The three Republicans who voted to oppose Mayorkas' impeachment have each warned about establishing a new precedent for the action some lawmakers place only below authorizing a war. Still, the vote to impeach Trump for inciting the Capitol riot was the most bipartisan presidential impeachment vote in history. As The New York Times pointed out during Trump's first impeachment, one out of every four presidents have had articles of impeachment written up against them. Gallagher announced his decision just days after bucking his party on the first vote to impeach Mayorkas.

U.S. Department of Homeland Security Secretary Alejandro Mayorkas holds a press conference at a U.S. Border Patrol station on January 08, 2024 in Eagle Pass, Texas. House Republicans are preparing to take another stab at impeaching Homeland Security Secretary Alejandro Mayorkas, a week after the same effort failed in an embarrassment for Speaker Mike Johnson, R-La. This time around, Republicans are confident they will have the majority vote to impeach now that House Majority Leader Steve Scalise, R-La., has returned to Washington after cancer treatment, which prevented him from breaking last week's 215-215 tie. If Republicans eke out a majority vote against Mayorkas, he would become only the second cabinet member in U.S. history to be impeached. The White House has supported Mayorkas, condemning the impeachment effort as a political distraction by Republicans, who refused $20 billion of border security funding in a bipartisan Senate deal last week.

The House of Representatives, by an extremely narrow margin, voted Tuesday to impeach Homeland Security Secretary Alejandro Mayorkas, the first Cabinet secretary to be impeached in almost 150 years. The Department of Homeland Security said that House Republicans “will be remembered by history for trampling on the Constitution” following the vote to impeach. “Secretary Mayorkas and the Department of Homeland Security will continue working every day to keep Americans safe,” the statement said. Ken Buck, Tom McClintock, and Mike Gallagher are three House Republicans who voted against impeaching Mayorkas. Four Republicans joined all House Democrats in voting down what would have been the first impeachment of a Cabinet official in nearly 150 years. Mayorkas' impeachment was not expected to go anywhere. But senators from both parties have repeatedly made clear that they have a particular ire reserved for Mayorkas' impeachment. Before Tuesday's vote, McClintock issued a scathing 10-page letter to his colleagues denouncing their impeachment push. "[T]aking the course outlined by the [Homeland Security Committee] is bad politics and bad policy," McClintock wrote in his letter.

House Republicans have accused Mayorkas of not complying with immigration laws when it comes to the southern border. The House focused on Mayorkas as efforts to impeach President Joe Biden have been met with less enthusiasm. But due to its razor-thin majority in the lower chamber, the GOP can only lose three Republican votes to secure impeachment if all of the party is in attendance – and they’ve already lost two. House Republicans were thrown for a loop on Tuesday when a vote to impeach Homeland Security Secretary Alejandro Mayorkas over his handling of the southern border failed after four Republicans voted against it. House GOP leaders displayed confidence going into the vote despite knowing ahead of time that at least a couple Republican members were going to vote against impeachment. Republicans could try to impeach Mayorkas again once Scalise returns. GOP efforts to impeach Mayorkas were vehemently opposed by the Biden administration and the Homeland Security Department. Republican senators on Tuesday indicated that they would block a procedural vote for the bipartisan border deal this week.

CNN —A plague on both these houses:The Senate seems to lack the political will for a bipartisan border deal. The House lacks an effective majority for a partisan impeachment effort as GOP leaders scramble for votes. Except, as the vote approached, they seemed to realize they might not have the votes to impeach Mayorkas after all. The only other time a Cabinet member was impeached, back in 1876, it was with a unanimous House vote. With hours to go before the Mayorkas impeachment vote is set to occur, there is a real possibility it could fail, and it can only pass by the slimmest of margins.

But Greene said she had a tougher time connecting with Speaker Mike Johnson, who doesn’t have a strong relationship with the congresswoman. “I haven’t heard much from him,” Greene told CNN earlier this week. Greene said Johnson heard her out and gave her assurances that her impeachment articles would move through committee and on to the floor. Taking a page from his predecessor’s playbook, Johnson has tried to dole out commitments and face-time to some of his potential critics. GOP Rep. Bob Good of Virginia said the Freedom Caucus made clear to the speaker on Thursday what their expectations are.

Rep. Jim Jordan, R-Ohio, talks to reporters after a House Republican Conference meeting in the U.S. Capitol on the speaker of the house nomination on Thursday, October 12, 2023. On this vote, Jordan came away with 152 votes for him, and 55 against, far short of the 217 he would need in a formal vote on the House floor. Following the second vote, lawmakers broke for the weekend, with few signs of what would come next. House Republicans had nominated Scalise Wednesday after he defeated Jordan in a narrow 113-to-99 internal party vote behind closed doors. The lower chamber is effectively in a state of paralysis, unable to move forward with urgent business until a House speaker is elected.

The House speaker election is days away after Kevin McCarthy’s historic ouster that has left the chamber in need of a successor. Two candidates have formally announced their bid for the speakership – House Majority Leader Steve Scalise of Louisiana and Rep. Jim Jordan of Ohio. House Republicans are set to hold their own candidate forum behind closed doors on Tuesday before holding an internal election and chamber-wide vote in the following days. “No candidate for Speaker is likely to receive 96 percent of the Republican Conference vote required by this new precedent,” Rep. Tom McClintock of California said in a statement. But the California Republican made clear after the vote to boot him from the role that he wouldn’t run for speaker again.
