McNamara shot and wounded Green, who is Black, after Green appeared to have quelled a fight that broke out inside an eatery near San Jose State University. Jan 25 (Reuters) - San Francisco 49ers defensive end Charles Omenihu is expected to be available for Sunday's NFC Championship game, the team said on Wednesday, after he was arrested this week on suspicion of domestic violence. San Jose police took Omenihu into custody on Monday after his girlfriend called authorities to say he had pushed her to the ground during an argument. Omenihu was not expected to take a full part in practice on Wednesday due to an injury. "We're letting the legal process take care of itself so if he's healthy he'll play this week," said head coach Kyle Shanahan. "We feel very good letting the legal process take care of itself and don't feel we should kick him off the team at this time," said Shanahan.

Jan 24 (Reuters) - San Francisco 49ers defensive end Charles Omenihu was arrested on Monday for misdemeanor domestic violence, the San Jose Police Department said. Police said Omenihu was booked at the Santa Clara County Main Jail but later posted bail and is no longer in custody, adding that the Santa Clara County District Attorney's Office will consider possible charges. "An adult female... called to report that her boyfriend, Charles Omenihu, pushed her to the ground during an argument. "Based on the victim’s statement and the complaint of pain, Omenihu was arrested." "We are aware of the matter involving Charles Omenihu and are in the process of gathering further information," the team said in a statement.
The 21-year-old victim had left his Airbnb to walk to a nearby grocery store on the night of the shooting, prosecutors said. When he crossed the street, he saw Waters exit a home and “quickly approach him while holding a black handgun,” the district attorney’s office said. Video footage of the shooting was also obtained from a nearby neighbor, prosecutors said. He was arrested and booked into Santa Clara County Jail and will be arraigned Monday in San Jose. NBC News has reached out to the San Jose Police Department and an attorney listed for Waters for comment.
