Nebraska’s Dan Osborn is returning to work Tuesday as a steamfitter after his unsuccessful Senate run, but his political career isn’t over. Osborn, who ran as an independent, is launching a political action committee, called the Working Class Heroes Fund, to support working-class candidates of all parties. And he isn’t ruling out another run for office after his loss to GOP Sen. Deb Fischer. Osborn said his PAC will support candidates of any party, and he said he didn’t expect to have many policy litmus tests, apart from supporting campaign finance overhaul and rejecting corporate donations. His Senate campaign raised $7.9 million through mid-October, according to the latest campaign finance reports, and he said it ultimately raised more than $14 million.

Nebraska voters approved a ballot measure enshrining current abortion restrictions in the state's constitution, NBC News projects, a setback for reproductive rights advocates in the red state. Unlike most states where the abortion issue was put directly before voters this year, the Nebraska ballot pitted two competing abortion measures against each other. The other, called “Protect Women and Children,” which sought to codify the state’s 12-week ban in the constitution while keeping the door open for additional restrictions. For a ballot measure to pass in the state, it needs a majority of the vote and at least 35% of the total votes cast in the election in favor of it. The amendment to codify the current abortion restrictions in the state was receiving 55% support with 92% of the vote in, while the measure to add constitutional protections for abortion received 49% support.

This week, the state health department issued an advisory to doctors suggesting that recent ads about Nebraska’s abortion restrictions had created "confusion." She said the health department and Gov. Jeff Powell, communications director for the Nebraska Department of Health and Human Services, said the intent of the health alert was to "clarify the current law." In response to the health department alert, two doctors in the state said there is no confusion among physicians about how to treat ectopic pregnancies or miscarriages. The Florida Health Department sent cease-and-desist letters to multiple broadcast stations that aired an ad supporting an abortion-rights ballot measure.

The Nebraska Supreme Court ruled that convicted felons who served their sentences are allowed to vote, after the state's top election official sought to keep them from casting ballots ahead of the Nov. 5 election. Nebraska has historically restored the voting rights of former felons two years after they completed the terms of their sentences. While Nebraska is solidly Republican state, it awards an electoral vote to the winner of each of its congressional districts. The Sentencing Project, criminal justice reform advocacy group, estimated that eliminating the waiting period for convicted felons in Nebraska would restore voting rights for 7,000 people. Far more completed their felony sentences more than two years ago, too, and were affected by the state officials prohibition on their voter registration.

CNN —Vice President Kamala Harris and former President Donald Trump are tied among likely voters in North Carolina, while Harris holds a comfortable lead in Nebraska’s 2nd Congressional District, according to two new CNN polls conducted by SSRS. In North Carolina, Harris and Trump stand at 48% each among likely voters. In Nebraska’s 2nd District, the so-called blue dot encompassing Omaha, Harris has 53% to Trump’s 42%, the poll finds. An 86% majority of Democratic likely voters and 69% of independent likely voters favor keeping the current system, while 69% of GOP likely voters say they’d rather move to a winner-take-all system in the state. But just 41% in North Carolina say they’re very confident, rising to a 59% majority in Nebraska’s 2nd District.

The war for the first battleground electoral vote may have been decided this week before a single ballot was cast. Trump allies have pushed for a special legislative session intended for the Republican-controlled legislature to change Nebraska to a winner-take-all system instead of awarding electoral votes by congressional district. The developments appear to cap months of deliberations over whether Nebraska lawmakers could change the way the state apportions its electoral votes in a way that would benefit Trump. The FBI is warning election offices to be on the lookout after threatening letters containing suspicious substances were sent to the offices of multiple secretaries of state throughout the country. A senior law enforcement official confirms elections officials in at least six states received packages on Monday, but so far none of the packages have been found to contain any actual hazardous material. Secretaries of state, attorney general offices and state election offices in Nebraska, Iowa, Kansas, Tennessee, Wyoming and Oklahoma were targeted. The FBI, United States Postal Inspection Service (USPIS), and state and local law enforcement partners are investigating multiple letters containing suspicious substances which have been mailed to Secretary of State's offices. The incident is also the second time in the past year that threats have hit multiple state election offices simultaneously.

Abortion rights opponents had argued in a pair of lawsuits that the amendment to expand abortion rights violated a state rule that says a ballot proposal must only address one subject. Matt Heffron, a senior counsel for a firm that argued against allowing the abortion rights initiative to stay on the ballot, slammed the high court's ruling. Colorado, New York and Maryland are the liberal-leaning states with abortion ballot measures. Arizona and Nevada — two key battleground states in the presidential election — also have abortion ballot initiatives.
