The Texas Supreme Court has ruled against lawmakers who used their subpoena power to halt the execution of a death row inmate for his daughter’s “shaken baby” death, paving the way for it to proceed. "Categorically prioritizing a legislative subpoena over a scheduled execution, in other words, would become a potent legal tool that could be wielded not just to obtain necessary testimony but to forestall an execution," the Texas Supreme Court said in its ruling Friday. But the Office of the Attorney General quickly appealed the subpoena, which was supported by a district court judge's temporary injunction that halted Roberson's execution. After the state's highest criminal court agreed with the attorney general's office, allowing Roberson's execution to continue, lawmakers then petitioned their case to the Texas Supreme Court. "Given the overwhelming new evidence of innocence, we ask the State of Texas to refrain from setting a new execution date."

CNN —Apple convinced a federal jury on Friday that health monitoring tech company Masimo’s smartwatches infringe two of its design patents. The jury, in Delaware, agreed with Apple that Masimo’s W1 and Freedom watches and chargers willfully violated Apple’s patent rights in smartwatch designs, awarding the tech giant $250 in damages. Apple’s attorneys told the court the “ultimate purpose” of its lawsuit was to win an injunction against sales of Masimo’s smartwatches after an infringement ruling. The jury also determined that Masimo’s watches did not infringe Apple patents covering smartwatch inventions that the tech giant had accused Masimo of copying. The tech giant countersued Masimo for patent infringement in 2022, alleging that Masimo copied Apple Watch features to use in its smartwatches.

American Airlines posted a third-quarter loss but raised its profit forecast for the year as CEO Robert Isom said the company's sales strategy shift earlier this year is paying off. The carrier said it expects to earn between 25 cents and 50 cents a share on an adjusted basis for the fourth quarter, above the 29 cents analysts polled by LSEG expected. For the full year, the airline expects to earn as much as an adjusted $1.60 a share, ahead of an earlier American forecast for no more than $1.30 a share. American in May fired its chief commercial officer after a sales strategy that aimed to drive direct bookings backfired and quickly reverted much of its sales model. For the fourth quarter, American said its unit revenue will likely drop between 1% to 3% compared with last year, with capacity up as much as 3% year over year.

A highly anticipated legislative hearing began Monday but without its key witness: a Texas inmate whose execution for his daughter's "shaken baby" death was narrowly averted last week. The National Union of Healthcare Workers (NUHW) — which represents 19,000 healthcare workers in California and Hawaii, including 4,700 mental health workers — picketed outside Kaiser facilities in Los Angeles, San Diego, Anaheim and Fontana, seeking an increase in salaries, restoration of pensions and increased staffing. Union members on strike in Southern California have said their demands are line in with what Kaiser has provided to the majority of its workforce. So DirecTV developed an unusual strategy: It’s paying customers to subscribe to a rival. Affected customers of DirecTV, DirecTV Stream and U-Verse can get a free weeklong trial of Fubo for two of its packages that carry ESPN and Disney networks and an additional $30 off the first month of service. DirecTV is also giving its customers a $30 credit to sign up for Sling’s orange tier that includes ESPN channels. ESPN owns the broadcast rights to “Monday Night Football,” which will be blacked out for DirecTV subscribers unless a deal is reached. “We continue to negotiate with DirecTV to restore access to our content as quickly as possible,” a Disney spokesperson told CNN on Sunday. CNN —Car manufacturer Stellantis is recalling more than 1.2 million Ram 1500 vehicles due to a software malfunction in the anti-lock brake system (ABS), according to the National Highway Traffic Safety Administration. The vehicles being recalled include certain 2019, 2021-2024 Ram 1500 trucks, the NHTSA said Saturday in a statement. Also, the ABS, ESC, Adaptive Cruise Control and Forward Collision Warning indicator lights would illuminate when the vehicle started up to show the systems are unavailable. Dealers will update the ABS software for free of charge. The recall comes after a similar recall in June that affected almost 158,000 Ram 2500 pick ups.

U.S. passenger airlines have added nearly 194,000 jobs since 2021 as companies went on a hiring spree after spending months in a pandemic slump, according to the U.S. Department of Transportation. It’s a departure from the previous years when airlines couldn’t hire employees fast enough. U.S. airlines are usually adding pilots constantly since they are required to retire at age 65 by federal law. Then, travel demand snapped back faster than expected, climbing in earnest in 2022 and leaving airlines without experienced employees like customer service agents. “We will be hiring for the foreseeable future at levels like that,” he said at the time.

CNN —Esteban Wood still remembers the time a 74-year-old Mexican farmer in Homestead, Florida, collapsed on the job from extreme heat. Such outdoor workers include lifeguards, transportation employees, ironworkers, agricultural workers and letter carriers. States like California, Colorado, Minnesota and Washington, have some heat protections for workers but they are not uniform or sweeping. For example, Minnesota’s protections only apply to indoor workers while California’s heat protections include both indoor and outdoor workers. The government must implement wage protections alongside heat protections, said Dr. Kristina Dahl, a principal climate scientist at the Union of Concerned Scientists.

Disney reported revenue of $8.4 billion for its theme park unit for the three months that ended in June. Disney’s streaming service turned a profit in the quarter for the first time, but since April 1, the company’s stock has fallen around 29 percent. “The lower-income consumer is feeling a bit of stress, and the higher-income consumer is traveling internationally a bit more,” Hugh F. Johnston, Disney’s chief financial officer, said Wednesday on a conference call with analysts.
