Jordan Neely died from the “combined effects” of a number of a factors, not a chokehold, a forensic pathologist hired by Daniel Penny’s attorneys testified Thursday. Penny is charged with manslaughter and criminally negligent homicide in the chokehold death of Neely on a New York City subway train in May 2023. Penny, 26, who was a passenger on the train, put Neely in a chokehold and took him to the ground. Chundru said he did not believe that Neely died of a chokehold or that Penny had applied consistent and sufficient pressure to render him unconscious. Chundru said he believed Neely died from “the combined effects of sickle cell crisis, the schizophrenia, the struggle and restraint and the synthetic marijuana” that was in his system.

After having called more than 30 witnesses, the prosecution in the manslaughter trial of Daniel Penny, who is charged in the chokehold death of Jordan Neely, rested its case Monday. Penny put him in a chokehold that lasted about six minutes, prosecutors have said and evidence presented at trial has shown. Penny’s attorneys have said he acted to protect himself and other subway riders from “a seething, psychotic” Neely. Again and again, Harris answered that she believed the chokehold was the most probable cause of Neely’s death. Harris testified Friday that she based her ruling on her autopsy findings, coupled with the video and the investigative information about it.

“It’s my medical opinion that there are no alternative reasonable explanations for Mr. Neely’s death,” the medical examiner, Dr. Cynthia Harris, told jurors. Daniel Penny went “way too far” when he put Jordan Neely in a chokehold on a New York City subway train last year until he died, a Manhattan prosecutor told jurors Friday during opening statements in Penny’s manslaughter trial. “A chokehold is only permitted when it’s absolutely necessary and only for as long as it’s absolutely necessary,” Yoran told jurors. He talked about being hungry, thirsty and made threats about hurting people and wanting to go back to jail, which frightened people on the train, Yoran said. In addition to opening statements, jurors on Friday heard from three police officers who had responded to the subway car. Kenniff said jurors also would hear during the trial from subway riders who had feared for their lives.

Video shows Penny wrapping his legs around Neely’s body as the pair are on the floor of the train car. Raiser said the defense plans to dispute that Penny had Neely in a chokehold at all. Hochul’s announcement came a week after a passenger had slashed a subway conductor in the neck and following other crimes in the subway system. And subway crime was down 5.1% year to date through the end of September, the police department said.

Another threat to election officialsAt least four swatting incidents have been aimed at the homes of senior officials who oversee or work to secure elections since December. Separately, a Department of Justice taskforce launched in 2021 has reviewed more than 2,000 allegations of hostility, harassment, abuse, or threats to election officials and staffers, a department spokesperson said. Swatting was featured in a tabletop exercise for election officials in New Jersey last month, a spokesperson for the secretary of state told CNN. Such incidents have prompted The Elections Group, a consulting group led by former election officials, to begin sharing resources on swatting with election workers and incorporating the topic into trainings. A wave of election officials have departed their roles since November 2020, when false claims of a stolen election proliferated.

Donham, 88, died Tuesday in Westlake, according to a fact of death letter from the Calcasieu Parish Coroner. In August 1955, 14-year-old Till was beaten and shot to death after he allegedly whistled at Bryant – now Donham – in Money, Mississippi. Emmett Louis Till, 14, with his mother, Mamie Bradley, at home in Chicago. They were both acquitted of murder following a trial in which Carolyn Bryant testified that Emmett grabbed and verbally threatened her. In 2007, a Mississippi grand jury declined to indict Donham on any charges.
JPMorgan Chase and Deutsche Bank must face lawsuits that accuse them of enabling Jeffrey Epstein’s sex trafficking, a US judge said Monday. Rakoff’s decision gives the plaintiffs a chance to prove another claim: that JPMorgan and Deutsche Bank (DB)knowingly benefited from involvement in Epstein’s sex trafficking. JPMorgan spokeswoman Trish Wexler and Deutsche Bank spokesman Dylan Riddle declined to comment on Rakoff’s ruling. ‘Landmark decision’Epstein had been a client of JPMorgan from 2000 to 2013, and Deutsche Bank from 2013 to 2018. In the Deutsche Bank case, the plaintiff, also known as Jane Doe 1, said Epstein sexually abused her from 2003 to 2018.
With the release of director Chinonye Chukwu’s “Till,” the conversation of the nation’s racist history and violence toward Black people is being revisited. Deadwyler told NBC News that the telling of Till’s story today is just as important as it was decades ago. “In the United States, we tend to think of our history in romantic terms,” Glaude told NBC News. The Senate passed a bill in January posthumously awarding Till and his mother the Congressional Gold Medal. But, Glaude said, even with these initiatives, without a racially just America, Till “died in vain.”“We can never forget,” he added.
LAS VEGAS — Prosecutors said they won’t seek the death penalty against a former Las Vegas-area politician who pleaded not guilty Wednesday to killing a veteran investigative journalist who wrote articles critical of him and his managerial conduct. Clark County District Attorney Steve Wolfson said he and a panel of prosecutors concluded that there were no qualifying aggravating factors to make Telles’ trial a capital case. The state Supreme Court has also suspended Telles’ law license pending results of a State Bar of Nevada investigation of allegations that he misappropriated funds of clients in his private law office.
SAN JUAN, Puerto Rico — A ship carrying much-needed diesel fuel has been unable to dock in hard-hit southern Puerto Rico since Sunday while it awaits federal authorization because of the Jones Act, a century-old shipping law. That means that a foreign ship with goods for Puerto Rico would first have to disembark in the mainland U.S. and change crews. Signed into law by President Woodrow Wilson two years after World War I ended, the Jones Act was passed as a protective measure against foreign competition. On Thursday, eight members of Congress called for the federal government to grant a one-year waiver from the Jones Act for storm-ravaged Puerto Rico. As of Monday morning, only 16% of power customers in Ponce had their electricity restored, according to the Puerto Rican government.
