Mason Morfit, Salesforce board member and co-CEO of activist investor ValueAct, has increased his stake in Marc Benioff's software firm to just under $1 billion, acquiring $99 million worth of shares earlier this week, just days after the company reported its first revenue miss since 2006. The trade was disclosed in a regulatory filing Thursday, sending Salesforce shares up around 3.5% on the news in morning trading. The other activists eyeing Salesforce at the time included Elliott Management, Dan Loeb's Third Point, and Starboard Value. Earlier this year, Salesforce's widely reported pursuit of data management firm Informatica sent shares see-sawing before the putative target said it was not considering a sale. Salesforce shares briefly eclipsed their previous 2021 highs earlier this year, but have since given back those gains and are down 4% year-to-date.

Activist investor Ancora on Tuesday urged Disney to put Nelson Peltz on its board, days after Peltz and his firm, Trian, launched a proxy fight with the entertainment giant. "Mr. Peltz (or a qualified designee) would make a fantastic addition to Disney's Board." Trian oversees about $3 billion in Disney stock, but the overwhelming bulk of the shares is owned by Perlmutter, whom Disney laid off earlier this year. Trian is seeking more than two seats on Disney's board, which is populated by directors seen as loyal to Iger. Ancora owned more than 60,000 shares of Disney as of September, according to FactSet.

A change in the way activist and private equity investors are viewed is underway, Corvex Management founder Keith Meister said Tuesday. Corporate raider is a term used to refer to aggressive activist investors. "The reason it hasn't happened more quickly is because the amazing large private equity funds have been victims of their own successes," Meister said. Activist investors, which include Trian's Nelson Peltz, can agitate for a wide variety of changes including selling off underperforming or undervalued businesses or replacing management teams. Private equity investors, meanwhile, usually build a controlling stake in a company, with the aim of taking it private and making it more valuable before selling it for a profit.

Disney's share price spike in 2021 was caused by the same phenomenon — investors charging into streaming services with significant subscriber growth. Activist investor Nelson Peltz spent about 30 minutes Thursday morning speaking with CNBC's Jim Cramer and David Faber in a wide-ranging interview about why he wants a Disney board seat. Now Iger's back, and the Disney board has tasked him with finding a successor in the next two years. It's a far easier case to be made that Disney's board and Iger have consistently bungled succession planning. As Trian noted in its presentation (on Slide 28), the Disney board extended Iger's retirement date five different times between October 2011 and December 2017.
Iger has committed to serve two years as CEO and agreed to help the board develop his eventual replacement, according to Disney.
