Donald Trump has more than just the presidency on the line Nov. 5 — the outcome of his various legal troubles hinges on the election, as well. The “witch hunts against President Trump have imploded” and “should all be dismissed in light of the Supreme Court’s historic decision on immunity and other vital jurisprudence,” Cheung said in a statement. Hush money caseWin or lose, Trump’s biggest immediate challenge after the election is his potential sentencing on 34 felony counts of falsifying business records in New York. Federal election interference caseIf Trump loses, special counsel Jack Smith’s election interference case is also on the horizon. Similar to the criminal cases, Trump has argued that his actions were protected by presidential immunity.

Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

A judge on Thursday dismissed two criminal counts against Donald Trump in his Georgia election interference case, but kept intact the top racketeering charge and other counts against the former president and other defendants. Fulton County Superior Judge Scott McAfee also tossed out a third count that had been lodged against a number of Trump allies. The third count the judge tossed — numbered as Count 14 in the indictment — was criminal attempt to commit filing false documents. In March, judge tossed out three counts of solicitation of violation of oath by a public officer that had been lodged against Trump. Trump's appeal is set to be heard in oral arguments at the Georgia Court of Appeals in December.

CNN —A judge on Thursday threw out three charges in the sweeping Georgia election subversion case, including two charges that former President Donald Trump faces. In a separate ruling, Fulton County Judge Scott McAfee also upheld the marquee racketeering charge in the case, which Trump is also facing. In the ruling, McAfee also threw out a separate count of filing false documents, which Trump was charged with. Trump was only named in two of the three charges that McAfee threw out Thursday. The awkward ruling from McAfee comes as he has only partial jurisdiction over the 2020 election meddling case.

CNN —Former special prosecutor Nathan Wade says he believes Donald Trump will “absolutely” be put on trial in Georgia in the 2020 election subversion case – even if he wins a second term and he’s in the White House at the time. The question of whether a sitting US president can be forced to stand trial for state-level criminal charges has never been litigated. Wade said in the interview Wednesday that he expects prosecutors and defense attorneys will have to confront that unprecedented scenario if Trump wins the 2024 election. Nathan Wade was asked if he thinks Trump can still be on trial as president. Trial court Judge Scott McAfee had previously ruled that Willis could remain on the case if Wade stepped away, prompting his resignation.

CNN —The Georgia Court of Appeals will consider an effort by Donald Trump and his co-defendants to disqualify District Attorney Fani Willis from the 2020 election subversion case. In a brief order Wednesday, the court said it will hear the appeal from Trump and others challenging the ruling from Judge Scott McAfee that allowed Willis to remain on the case. No trial date has been set in the sprawling election subversion conspiracy case against Trump, and the decision to consider the appeal is another sign that pre-trial efforts to delay a trial are succeeding. Tuesday, a federal judge in Florida indefinitely postponed Trump’s trial on mishandling classified documents at his Mar-a-Lago estate. Willis testified that she paid Wade back for the expenses in cash.

A Georgia appeals court Wednesday agreed to hear a bid by Donald Trump to disqualify Fulton County District Attorney Fani Willis from the former president's criminal election interference case. Trump still faces 10 criminal counts in Willis' case. That order grants Trump's application to appeal McAfee's disqualification ruling while Willis' case is ongoing. The appeals court gave Trump 10 days to file the notice of appeal.

And if there’s one of the four criminal trials that Trump would prefer to take place first, it’s this one. But there is a clear trend of him using frivolous legal challenges to slow the road to trials. With only four weekdays until the New York trial begins, the chances that it will be further delayed are fading fast. If he’s reelected, Trump would regain presidential powers that would allow him to stall or even end the federal case against him completely. “There is no democracy without robust and uninhibited freedom of expression,” Trump attorney Steve Sadow said in a statement.

CNN —Former President Donald Trump was dealt two major setbacks Thursday in his efforts to derail the criminal cases against him, with judges in the Georgia election interference case and in the federal classified documents case both rejecting bids by the presumptive 2024 GOP presidential nominee to have those cases thrown out. Trump has made similar presidential immunity arguments in the Georgia case and in the classified documents case. She wrote that prosecutors “make no reference to the Presidential Records Act” in the indictment against Trump and did not “rely” on the statute to bring charges. McAfee’s ruling is the latest step inching the state racketeering case against Trump forward. McAfee’s refusal to scrap the indictment comes as the free speech defense has repeatedly fallen short in pretrial wrangling in election meddling cases.

A gag order against one of Trump’s biggest foes could score political points and help him and his co-defendants in the short term. Then, McAfee appeared to suggest a gag order may be necessary. “I don’t know a reason to have a gag order right now,” Parker told CNN. The former president already faces a gag order in his criminal hush money case that’s headed to trial later this month in New York. And several other defendants in the Georgia case, including former Trump attorney Rudy Giuliani and former Georgia GOP Chairman David Shafer, have offered commentary on the case and Willis on social media.

If he approves the request, the Georgia Court of Appeals would decide whether to take up the matter. McAfee concluded that if Willis stayed, Wade had to step down in order to dispel the “cloud of impropriety” created by their romantic relationship. Wade, who has testified that his romantic relationship with Willis is over, resigned after the ruling was issued on Friday. Willis and Wade’s relationship was thrust into the spotlight in January when co-defendant Mike Roman filed a motion to disqualify Willis over allegations of an “improper” relationship with Wade, whom she hired in 2021. Trump and his co-defendants wanted the judge to disqualify Willis’ team from the case – or throw out the charges – because of a possible conflict of interest.

Elijah Nouvelage | ReutersThe sprawling Georgia election interference case against former President Donald Trump and his co-defendants can continue if either Fulton County District Attorney Fani Willis or prosecutor Nathan Wade removes themselves, Fulton County Superior Court Judge Scott McAfee ruled Friday. Fulton County Superior Judge Scott McAfee looks on during a hearing in the case of the State of Georgia v. Donald John Trump on February 12, 2024 at the Fulton County Courthouse in Atlanta, Georgia. Willis and Wade admitted to the relationship only after it was first alleged in January court filings for defendant Michael Roman. and the prosecutor engaged in an "improper, clandestine personal relationship" and that they profited off the arrangement at taxpayers' expense. But both Willis and Wade insisted their relationship posed neither a personal nor financial conflict, and Willis has decried related claims as "fantastical theories and rank speculation."

In Florida, Trump’s attorneys told Judge Aileen Cannon his Mar-a-Lago classified documents case should wait until after the 2024 election. But both hearings could have a significant impact on when – or whether – Trump will face trial in each of those two cases. The only case that appears set: Trump’s New York criminal trial will begin March 25, which Trump’s attorneys said was a “firm” date in court Friday. Fulton County District Attorney Fani Willis attends a hearing on the Georgia election interference case on Friday in Atlanta. When Trump’s attorneys argued for the hearing, Cannon pushed them to describe how they could narrow its scope and asked them to lay out specifically what a hearing would examine.

The text messages raise questions about Bradley’s credibility, and the degree to which Merchant appeared to rely on his claims that she was then unable to substantiate elsewhere. Wade and Willis have admitted to being romantically involved, but both have testified their relationship started after Willis appointed Wade lead prosecutor in the Trump case. Merchant had said that he would contradict testimony from Willis and Wade once he took the stand. “Why would you speculate when she was asking you a direct question about when the relationship started?” Sadow pushed. The additional text messages show Bradley calling Merchant his “friend,” offering unsolicited advice, and also bashing Willis and Wade, Bradley’s former law partner.

CNN —A Georgia lawyer who had been billed as a star witness in the effort to disqualify Fulton County District Attorney Fani Willis did not deliver damaging testimony Tuesday on her romantic relationship with prosecutor Nathan Wade. “I do not have knowledge of it starting, or when it started,” Bradley said at one point. That filing leveled allegations that Willis and Wade engaged in an improper romantic relationship from which Willis financially benefited. “Why would you speculate when she was asking you a direct question about when the relationship started?” Sadow pushed. That means attorneys can use it to bolster their legal arguments about whether Willis should be disqualified without witness testimony.

Friday’s filing from Steve Sadow, Trump’s lead attorney in the Georgia case, included an affidavit from a criminal defense investigator who said he relied on subpoenaed cell phone information and cell tower data. The investigator, Charles Mittelstadt, said he generated a report that isolated “all interactions,” including calls and text messages between Wade and Willis. (Trump’s attorney submitted a new filing Friday afternoon to clarify the types of exchanges between Wade and Willis.) In addition, Willis and Wade exchanged phone calls late into the evenings during this time, the investigator says, citing Wade’s subpoenaed cell phone data. This story has been updated with the revised filing from Trump’s attorneys, referring to 12,000 “interactions” between Wade and Willis.

CNN —Donald Trump’s attorneys are joining calls for the dismissal of Fulton County District Attorney Fani Willis in the 2020 election subversion case against the former president and his co-defendants in Georgia, pointing to alleged misconduct between Willis and her lead prosecutor. The filing also points to public comments Willis recently made defending her choice to select the lead prosecutor, Nathan Wade, arguing that she violated Georgia rules for prosecutors. In comments Willis made at Atlanta’s Big Bethel A.M.E. Church earlier this month, the DA defended her team of prosecutors in the case, calling into question why only one of the three prosecutors was being attacked. The district attorney’s office declined to comment on the latest filing. Trump’s attorneys claim that Willis made a “calculated effort to foment racial bias” against the defendants with her comments, which run the risk of prejudicing the public and prospective jurors.

Fulton County DA Fani Willis was accused of having an "improper" relationship with a prosecutor. Willis appointed the prosecutor, Nathan Wade, to oversee the RICO case against Trump. The motion seeks to dismiss the indictment and disqualify Willis and Wade and their offices from further prosecuting the case. Willis said she hired three special prosecutors for the election case: a white man, a white woman, and a Black man. If Willis financially benefited from her relationship with Wade, that may be an ethics violation," he said.

ATLANTA (AP) — Fulton County District Attorney Fani Willis on Sunday defended the qualifications of a special prosecutor she hired for her case against Donald Trump and others over efforts to overturn the 2020 election in Georgia after a defense lawyer accused Willis of professional impropriety. At the church, Willis did not address the allegations of an improper relationship. They are paid the same hourly rate and no one has questioned the qualifications of the two white lawyers, she said. Merchant's filing offered no proof of the alleged relationship or trips that she said that Willis and Wade had taken together. Pete Skandalakis, a former district attorney who is executive director of the Prosecuting Attorneys’ Council, said district attorneys do not have to seek permission before hiring a special prosecutor.

John David Mercer/Pool via REUTERS Acquire Licensing RightsWASHINGTON, Dec 1 (Reuters) - A lawyer for Donald Trump said on Friday that the former U.S. president should not face trial on charges that he sought to overturn the 2020 election results in the state of Georgia if he wins the election next year. Trump is the frontrunner for the Republican nomination to challenge Democratic President Joe Biden in the 2024 election. Sadow said that if Trump wins the election, he would seek to postpone the trial until after he left office, arguing that it would interfere with his responsibilities as president. Fulton County District Attorney Fani Willis last week requested the Georgia trial begin in August 2024, a timeline that would likely extend the proceedings through Election Day and into early 2025. “What would be the state's response that having this trial on Election Day is election interference?” Judge Scott McAfee asked prosecutors.

Washington CNN —Former Trump campaign lawyer Jenna Ellis pleaded guilty Tuesday in the Georgia election subversion case and will cooperate with Fulton County prosecutors – the third guilty plea in the past week. At an unscheduled hearing in Atlanta, Ellis pleaded guilty to one count of aiding and abetting false statements, a felony stemming from the election lies that Ellis and other Donald Trump lawyers peddled to Georgia lawmakers in December 2020. The development comes after back-to-back guilty pleas last week in the sprawling case from former Trump campaign lawyer Sidney Powell and Kenneth Chesebro, who helped devise the fake electors plot.
