Nadra Wilson was also listed as a noncitizen and was purged from Virginia’s voter rolls. She also didn’t realize she had been purged from Virginia’s voter registration rolls until she received a call from CNN. The bitter nationwide debate over transgender rights is playing out on a very personal level in a federal court lawsuit filed in Virginia by a former Liberty University employee. She was fired by the evangelical Christian school after disclosing her identity as a transgender woman. The lawsuit on behalf of Ellenor Zinski was filed in July by the American Civil Liberties Union of Virginia and the Richmond law firm of Butler Curwood. Earlier this month, the conservative legal organization Liberty Counsel filed a brief on behalf of the university asking the federal district court to dismiss the lawsuit. Wyatt Rolla, the ACLU of Virginia’s senior transgender rights attorney, rejected the claim of a set-up.

WASHINGTON — The Supreme Court on Wednesday allowed Republican officials in Virginia to revive a plan aimed at removing noncitizen voters from the rolls ahead of next week’s election. Virginia has same-day voter registration, meaning that any eligible voter who was removed from the rolls should still be able to vote. The Justice Department said that while states can review its voter rolls, it cannot do so right before an election. States are barred from systematically removing people from voters rolls within 90 days of an election under the National Voter Registration Act. In court papers, the groups said that "the record makes clear that citizens are being removed from the voter rolls."

Republicans, including former President Donald Trump, framed the effort in Virginia as a commonsense way of ensuring noncitizens don’t vote. At issue are about 1,600 voter registrations that Virginia said came from self-identified noncitizens but that a US District Court said hadn’t been fully vetted for citizenship status. Noncitizens are not allowed to vote in federal elections; none of the lower court rulings had changed that fact. But documented cases of noncitizens voting are extremely rare. Those opposed to the program relied on a 1993 law, the National Voter Registration Act, which bars states from making “systematic” changes to voting rolls with 90 days of a federal election.

There is still time for those patterns to shift — and we’ve already seen them shift in twists and turns through recent weeks of early voting. Consistent with that hypothesis, the below table of early voting through Oct. 26 shows substantial leveling in the usage of early voting over different areas. One of the broader challenges of interpreting early vote totals in most states is the lack of sufficient historical data to benchmark against the current returns. The below table shows the number of recent elections in which this year’s Virginia early voters participated. Just as previous research suggests, an overwhelming number of the absentee ballots cast so far have been cast by consistent voters.

Democratic Rep. Colin Allred is giving the polarizing Republican Sen. Ted Cruz a run for his money, presenting him as a do-nothing extremist. A federal judge on Friday granted a Department of Justice request to block Virginia from systematically removing alleged noncitizens from the voter rolls this close to an election. "All of the eligible voters who were wrongfully purged from the voter rolls will now be able to cast their ballots," Snow said. The Justice Department said in a previous filing that 43 people removed from rolls in Prince William County were likely U.S. citizens. States are barred from systematically removing people from voters rolls within 90 days of an election under the National Voter Registration Act. Early voting is getting underway throughout the country, including in key battleground states like Georgia, where more than 300,000 people voted Tuesday, the first day of early voting. However, there were substantial differences in the number of early voters based on a city or county’s partisan lean. So far in 2024, more absentee voting has occurred in places that tend to support Republicans than places that tend to lean Democratic. However, if early voters are less consistent or new voters, it could signal a shift in electoral trends ahead of November. These satellite voting locations may make early in-person voting accessible in more populous areas, which tend to be more Democratic-leaning.

Amazon Web Services is investing over $500 million in nuclear power, announcing three projects from Virginia to Washington State. Amazon is the latest large tech company to buy into nuclear power to fuel the growing demands from data centers. America PAC has taken on a critical supporting role for the Trump campaign, according to its independent expenditure filings, which cover some spending beyond September 30. Tuesday’s filings show other conservative billionaires also plowing extraordinary sums into the effort to reelect Trump. Another leading pro-Trump super PAC, Restoration PAC, also reported a huge haul from a single major donor. The Justice Department announced Friday that it is suing Virginia over its efforts to purge voter rolls within 90 days of an election, calling the state's actions a violation of federal voting laws. Glenn Youngkin signed an executive order requiring the state's Department of Elections to conduct daily updates to its voting list, including comparing the list of identified "noncitizens" to the state's existing list of registered voters. According to the Justice Department, some of the people identified as noncitizens are in fact U.S. citizens, leading to some voter registrations being cancelled unnecessarily. In a statement, Youngkin called the lawsuit "politically motivated" and a "desperate attempt" to attack the election's legitimacy. Virginia’s Department of Elections and elections commissioner — both named in the lawsuit — did not immediately respond to requests for comment Friday evening.
