CNN —President-elect Donald Trump can be sentenced Friday in his New York hush money case, the Supreme Court said in a 5-4 ruling. Four conservative justices – Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh – said they would have granted Trump’s request. Trump’s attorneys told the Supreme Court that having to deal with the sentencing would distract from his transition to power and potentially jeopardize national security. “There is a compelling public interest in proceeding to sentencing,” Bragg told the Supreme Court. Nor did the two discuss “any other matter that is pending or might in the future come before the Supreme Court or any past Supreme Court decisions involving the President-elect,” Alito said in a statement Wednesday.

New York prosecutors on Thursday urged the U.S. Supreme Court to deny President-elect Donald J. Trump’s last-ditch effort to halt his criminal sentencing, in a prelude to a much-anticipated ruling that will determine whether he enters the White House as a felon. In a filing a day before the scheduled sentencing, prosecutors from the Manhattan district attorney’s office called Mr. Trump’s emergency application to the Supreme Court premature, noting that he had not yet exhausted his appeals in state court. They noted that the judge overseeing the case plans to spare Mr. Trump jail time, which they argued undermined any need for a stay. The prosecutors, who had secured Mr. Trump’s conviction last year on charges that he falsified records to cover up a sex scandal that endangered his 2016 presidential campaign, implored the Supreme Court to let Mr. Trump’s punishment proceed. “There is a compelling public interest in proceeding to sentencing,” they wrote, and added that “the sanctity of a jury verdict and the deference that must be accorded to it are bedrock principles in our Nation’s jurisprudence.”

The U.S. Supreme Court on Thursday narrowly denied a request by President-elect Donald Trump to halt proceedings in his New York criminal hush money case, clearing the way for him to be sentenced on Friday morning. The decision came hours after New York state's highest appeals court refused to delay Trump's sentencing. The Supreme Court last July greatly expanded the scope of presidential immunity when it ruled that former presidents enjoy "presumptive immunity" for all their official acts in office. Prosecutors for Manhattan DA Alvin Bragg responded earlier Thursday that "there is no basis" for the Supreme Court to intervene in the case. A New York appeals court and the state's highest court had both denied Trump's bid to pause his Friday morning sentencing hearing.

CNN —New York’s highest court on Thursday rejected President-elect Donald Trump’s bid to postpone his sentencing in the hush money case, leaving the US Supreme Court as his last chance to delay Friday’s scheduled hearing. Trump appealed to both the Supreme Court and the New York Court of Appeals to try to block state Judge Juan Merchan from imposing a sentence in the hush money case, where Trump was convicted in May on 34 counts of falsifying business records. In a two-sentence letter Thursday from the Court of Appeals, Trump’s attorneys were notified that Judge Jenny Rivera denied Trump’s request. The US Supreme Court can act at any time on Trump’s attempt to intervene and stop the sentencing, which was filed Wednesday after the New York Appellate Court, First Division, also denied Trump’s request to stay the sentencing. Trump’s “extraordinary immunity claim is unsupported by any decision from any court,” Bragg, a Democrat, told the Supreme Court.

President-elect Donald Trump on Wednesday asked the Supreme Court to block criminal proceedings in his hush money case in New York, with a sentencing hearing scheduled for Friday. They argue that the case should not go forward because Trump was protected by presidential immunity, as recognized by the Supreme Court last year. Trump's lawyers have filed a similar request at the New York State Court of Appeals, the highest court in the state. He then directed Trump’s sentencing on 34 felony counts of falsifying business records to take place Friday morning. Trump's Supreme Court request was filed by lawyer D. John Sauer, whom the president-election intends to appoint as solicitor general, his administration's top courtroom advocate.

CNN —President-elect Donald Trump will face no legal penalties for his conviction in the hush money case, a New York judge ruled Friday. Judge Juan Merchan, however, upheld Trump’s conviction in the case, rejecting the president-elect’s effort to throw out the jury’s verdict because of his reelection in November. Trump was first set to be sentenced in JulyTrump was scheduled to be sentenced in July, but that was postponed twice as a result of the Supreme Court’s immunity ruling. Manhattan District Attorney Alvin Bragg had argued that Trump’s conviction should be upheld. Trump spokesman Steven Cheung called the Friday ruling is a “direct violation” of the Supreme Court’s immunity decision.

Now the criminal cases against him are in jeopardy — the two federal prosecutions have already been dismissed, while the two state cases are stalled — and appeals courts might whittle down the hefty civil judgments against him. The change in circumstance is largely due to Trump’s election win — the federal cases were dropped because of a Justice Department legal opinion that sitting presidents can’t be prosecuted, a position Trump’s lawyers have said should be applied to the state cases, as well. Trump's attorneys in his civil cases, meanwhile, are trying to use his soon-to-be office to their benefit, as well. His spokesperson, Steven Cheung, said in a statement that Trump's election was a "mandate" from the American people, who "demanded an immediate end to the political weaponization of our justice system and a swift dismissal of all the Witch Hunts against him. And if they pled guilty — then they pled we’re not guilty,” Trump said at the debate.

A federal criminal complaint was unsealed Thursday, in which Mangione was charged with murder through use of a firearm, two stalking charges and a firearms offense. He could face the death penalty if found guilty of the federal murder charge, while the state charges carry a maximum penalty of life in prison without the possibility of parole. The New York judge who presided over Donald Trump’s hush money trial denied the president-elect’s bid to vacate his guilty verdict on presidential immunity grounds. "Defendant’s motion to dismiss the indictment and verdict is denied," Judge Juan Merchan wrote in a ruling Monday. Merchan handed down the decision after he also denied Trump's argument that he's already protected by presidential immunity because of his election win. Trump's attorneys had argued the indictment and the verdict should be thrown out in light of a Supreme Court ruling issued weeks later that created a new standard for presidential immunity. Merchan instructed attorneys on both sides to file their letters about the issue publicly and with redactions.

Former U.S. President Donald Trump, with attorney Todd Blanche, speaks to reporters as jurors are released to begin deliberations for his criminal trial at the Manhattan Criminal Court in New York, NY on Wednesday, May 29, 2024. Attorneys for Donald Trump told a New York judge that the president-elect's criminal hush money trial was tainted by "grave juror misconduct" and that his guilty verdicts should be thrown out as a result. The seven-page letter from Blanche and Bove is heavily redacted. The visible portions of the letter offer few details or evidence to support the misconduct claims. The correspondence was revealed one day after Manhattan Supreme Court Judge Merchan rejected Trump's bid to have his hush money conviction dismissed on the grounds of presidential immunity.

Investigators say they have mounting evidence against Luigi Mangione, 26, connecting him to the assassination of Brian Thompson on December 4. Mangione was denied bail on Tuesday and is fighting his extradition to New York, where he faces five charges, including second-degree murder, in Thompson’s killing. If convicted of second-degree murder, Mangione faces at least 15 years to life in prison, while a first-degree murder charge carries a minimum of 20 years to life in prison. A second-degree murder charge – but not first-degree murder – allows the defendant an “affirmative defense,” which is essentially a “Yes, but” argument to lessen the seriousness of the charge to first-degree manslaughter, according to Shapiro. Mangione’s arrest is only the first piece of the case against him, according to Ken Corey, former NYPD chief of department.

Prosecutors from the Manhattan district attorney's office are urging a New York judge not to throw out President-elect Donald Trump's criminal conviction in the hush money case, offering a variety of suggestions on how the case could proceed without interfering with his presidential duties. They also knocked Trump's claim that the case should be "immediately" dismissed because he's already protected by presidential immunity. Judge Juan Merchan indefinitely postponed Trump's sentencing last month so both sides could present their arguments on the issue. Prosecutors presented a number of possible ways forward, including staying Trump's sentencing until after he's out of office.
