CNN —President-elect Donald Trump has chosen Matthew Whitaker, who served as acting attorney general during Trump’s first term, as his pick to be US ambassador to NATO. During the campaign, Trump also indicated he would only adhere to NATO’s mutual defense commitment for countries who are contributing enough of their annual budgets to defense. He served as the former acting attorney general in Trump’s first term and temporarily led the Justice Department after Trump fired Jeff Sessions. During brief tenure at the top of DOJ, Whitaker quickly took charge of Mueller from Deputy Attorney General Rod Rosenstein. Before becoming the acting attorney general, Whitaker was the US attorney for the Southern District of Iowa and chief of staff to Sessions.

CNN —From his seaside Florida resort, Donald Trump is holding a casting call to fill the toughest job in Washington: attorney general. Current and former Justice officials anticipate eventual departures in some parts of the department and employees being sidelined and forced out. The Justice Department is also charged with defending administration actions in court, covering issues from health care to the environment to gun control. “Attorney General Jeff Sessions has taken a VERY weak position on Hillary Clinton crimes,” he wrote in a Twitter post in July 2017. Trump told Fox Business in 2020 that Barr should indict Obama, Biden and others because of the Russia investigation.

Immune, immune, immune.”Justice Department ‘problem’But just how far that immunity extends is murky. The Supreme Court’s 6-3 decision left many questions unanswered and lower courts have not yet wrestled with them. But the Supreme Court majority ruled that a president’s power to direct the Justice Department’s investigative and prosecutorial work is within his exclusive constitutional authority. While the Supreme Court granted former presidents wide immunity, the ruling made no such promises to aides in the White House or Justice Department. Even the conservative Supreme Court and several lower courts repeatedly blocked Trump, who according to a study last year had the worst win rate at the high court of any modern president.

(AP) — President Joe Biden's personal attorney said Sunday he went to both the special counsel and the attorney general to register concerns over what he viewed to be pejorative and unnecessary digs at the president's memory. “This is a report that went off the rails,” Bob Bauer said on CBS' Face the Nation Sunday. “It’s evident that he had committed to make the report public the way that the special counsel had written it,” said Bauer. He said the special counsel made a decision “to cherry pick in a very misleading way” what references made it in and what didn't. The Justice Department has not commented on the criticism.

By Kanishka SinghWASHINGTON (Reuters) - Robert Hur, the special counsel appointed to investigate whether President Joe Biden improperly handled sensitive government documents, is a former high-ranking Justice Department official with experience in prosecuting sensitive leak investigations. On Thursday, he concluded that probe and found that Biden retained classified materials about Afghanistan after leaving the vice presidency in 2017 but said he will not be criminally charged. Hur was appointed by Donald Trump in 2018 as the chief federal law enforcement officer in Maryland and left that position in early 2021. Under Hur, the Maryland U.S. attorney's office prosecuted the case of former National Security Agency contractor Harold Martin, who stole huge amounts of classified material from U.S. intelligence agencies. A graduate of Stanford Law School and Harvard College, Hur served as top aide to then-Deputy Attorney General Rod Rosenstein before his appointment as the U.S. attorney in Maryland.

Many in the White House were blindsided when AG Garland appointed a special counsel to investigate Biden, WaPo reported. The GOP has accused the special counsel Robert Hur of being partisan, but a former Trump lawyer disagreed, saying he's "smart and experienced." That's why many in the White House were blindsided, according to The Washington Post, when Attorney General Merrick Garland appointed a special counsel to investigate Biden's mishandling of classified information. Republicans and Democrats alike have criticized the Biden White House for failing to disclose the existence of the DOJ's investigation for two months, despite having known about it since November. But Ty Cobb, who once served as Trump's White House counsel, dismissed those concerns.
WASHINGTON—When Rod Rosenstein left the Justice Department in 2019 after a rocky two years as deputy attorney general, his former top aide and protégé, Robert Hur, delivered a roast recalling the office’s capacity for comedic relief amid adversity. “When you’re going through tough times, when you say, ‘You can’t make this stuff up,’ you can either laugh or you can cry,” Mr. Hur said. “I certainly don’t remember any crying.”Mr. Hur’s resilience will soon be tested again. On Thursday, Attorney General Merrick Garland appointed him as special counsel to oversee the investigation into classified documents discovered at President Biden’s home and an office he used at a Washington think tank following his vice presidency.
REUTERS/Michael A. McCoyWASHINGTON, Jan 13 (Reuters) - U.S. Attorney General Merrick Garland on Thursday named Robert Hur as special counsel to investigate whether President Joe Biden had improperly handled sensitive government documents. Hur was the U.S. attorney in Maryland during the Trump administration and most recently served as litigation partner at law firm Gibson, Dunn & Crutcher. A graduate of Stanford Law School and Harvard College, Hur served as top aide to then-Deputy Attorney General Rod Rosenstein before his appointment as the U.S. Attorney in Maryland. He knows what he is getting into," Rosenstein told CNN on Thursday after Hur's appointment as special counsel. "I will conduct the assigned investigation with fair, impartial, and dispassionate judgment," Hur said in a statement released after his appointment as special counsel.
WASHINGTON — Robert Hur, named Thursday by Attorney General Merrick Garland to oversee the investigation into President Joe Biden's handling of classified documents, is a former federal prosecutor who has worked with many Republicans throughout his law enforcement career. Garland appointed Hur as special counsel on Thursday after the White House acknowledged that Obama administration documents with classified markings were found in one of Biden’s Delaware homes. On Monday, the White House said that similar documents had been found in a Washington office. Hur has served as a partner at the law firm Gibson, Dunn & Crutcher since April 2021 where he has focused on enforcement, investigations and litigation. In between his jobs at the Justice Department, Hur worked at another private law firm, King & Spalding.

When Attorney General Merrick Garland announced on Nov. 18 that Jack Smith would take charge as special counsel in two high-profile criminal investigations of Donald Trump, he omitted an important detail: As head of the Justice Department, Mr. Garland will remain accountable for deciding whether to indict the former president. As Attorney General Janet Reno emphasized when she promulgated the special counsel regulations in 1999, “ultimate responsibility” for such investigations “will continue to rest with the Attorney General.” In other words, the special counsel isn’t fully independent. Their wide-ranging and long-lasting investigations led to bipartisan criticism of the independent-counsel model as having too much autonomy. Reno’s regulations sought to correct that imbalance by making special counsels analogous to U.S. attorneys, whose discretionary decisions about matters within their jurisdiction may be overturned by the attorney general. These regulations ensure oversight in six ways.

Star attorney Randy Mastro is leaving Gibson Dunn & Crutcher after more than 20 years, four people told Insider. Mastro has spent more than two decades at Gibson Dunn, which he first joined in 1989.
