CNN —With two presidential candidates fighting over a mere 538 Electoral College votes, a tie scenario is more than possible. Those individual, competitive electoral votes in Maine and Nebraska become hugely consequential in potential tie scenarios. If there’s a 269-269 tie, or if a third party or independent candidate wins electoral votes and keeps a candidate from reaching an Electoral College majority of 270, the next step is the same. Has a contingent election happened in the years since the tied election of 1800? In 1876, when there was a contested outcome, the contingent election system was bypassed.

The state’s highly decentralized system of administering voting means that “Michigan has 1,500 elections every big election day,” said Kyle Whitney, the city clerk of Marquette in the state’s Upper Peninsula. ‘We’re all beginners’The new rules in Michigan flow from a constitutional amendment that state voters approved by a wide margin in 2022 that dramatically expanded access to voting. Miller was elected to succeed the previous, term-limited clerk and is overseeing her first presidential election. Deborah Pellow, the part-time clerk of rural Tilden Township in the Upper Peninsula, is also overseeing her first presidential election this year. The next big test for Michigan comes in August, when voters cast primary ballots for congressional, state and local offices.

Or it’s possible the founders just had a lot on their minds and threw the system together at the last minute. Confession: I was hoping to blame the whole Electoral College thing on Thomas Jefferson, who’s possibly my least favorite founding father. Anyway, no matter how it originally came together, we’ve now put the loser of the popular vote in office five times. One involved the Republican Rutherford B. Hayes, who won in 1876 even though the electoral vote was virtually tied and Samuel Tilden easily won the popular vote. George W. Bush lost the popular vote to Al Gore in 2000 — many of you will remember the manic counting and recounting in Florida, which was the tipping point state.

☆ Nordstrom adds former Nike executive to board as activist battle continues

Nordstrom on Monday said it has tapped former Nike operating chief Eric Sprunk to join its board, as the company faces pressure from an activist investor. Sprunk, who was Nike's COO from 2013 to 2020, will join the board immediately, the company said. In a news release, Nordstrom board member Brad Tilden highlighted Sprunk's "track record of driving e-commerce growth and large-scale transformations within a complex global business." Nordstrom did not say in the news release whether the board appointment was board of an agreement with Cohen. Net sales for the company's namesake banner decreased 2.4%, and net sales for its off-price banner, Nordstrom Rack, dropped 8.1% in the quarter versus the year-ago period.
