CNN —Four Fox Corporation board members have been subpoenaed in voting technology company Smartmatic’s $2.7 billion defamation lawsuit against Fox News over its airing of 2020 election lies, alleging executives at the right-wing cable channel’s parent company knew it was spreading false claims. In a court filing Monday, Smartmatic subpoenaed the four board members — Anne Dias, Charles Carey, Roland Hernandez, Jacques Nasser — over Fox News’s repeated airing of bogus conspiracy theories that the 2020 election was stolen from former President Donald Trump. “Smartmatic plans to pursue Fox’s board members as well to determine why they allowed the company’s most valuable asset, Fox News, to spread disinformation about the 2020 election.”New York Judge David Cohen had previously ordered Fox Corporation to turn over documents related to the board members in the case. Rupert Murdoch, the right-wing media mogul who founded Fox Corporation, the parent company of Fox News, was also deposed late last year. A former Fox News reporter has sued the conservative network, accusing it of discrimination and retaliation for firing him after he spoke out against “false coverage” of the 2020 U.S. election and the Jan. 6, 2021, riot at the Capitol, according to court filings. Jason Donner, who worked for Fox News as a reporter and producer for 12 years, claimed in the lawsuit that he had been targeted after continually raising concerns with his managers about false statements allowed on the air. The lawsuit was filed in Superior Court of the District of Columbia on Sept. 27 and transferred to U.S. District Court for the District of Columbia on Monday. Mr. Donner had covered Capitol Hill for Fox News since 2018. He was hiding with other reporters in news booths when he heard that Fox was reporting that the attack was “peaceful,” he said.

After Fox News fired Carlson in April, the progressive watchdog Media Matters published embarrassing behind-the-scenes video of Carlson making crude remarks while joking with staff and denigrating the Fox Nation streaming service. Chairman Rupert Murdoch and other senior corporate executives. “We will produce the materials as quickly as we are able to,” Fox lawyer Winn Allen said. These materials will include deposition transcripts and exhibits, apparently from the recently settled defamation case involving Dominion Voting Systems, a Smartmatic lawyer said in court. The monster case pits Smartmatic against Fox News, Trump lawyer Rudy Giuliani, Fox hosts Maria Bartiromo and Jeanine Pirro, and former host Lou Dobbs, who all promoted the baseless lie that Smartmatic rigged the 2020 election. An appeals court recently dropped Fox Corp. as a defendant, but Smartmatic refiled its lawsuit and is trying to re-add the parent company.

Good progress was made and the presiding judge noted that there were “more than enough jurors” to start the trial as scheduled on Monday. I’ve watched thousands and thousands of hours of the right-wing channel’s programming. Fox News is about to enter the true No Spin Zone, where deception is strictly prohibited. The case hasn’t even started and the presiding judge has already lost his patience with Fox’s legal team and put them on notice. But if they play out like the last few weeks of court have, Fox News is in for a brutal ride.
