CNN —Four Fox Corporation board members have been subpoenaed in voting technology company Smartmatic’s $2.7 billion defamation lawsuit against Fox News over its airing of 2020 election lies, alleging executives at the right-wing cable channel’s parent company knew it was spreading false claims. In a court filing Monday, Smartmatic subpoenaed the four board members — Anne Dias, Charles Carey, Roland Hernandez, Jacques Nasser — over Fox News’s repeated airing of bogus conspiracy theories that the 2020 election was stolen from former President Donald Trump. “Smartmatic plans to pursue Fox’s board members as well to determine why they allowed the company’s most valuable asset, Fox News, to spread disinformation about the 2020 election.”New York Judge David Cohen had previously ordered Fox Corporation to turn over documents related to the board members in the case. Rupert Murdoch, the right-wing media mogul who founded Fox Corporation, the parent company of Fox News, was also deposed late last year. Rupert Murdoch, one of the most powerful media tycoons of the modern era, is stepping down as chairman of Fox Corporation and News Corporation at the age of 92 and handing the reins to his 52-year-old son. The takeover planning appeared to begin in 2015, when Rupert named Lachlan and his brother James Murdoch as co-chairmen of 21st Century Fox. James later left the company, and Lachlan became CEO of the Fox Corporation in 2019, following Disney’s acquisition of 21st Century Fox. With his father’s departure, Lachlan will become the sole chairman of both Fox and News, after having co-chaired the company for years. So, $1,306,739 Australian ($839,207.39 US) to cover Private Media’s legal costs, more than the $1.1 million Australian ($705,000 US) that had been sought by the outlet. Private Media, which had crowdfunded its legal defense against Murdoch, pledged to donate $588,735 Australian ($377,555 US) — all of the money it had raised — to the Alliance for Journalists’ Freedom. Will Hayward, the chief executive of Private Media, said he was “delighted” to be able to donate the funds. “This includes campaigning for a Media Freedom Act, supported by a voluntary membership that will recognize quality journalism.”

Fox News has settled another lawsuit, this time with a one-time producer for former primetime host Tucker Carlson. The Fox Corp. network agreed to pay $12 million to settle the lawsuit brought by Abby Grossberg, who alleged she was coerced into giving false testimony for the Dominion Voting Systems defamation case. Grossberg earlier this year had filed lawsuits against Fox in New York and Delaware, and had also accused the network of discrimination. After the discovery of one particularly incendiary text from Mr. Carlson, the Fox Corporation board decided to begin an internal investigation into his conduct. Mr. Carlson’s cancellation — he is still an employee of Fox unless the network decides to let him out of his contract — has upended Fox’s lucrative and popular prime-time lineup. Mr. Carlson offered no details of when his new program would begin or what kind of content it would have — questions that highlight the uncertainties surrounding his departure from Fox News, which ultimately could block any attempt by the host to return to a prominent role in conservative media. Lachlan Murdoch, the executive chairman of the Fox Corporation, conceded on Tuesday that a Delaware judge’s pretrial rulings against the company “severely limited our defense at trial” and contributed to his decision to settle the landmark defamation case brought by Dominion Voting Systems. Mr. Murdoch, on a call with investors and analysts, called the $787.5 million settlement — believed to be the largest in the history of defamation law — “a decision clearly in the best interest of the company and its shareholders.”In a remark that echoed the trademark defiance of his father, Rupert Murdoch, he also defended the conduct of Fox News personnel, saying the settlement “in no way alters Fox’s commitment to the highest journalistic standards across our networks, or our passion for unabashedly reporting the news of the day.”His remarks came after Fox revealed a real-world consequence of the landmark settlement: The company swung to a net loss in the first three months of the year, its quarterly revenue erased — and then some — by payments associated with resolving the lawsuit with Dominion, an election technology firm.

When Russia invaded Ukraine, Mr. Carlson’s show frequently promoted the Kremlin’s point of view, attacking U.S. sanctions and blaming the conflict on American designs for expanding NATO. The drought of premium advertisers on “Tucker Carlson Tonight” — driven away by boycotts targeting his more racist and inflammatory segments — did not seem to dent his standing within the network, so long as the audience stuck around. Disdainful of the cable network’s top executives, Mr. Carlson cultivated the impression that he was close to the Murdoch family and, perhaps, untouchable. But he prospered in tandem with Mr. Trump’s presidency, as the New York real estate tycoon made frank nativism and seething cultural resentment the primary touchstones of conservative politics.

Fox Corp. had nearly $4.1 billion of cash on hand, according to comments made in February by company CEO Lachlan Murdoch. New York CNN —Dominion Voting Systems’ historic defamation case against Fox News will proceed to a high-stakes jury trial next month, a Delaware judge ruled Friday, declining to declare a pretrial winner. But in his Friday ruling, Davis said that the evidence Dominion presented shows Fox News aired falsehoods about the company. “The evidence developed in this civil proceeding demonstrates that is CRYSTAL clear that none of the Statements relating to Dominion about the 2020 election are true,” Davis wrote. The on-air statements, from various Fox News hosts after the 2020 election, had accused Dominion of rigging the election by flipping millions of votes from Donald Trump to Joe Biden. Incriminating texts and emails have shown how Fox executives, hosts and producers didn’t believe the claims the network was peddling about Dominion.
