Welcome to a post-debate edition of the From the Politics Desk newsletter, breaking down all the action from tonight's showdown between Vice President Kamala Harris and former President Donald Trump. Vice President Kamala Harris, who took the Democratic nomination when President Joe Biden stepped aside following a catastrophic debate performance in June, delivered aggressive attacks and coherent rebuttals. He declined to answer questions about committing to a second debate, which Harris’ campaign challenged him to do in a statement earlier in the night. “I made that very clear in 2020, I will not ban fracking,” Harris said. He criticized Biden’s handling of classified documents, knocked him for opposing the Keystone XL pipeline and called the Biden’s administration “the most divisive presidency in the history of our country.”Read more from Sahil →More debate night coverageThat’s all from the Politics Desk for now.

PHILADELPHIA — Former President Donald Trump found out Tuesday night that he's got a much tougher rival on his hands now. Harris, eager to portray herself as different from both Trump and Biden, reminded him that Biden won't be on the ballot. Trump said Harris has had 3½ years to make the changes she promises to make and argued the Biden-Harris administration squandered progress Trump gave them. Trump and Harris also clashed over the 2020 election, with Trump again falsely claiming that he won. Throughout the debate, Harris needled Trump in ways that undermined his self-image as a popular, strong leader whom American’s adversaries fear.

CNN —Former President Donald Trump falsely claimed Wednesday that his 2024 Democratic rival, Vice President Kamala Harris, “happened to turn Black” a few years ago, saying that “all of a sudden, she made a turn” in her identity. I didn’t know she was Black until a number of years ago, when she happened to turn Black, and now she wants to be known as Black. So I don’t know, is she Indian or is she Black?” the former president said. Former U.S. President Trump found guilty on 34 felony counts of falsifying business records during his trial at Manhattan Criminal Court May 30th 2024 in New York City. Trump, the presumptive Republican presidential nominee, was convicted last month on all 34 felony counts of falsifying business records in the historic case. The probation interview is required by the court as part of the former president's pre-sentencing report. Judge Juan Merchan, who is presiding over the hush money case, permitted Blanche to be present for the probation interview over a video call after prosecutors did not object. Some legal experts noted that holding a probation interview over a video conference call is unusual but having the former president in a New York probation would also be unprecedented.

CNN —A Manhattan jury found Donald Trump guilty of all 34 charges of falsifying business records Thursday, an unprecedented and historic verdict that makes Trump the first former president in American history to be convicted of a felony. And if he defeats President Joe Biden in November, he will be the first sitting president in history to be a convicted felon. The verdict in the hush money trial was announced after jurors deliberated for nearly 12 hours over two days. Manhattan District Attorney Alvin Bragg speaks to the media after a jury found former President Donald Trump guilty on 34 felony counts of falsifying business records, on Thursday, May 30, in New York. “There’s only one way to keep Donald Trump out of the Oval Office: At the ballot box,” Biden wrote on X, linking to a fundraising page.

CNN —On Tuesday, we at last came to closing arguments in the Manhattan criminal trial of former President Donald Trump after 20 days of trial, testimony from 22 witnesses and over 200 exhibits. Were the 34 allegedly false records actually false? The first pivot point is whether the 34 business records at the heart of the case actually contain false information. And Steinglass pushed back on Blanche’s emphasis on the much-discussed October 24, 2016, Cohen call to Trump’s bodyguard, Keith Schiller. Indeed, Blanche continued, Trump repeatedly disclosed the reimbursement — including on Twitter, a 1099 form to the IRS and a federal financial disclosure form.

CNN —The defense rested its case in Donald Trump’s criminal hush money trial on Tuesday after roughly 90 minutes of testimony – and without the former president taking the stand. Here are takeaways from the final day of testimony in the Trump hush money trial:Trump doesn’t take the standOver the last several months, Trump repeatedly teased that he would take the stand in his own defense. “That was a lie,” Blanche alleged of Cohen’s testimony he spoke to Trump about moving forward with the hush money deal. Prosecutor Susan Hoffinger also tried to remind jurors that it was Trump – not Cohen – who was on trial in this case. In their first meeting, Costello said Cohen was “absolutely manic” and suicidal after the FBI raid on his properties.

CNN —If Donald Trump opts to testify at his New York criminal trial, Manhattan prosecutors want to use his past legal run-ins to discredit him to the jury. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. The judge plans to hold a proceeding called a Sandoval hearing to rule on what’s fair fodder for prosecutors if Trump takes the stand in his defense later at trial. A Sandoval hearing is a common preliminary proceeding that reviews a defendant’s criminal history and looks at how much prosecutors can ask if a defendant testifies. “If for some reason we are fortunate and get done early on Friday, we will take up Sandoval at that time,” Merchan said.

“I’ve done a lot of cases that are considered no-win,” Bragg told CNN at the time, in December 2021. Though Bragg’s ambitions are widely considered to be less lofty than some of his predecessors, the Trump trial will likely write both his political future and legacy. Two months into office, Bragg was confronted by two senior attorneys leading the Trump investigation. When Bragg refused to authorize them to seek an indictment they abruptly and noisily resigned, putting additional pressure on the new district attorney. Trump eventually paid $2 million of his own money to a group of charities, and the foundation was dissolved.

CNN —Three months ago, Donald Trump took the stand before a jury of nine in a New York courtroom without his typical bombast or ranting. “The record will reflect that Mr. Trump just rose and walked out of the courtroom,” Judge Lewis Kaplan announced, in case any jurors had missed it. “I mean, our whole case was about the fact that Donald Trump is unable to follow the law, unable to follow the rules. But just having political views about Trump, for or against, won’t be a reason for potential jurors to be dismissed. An expanded hush-money gag bars attacks on the judge's daughter, a Democratic campaign consultant. On Tuesday, Trump found a way around the gag, attacking the daughter in a legal filing instead. AdvertisementDonald Trump has found a work-around for a newly-expanded gag order that bars him from attacking the Democratic campaign-consultant daughter of his hush-money judge: attacking the daughter through legal filings instead. Manhattan prosecutors did not immediately respond to the recusal request, but have called Trump's attacks on the judge's family members "dangerous" and "reprehensible." "This Court and the Advisory Committee on Judicial Ethics have already determined that such a claim provides no basis for recusal," prosecutors countered on Tuesday night.

But while the unsigned, 13-page opinion the Supreme Court handed down Monday decisively resolved the uncertainty around Trump’s eligibility for a second term, it left unsettled questions that could some day boomerang back to the justices. Donald Trump's fraud verdict targets three things he values dearly: his cash, his New York business address, and the Trump Organization steering wheel. Otherwise, as Engoron noted in his verdict, Trump, his company, and his sons, Donald Trump Jr. and Eric Trump, "are likely to continue their fraudulent ways." In previous years, Trump has settled allegations of fraud involving the Trump Foundation, Trump University, and the 2017 Inaugural Committee, Amer pointed out in closings.
