A bipartisan bill to change Social Security benefit rules for pensioners passed in the House of Representatives on Tuesday, with 327 lawmakers voting to support the measure. The proposal — called the Social Security Fairness Act — would repeal rules that reduce Social Security benefits for individuals who receive pension benefits from state or local governments. It would eliminate the windfall elimination provision, or WEP, that reduces Social Security benefits for individuals who worked in jobs where they did not pay Social Security payroll taxes and now receive pension or disability benefits from those employers. About 3% of all Social Security beneficiaries — about 2.1 million people — were affected by the WEP as of December 2023, according to the Congressional Research Service. As of December, about 1% of all Social Security beneficiaries — or 745,679 individuals — were affected by the GPO, according to the Congressional Research Service.

The most pressing concerns are for convicted rioters required to report to prison before Trump’s inauguration in January, and for rioters with sentencing hearings coming up, according to a source familiar with the discussions. “They’re thrilled with the election, but there’s a lot of uncertainty from their perspective,” the source told CNN. For convicted rioters already serving prison sentences, there’s even less hope to get them out based on Trump’s campaign rhetoric, the source said. She later told CNN that her strategy guide has already been sent to Trump and the Republican National Committee.

CNN —The Supreme Court on Tuesday turned away an appeal from John Nassif, a January 6 defendant who challenged a law that bans “parading, picketing, and demonstrating” at the US Capitol as a violation of the First Amendment. After he was charged with four misdemeanor counts, he attempted to have the charge forbidding “parading, demonstrating, or picketing in a Capitol building” dismissed. Lower courts, including the federal appeals court in Washington, DC, declined to do so. The appeals court ruled that the Capitol buildings are not a public forum open to protests. “Nassif has not established that the Capitol buildings are, by policy or practice, generally open for use by members of the public to voice whatever concerns they may have – much less to use for protests, pickets, or demonstrations,” a three-judge panel ruled.

Since it is a state case, Trump does not have the power to pardon himself next year after he is sworn into office. Federal cases in DC and FloridaTrump’s election victory is poised to have the greatest impact on the two federal criminal cases brought against him by Smith in Washington, DC, and Florida. Dismissing Smith would allow the Department of Justice and Trump’s attorney general to move to drop the charges against him and end the court cases. In the DC case, Smith charged Trump over his efforts to overturn his election loss in 2020. CNN —Sarah McBride, a Delaware state senator, will win her state’s at-large US House seat, making her the first out transgender person to serve in Congress, CNN projects. Despite running in a reliably blue state, McBride emphasized her work leading a bipartisan push to pass paid family and medical leave in the state. McBride, a former spokesperson for the Human Rights Campaign, an LGBTQ rights group, has made history throughout her public life. Four years later, McBride became the first transgender person to address a national party convention, when she spoke at the 2016 Democratic National Convention. And in 2020, McBride became the first out transgender person elected to serve in a state Senate, when she was elected to represent a seat in northern Delaware.

Meta last week began blocking advertisers from creating or running new ads about US social issues, elections or politics across its platforms, including Facebook and Instagram. But experts say that previous moves by social media companies — such as cutting their own internal safety teams — could undercut their current efforts. Former President Donald Trump and many of his supporters have already made repeated false claims that Democrats are cheating in the election. But since then, those companies have made cuts to those teams and walked back policies designed to restrict false claims about politics and elections. Last year, they said they would no longer remove false claims that the 2020 election was stolen.

CNN —The tumultuous 2024 election is ending with a contrast that encapsulates America’s fateful choice on election eve. The vice president also proposes reforms to improve the lives of working Americans — but hers are less revolutionary than Trump’s. If she loses Pennsylvania, Harris would need a combination of other swing states, including Georgia, Nevada and Arizona, where poll averages also show no clear leader. But the findings, which suggested a shift toward Harris from the previous Iowa Poll in September, also showed the vice president with a strong advantage among women. If such a pattern is repeated nationwide, the vice president could be headed to victory if she can limit her deficit to Trump among White males especially.
