The Texas Supreme Court has ruled against lawmakers who used their subpoena power to halt the execution of a death row inmate for his daughter’s “shaken baby” death, paving the way for it to proceed. "Categorically prioritizing a legislative subpoena over a scheduled execution, in other words, would become a potent legal tool that could be wielded not just to obtain necessary testimony but to forestall an execution," the Texas Supreme Court said in its ruling Friday. But the Office of the Attorney General quickly appealed the subpoena, which was supported by a district court judge's temporary injunction that halted Roberson's execution. After the state's highest criminal court agreed with the attorney general's office, allowing Roberson's execution to continue, lawmakers then petitioned their case to the Texas Supreme Court. "Given the overwhelming new evidence of innocence, we ask the State of Texas to refrain from setting a new execution date."

Montana voters approved a ballot measure enshrining abortion in the state constitution, NBC News projects, delivering a victory to advocates for reproductive rights in a Western red state. The amendment will not change current law on abortion in Montana: Abortion is legal in the state until fetal viability, around the 23rd or 24th week of pregnancy, backed up by a 1999 ruling by the state Supreme Court. But advocates for the ballot measure wanted to guard against potential changes by the Legislature or state Supreme Court justices in the heavily Republican state. South Dakotans voted down a ballot measure that would have put abortion rights in the state constitution, instead keeping the state’s near-total ban on abortion. Voters have overturned state abortion bans in a number of red states since the Supreme Court’s Dobbs decision, but South Dakota is an extremely conservative state. WASHINGTON — The Supreme Court on Friday handed a loss to Republicans by allowing Pennsylvania voters who sent mail-in ballots that were flagged as being potentially defective to submit a separate provisional in-person ballot. The justices rejected, with no noted dissents, a Republican request to put on hold a Pennsylvania Supreme Court ruling from last week. The Supreme Court action does not definitively resolve the legal issue, which could yet return to the justices. Many of Pennsylvania's counties, which administer elections, already allowed for voters to cast provisional ballots if their mail-in ballots lacked a secrecy envelope even before the recent state Supreme Court ruling. Genser and Matis lost in a trial court, but an intermediate appeals court and the Pennsylvania Supreme Court ruled in their favor, prompting Republicans to appeal again to the U.S. Supreme Court.

Together, Pennsylvania’s mail ballot rules have generated an entire vocabulary for rejected mail ballots — ballots that are unsigned, undated or misdated, or even “naked,” if they are not clothed in a secrecy envelope. The latest update from Oct. 31 — after the general statewide deadline to request a mail ballot — shows there were 2,193,578 mail ballot applications ever approved. Combined with the deficient returned ballots that we already know about referenced above, that comes to about 8,000 deficient mail ballots that have been returned to date. Although this general election will likely see more mail ballots returned than the previous midterm, the trend so far suggests we might have fewer mail ballots rejected. Moreover, the experience in 2022 suggests there will also be thousands of provisional ballots cast by voters who return deficient mail ballots.

A New York woman has been charged with assault as a hate crime after she allegedly pepper-sprayed her Muslim Uber driver as he praying at a red light, prosecutors said Thursday. Jennifer Guilbeault, 23, allegedly launched the “anti-Muslim” attack on July 31, the Manhattan District Attorney’s Office said in a news release Monday. A few minutes later the driver called 911 and Guilbeault was arrested at the scene. Guilbeault has been charged in a New York State Supreme Court indictment with second-degree assault as a hate crime, third-degree assault as a hate crime, and second-degree aggravated harassment. “As alleged, Jennifer Guilbeault senselessly assaulted a Muslim Uber driver while he was just doing his job,” District Attorney Alvin L. Bragg said in a statement.

(CNN) — A New York woman has been indicted on hate crime charges after allegedly pepper-spraying a Muslim Uber driver while he was praying, according to the Manhattan District Attorney’s Office. Jennifer Guilbeault, 23, was indicted on multiple hate crime charges on Monday after allegedly pepper-spraying a 45-year-old Uber driver while he began praying in Arabic, according to a press release from the prosecutor. “As alleged, Jennifer Guilbeault senselessly assaulted a Muslim Uber driver while he was just doing his job. Everyone is welcome to live and work in Manhattan,” said Manhattan District Attorney Alvin Bragg. The charges against Guilbeault include one count each of Assault in the Second Degree as a Hate Crime, Assault in the Third Degree as a Hate Crime and Aggravated Harassment in the Second Degree.

A highly anticipated legislative hearing began Monday but without its key witness: a Texas inmate whose execution for his daughter's "shaken baby" death was narrowly averted last week. The high court, however, said Sunday it would not rule on the manner in which Roberson must testify. Roberson, 57, has maintained his innocence in the 2002 death of his 2-year-old daughter, Nikki, based on "shaken baby syndrome." But hours later, Roberson said, he woke up and realized Nikki was not breathing and her lips looked blue. Wharton, the lead detective in the case, has also voiced his support for Roberson, telling House committee members at a hearing last week: "This is an innocent man, beyond question."
