Smartmatic and Newsmax have reached a settlement in the voting technology company’s election defamation lawsuit against the right-wing news outlet shortly before the case was set to go to trial. The lawsuit focused on Newsmax's false claims that Smartmatic's machines rigged the 2020 presidential election for Joe Biden. Smartmatic sued Newsmax Media in 2021, alleging it claimed Smartmatic’s devices rigged the 2020 election. Former President Donald Trump and his allies have continued to promote false claims that the 2020 election results were manipulated to favor Biden. Smartmatic in April settled a similar defamation lawsuit against One America News for a sum that was not disclosed publicly.

Washington CNN —Jury selection is set to begin Thursday in a closely watched defamation trial pitting voting technology company Smartmatic against the right-wing cable network Newsmax, in a high-stakes case over the airing of false 2020 election claims. The Newsmax case revolves around the same false claims, championed by former President Donald Trump and his Republican allies, that the 2020 election was rigged by Smartmatic software and others. The Florida-based company sued Newsmax and other right-wing outlets and figures in 2021, alleging that its reputation was destroyed by the lies. The Newsmax case will test the legal limits of publishing lies about the 2020 election, and the trial will play out during the final stretch of the 2024 campaign. ‘Dozens’ of defamatory reportsAfter mainstream news outlets – and even Fox News – projected that Democratic nominee Joe Biden would win the 2020 election, Trump and his surrogates falsely claimed that he won.

A settlement has been reached in a defamation lawsuit pitting an electronic voting machine manufacturer targeted by allies of former President Donald Trump against a conservative news outlet that aired accusations of vote manipulation in the 2020 election. The Delaware lawsuit, which takes issue with Newsmax reports over a five-week period in late 2020, is one of several stemming from reports by conservative news outlets following the election. Smartmatic also is suing Fox News for defamation in New York and recently settled a lawsuit in the District of Columbia against the One America News Network, another conservative outlet. Dominion Voting Systems similarly filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Trump's loss. Last year, in a case presided over by Davis, Fox News settled with Dominion for $787 million.

The pro-Trump cable outlet Newsmax and voting technology company Smartmatic settled a major 2020 election defamation lawsuit Thursday in a last-minute agreement to avoid a high-stakes trial. But in the run-up to the trial, Smartmatic’s hand weakened significantly, further raising the possibility of a settlement. Smartmatic has claimed that the lies promoted by Newsmax, Fox News, and other Trump allies destroyed its reputation and cost the company billions of dollars. However, as the Newsmax trial approached, Smartmatic’s lawyers reduced the company’s damages claim to approximately $370 million, according to statements in court. It often makes sense to settle rather than pay the expenses of a trial and possible appeals.”The settlement is the latest in a string of 2020 election defamation cases to reach an out-of-court agreement before trial.

A Delaware judge agreed to send another 2020 election defamation case to trial Thursday, ruling that the Newsmax Media published false claims saying Smartmatic voting machines rigged the 2020 election. Florida-based voting machine company Smartmatic, alleging defamation, sued Newsmax Media, also based in Florida, in 2021, arguing that the network claimed its devices rigged the 2020 election. Former President Donald Trump and his allies have repeatedly claimed that the 2020 election was rigged. But in wins for Smartmatic, he ruled firmly that the rigged election claims were definitely false, published by Newsmax and specific to Smartmatic. Smartmatic's case is quite different, in large part because the voting machine company was used only in Los Angeles during the 2020 election.

Instead, Davis concluded that key questions about Newsmax’s actions in 2020 would be weighed by a jury, barring a pre-trial settlement. “Newsmax reported on allegations regarding the Election and Smartmatic, but there remains a dispute as to whether Newsmax recklessly disregarded the truth,” Davis wrote. “With these facts, a reasonable jury could find Newsmax was reporting on a matter of public concern without endorsing the allegations surrounding the Election,” Davis wrote. If the outlet doesn’t settle, its executives and on-air personalities could be forced to publicly testify about their contacts with Trump during the 2020 election and their controversial post-election coverage. The judge also went out of his way to make clear that nothing in his ruling is meant to suggest that there was anything questionable or illegitimate about the 2020 election results.

Two executives at Smartmatic, a voting machine company, were indicted in Florida on Thursday for allegedly bribing officials in the Philippines to secure contracts ahead of the 2016 election there, the U.S. Attorney's Office in the Southern District of Florida announced. “No voter fraud has been alleged and Smartmatic is not indicted. These are the values that Smartmatic lives by,” the company said in a statement. Smartmatic has since filed a major defamation suit against Fox News and its parent company over the network’s reporting on the stolen election claims. Fox News promoted the indictment of the Smartmatic executives in an email to reporters.

The Justice Department on Thursday charged three current and former executives at Smartmatic, the voting technology company, with taking part in a bribery scheme in the Philippines. In the indictment, which was released publicly on Friday, prosecutors said that from 2015 to 2018, Smartmatic’s president and co-founder, Roger Piñate, and other executives funneled “at least $1 million in bribes” to Juan Andres Bautista, the former chairman of the Philippine elections commission, so that their company could obtain and keep a contract providing voting machines and election services for the 2016 Philippine elections. A Smartmatic spokesman said in a statement that two of the people charged remain at the company, including Mr. Piñate, and each has been placed on a leave of absence, though he noted that “our accused employees remain innocent until proven guilty.”“No voter fraud has been alleged, and Smartmatic is not indicted,” the spokesman said. “Still, voters worldwide must be assured that the elections they participate in are conducted with the utmost integrity and transparency.”

CNN —Rudy Giuliani is no longer entitled to bankruptcy protection, a judge decided Friday, making it possible for creditors to immediately pursue his assets within days. Judge Sean Lane of the federal bankruptcy court in New York made the decision partly because of Giuliani’s lack of transparency after he filed for bankruptcy more than six months ago. The worth of those other assets is unclear, as creditors accuse Giuliani of downplaying or not disclosing complete estimates of the value of what he owns. The creditors believe one World Series ring alone would sell for nearly $30,000, according to court filings in his bankruptcy case. Giuliani agreed to end his bankruptcy proceedings, after Freeman and Moss suggested that approach earlier this week.

A person with knowledge of the matter wouldn’t say exactly how much money Hoffman poured into Smartmatic but told CNN the eight-figure investment surpassed $10 million. Smartmatic is seeking billions of dollars in damages from Fox News, Newsmax and other right-wing figures that falsely accused the company of rigging the 2020 election. The voting technology company’s defamation lawsuit against Fox News is still in the fact-finding “discovery” phase and isn’t expected to go to trial until 2025. New York CNN —Alex Jones’ conspiracy empire is on the brink. If the judge rules in favor of Sandy Hook families, Infowars would be shuttered. In such a scenario, a court-appointed trustee would be tasked with securing the assets and then selling off Jones’ media empire, including the website, studio space, and broadcasting equipment. “Infowars would no longer exist,” Christopher Mattei, an attorney who represents some of the Sandy Hook families, explained this week to CNN’s Hadas Gold. CNN —Rudy Giuliani was processed in Phoenix on Monday, weeks after pleading not guilty in Arizona to charges of allegedly conspiring to overturn the 2020 presidential election results. Giuliani was served on May 17 in Palm Beach, Florida, at his 80th birthday bash held by a GOP operative. Arizona prosecutors spent weeks trying to track down the former New York City mayor and eventually found him based on his podcasts. A grand jury in Arizona handed up indictments last month charging over a dozen Trump allies, including the fake electors and several individuals connected to his campaign, over their efforts to overturn his 2020 election loss. Goodman added that Giuliani “will be fully vindicated.”The Arizona indictment is just the latest legal woe for Giuliani stemming from his time as Trump’s attorney after the 2020 presidential election.

Smartmatic and Newsmax have since been embroiled in the years-long defamation case, which is slated to go to trial this September in Delaware Superior Court, barring an out-of-court settlement. Smartmatic further accused Newsmax of intentionally “destroying relevant evidence” by deleting texts and emails from senior officials. Fox News famously paid more than $787 million to Dominion Voting Systems to settle a case last year over similar 2020 election lies on its airwaves. A trial could put Newsmax’s financial future in peril, but there is one major difference between the Newsmax and Fox cases.
