing weeks, the Senate contest turned bitter as Justice and Mooney traded sharp jabs on air.

CNN —The centrist group No Labels is abandoning plans to form a third-party presidential unity ticket for this year’s election. “But No Labels has always said we would only offer our ballot line to a ticket if we could identify candidates with a credible path to winning the White House. The Wall Street Journal was first to report on the No Labels decision not to field a presidential ticket. In its quest for a unity ticket, the group had been rebuffed by several high-profile figures, including former New Jersey Gov. The group had previously set a March deadline to decide on whether to field such a ticket.

CNN —Ohio’s Republican Senate primary on Tuesday – this year’s first test of Donald Trump’s clout in a contested Senate race – will help determine a key question this fall: What is the fate of Sen. Sherrod Brown and the Democratic majority? Despite already having clinched the GOP presidential nomination last week, Trump has a lot on the line in Ohio on Tuesday. “Trump endorsed Bernie Moreno for Senate.”But Democrats are also trying to use the former president’s popularity in this red state to their advantage. At over $40 million as of Monday, Ohio’s Senate race trails only the US presidential race, the 2023 Kentucky governor’s race and the 2024 California Senate race in total ad spending so far. “The person who clearly has the best shot of winning in the fall is Matt Dolan – I think our common sense tells us that.”But the governor’s backing could cut both ways for Dolan, Ohio Republican strategists told CNN.
