Securities and Exchange Commission Chairman Gary Gensler has sought to dramatically increase regulation of corporate America, vastly increasing disclosure requirements in particular. In response, corporate America has brought an avalanche of lawsuits against Gensler and the SEC. With a new regime now coming into the SEC following Donald Trump's victory in the presidential race, how will they respond to the lawsuits? Are there are any favorites for SEC chairman? Dan Gallagher, now serving as Robinhood's chief legal officer and formerly a Republican SEC commissioner, has been floated as a possible replacement.

Signage is seen at the headquarters of the U.S. Securities and Exchange Commission (SEC) in Washington, D.C., U.S., May 12, 2021. The SEC said Impact Theory marketed its Founder's Keys--sold in "Legendary," "Heroic" and "Relentless" tiers--as a means to profit from its business by investing at an early stage. Impact Theory allegedly raised $29.9 million by selling 13,921 Founder's Keys in late 2021, and received $978,000 of royalties from secondary sales. The SEC said Impact Theory also compared its NFTs with "handing ($20) to Mark Zuckerberg in his dorm room," referring to the billionaire Facebook co-founder. SEC commissioners Hester Peirce and Mark Uyeda partially dissented from Monday's settlement, saying the regulator owed investors better guidance on NFTs.

However, Gensler has claimed that pension funds and other institutional investors are not able to interact with that retail order flow. Auctions: the industry lines up against it The auction proposal has generated a large volume of comment letters to the SEC. He has said investors today need a better understanding of how well their trading orders are being executed. Theoretically, the SEC could vote on any or all of the four proposals in a shorter time period. This is just the start This is just the start of many proposals in front of the SEC.
It's just ridiculous that anybody would buy this stuff," Munger, 99, told CNBC's Becky Quick during a livestream of the event, adding: "It's totally absolutely crazy, stupid gambling." "I think the people who oppose my position are idiots, so I don't think there is a rational argument against my position," he said. Munger's comments come amid an avalanche of problems for crypto investors over the past year. He's previously urged the U.S. government to ban cryptocurrencies, and may partially get his wish as the crypto industry faces rising regulatory crackdowns. "In other words, an adviser may custody crypto assets at a bank, but banks are cautioned by their regulators not to custody crypto assets," Uyeda wrote.

"We've had a number of applications ... none of those have been approved to date," said Uyeda, who was in Singapore to speak at the ICI Global Asset Management Asia Forum. Earlier this month, the SEC delayed a decision on whether to allow a spot bitcoin ETF by stock-picker Cathie Wood's Ark Invest and crypto investment product firm 21Shares US to list and trade on Cboe Global Markets until Jan. 27. The regulator has rejected over a dozen spot bitcoin ETF applications, and approved several bitcoin futures-based ETFs. The rejections have focused on applicants' lack of surveillance-sharing agreements with regulated markets relating to the spot funds' underlying assets. Uyeda added that the SEC continues to consider applications filed by exchanges "as they come up".
