The long-awaited Google-DOJ showdown focuses on the $31 billion portion of Google’s ad business that matches website publishers with advertisers. “One monopoly is bad enough, but a trifecta of monopolies is what we have here,” said Wood, the DOJ attorney, referring to Google’s publisher ad server business, its advertising exchange AdX, and its advertiser ad network. Authorities have called for that group of businesses within Google — which is distinct from Google’s search or search ads business — to be broken up. Factoring in those other sources of competition drops Google’s share of the ad exchange market from 34% to 17%, said Dunn, Google’s attorney. Still, a breakup of Google’s ad tech business could potentially trigger a shakeup of the digital advertising industry and Google’s role within it.

On a mild Houston day in March 2021, Judge Marvin Isgur prepared to oversee the only case on his docket that morning. In October 2023, the Fifth Circuit Court rebuked Judge David Jones but said that his longtime colleague, Judge Marvin Isgur, had been "unaware" of Jones' inappropriate relationship. "But only Judge Isgur knows what he knew or didn't know about the relationship." Much of this work was in cases before either Judge Isgur or Judge Jones. Isgur can continue to hear the case, he ruled, writing in the December 2023 opinion that lawyers for the creditor "failed to demonstrate much other than that former Judge Jones and Judge Isgur are close friends."

The Supreme Court’s recent rescue of an important federal agency from the hands of a hostile lower court was an exercise in the evolving definition of originalism. A mechanism that the United States Court of Appeals for the Fifth Circuit deemed unconstitutional was clearly known to and accepted by the Constitution’s framers, Justice Thomas concluded. Justice Elena Kagan wrote a concurring opinion to say that while the old history was enlightening and adequate to support the agency’s constitutionality, modern practice supported it as well. “All the flexibility and diversity evident in the founding period,” she wrote, has “continued unabated” when it comes to financing government operations. Notably, two of the court’s conservatives, Justices Brett Kavanaugh and Amy Coney Barrett, in addition to Justice Sonia Sotomayor, joined Justice Kagan’s endorsement of the significance of later, even contemporary, practice when interpreting the Constitution.

The city of Berkeley, Calif., has agreed to repeal a landmark climate rule that would have banned natural gas hookups in new homes, throwing into question the fate of dozens of similar restrictions on gas in cities across the country. The city settled the lawsuit last week by agreeing to immediately halt enforcement of the rule and eventually repeal it altogether. “To comply with the Ninth Circuit’s ruling, we have ceased enforcement of the gas ban,” Farimah Brown, the city attorney for Berkeley, said in an email. However, she added, “Berkeley will continue to be a leader on climate action.”The decision could have widespread ripple effects. Many of those efforts are facing fierce resistance and legal challenges from the gas industry, restaurants and homebuilders.

These broadsides frequently trigger surges in threats against the judges, prosecutors and other court officials he targets, Reuters found. In that time, serious threats against federal judges alone have more than doubled, from 220 in 2020 to 457 in 2023, as Reuters reported on Feb. 13. For judges, threats have always been part of the job. Over the last four years, the Marshals investigated more than 1,200 threats against federal judges that they considered serious, according to the data provided to Reuters. Among the 57 federal prosecutions Reuters identified during that period, 47 involved threats against federal judges, six involved threats against state judges, and four involved threats against both.

Former President Donald J. Trump’s claim that he was immune from being prosecuted for any crimes he committed while trying to stay in office after losing the 2020 election was always a long shot. But in an opinion on Tuesday eviscerating his assertion, three federal appeals court judges portrayed his position as not only wrong on the law but also repellent. They included two Democratic appointees and, significantly, Judge Karen L. Henderson, a Republican appointee who had sided with Mr. Trump in several earlier legal disputes. The ruling systematically weighed and forcefully rejected each of Mr. Trump’s arguments for why the case against him should be dismissed on immunity grounds. Most people know by now about the border war between Texas and the United States playing out along the banks of the Rio Grande. Less obvious, but no less consequential, is an emerging border war inside the Supreme Court. At the physical border are 29 miles of coiled razor wire on the United States side of the river, put in place by the Texas National Guard on orders from Gov. It has had the added and hardly unpredictable effect of barring access to the border by the federal Border Patrol agents. The state lost in Federal District Court on the grounds that the United States is immune from suits of this type.

A group of transgender veterans filed a lawsuit Thursday seeking to force the Department of Veteran Affairs to begin providing and paying for gender-affirming surgeries. A spokesperson for the Department of Veterans Affairs said it does not comment on ongoing litigation. But he pointed to 2021 statements from Veteran Affairs Secretary Denis McDonough, who said the VA was beginning a years long rulemaking process that would result in providing gender-affirming surgeries. McDonough said the VA would use the time to “develop capacity to meet the surgical needs” of transgender veterans. Natalie Kastner, a 39-year-old disabled veteran from Texas, said she went to the VA in 2022 seeking surgery.

The deal will expand an existing commercial project by Google in the region to the nations of Micronesia, Kiribati, the Marshall Islands, Papua New Guinea, the Solomon Islands, Timor-Leste, Tuvalu and Vanuatu. Set to be announced during an official White House visit by Australian Prime Minister Anthony Albanese, the previously unreported deal involves contributions from both governments. Google is currently working on a fiber-optic cable that links Taiwan, the self-ruled island claimed by China, with the Philippines and the United States. But in a written order, U.S. District Judge Lewis Kaplan said three proposed witnesses cannot take the stand, because their testimony was irrelevant or could confuse the jury. He also said Bankman-Fried may seek to call the remaining four experts, but only to rebut prosecution witnesses.
