WASHINGTON — Special counsel Jack Smith and his team plan to resign before President-elect Donald Trump takes office, a source familiar with the matter said. The special counsel's office is required under Justice Department regulations to provide a confidential report to Attorney General Merrick Garland, who can choose to make it public. Before Trump's re-election last week, Smith and his team had continued moving forward in their election interference case against Trump. The Justice Department indicted Trump last year for his efforts to overturn the 2020 presidential election.

An adviser to Trump said that Elon Musk would join Trump in a meeting Wednesday with Republican lawmakers ahead of leadership elections. In posts on X in the past week, Musk has pushed various policy ideas including deporting immigrants and slashing government spending. On Sunday, one of Trump's grandchildren, Kai Trump, posted a photo on X of herself with Musk, writing that Musk was "achieving uncle status."

Elon Musk's controversial $1 million-a-day swing state sweepstakes was never a lottery, a Philadelphia judge said in a written decision explaining why he declined to shut the program down after a hearing last Monday. Lotteries require a prize, a payment for a chance to win that prize, and for winners to be chosen at random, the judge said. Representatives for Krasner, Musk, and the PAC did not immediately respond to requests for comment on the judge's decision and next steps in the case.

The CBOE Volatility Index , known on Wall Street as the VIX, helps traders track when a market rally is actually unhealthy, said DataTrek co-founder Nicholas Colas. Monday's close for the VIX around 15 "is a healthy sign" for the temperature of the market as it advances, Colas wrote to clients. To put it succinctly: "Rallies built on an elevated VIX signal a bubble," he wrote. That's a lesson market participants learned, during the dot-com bubble of the mid- to late-1990s, he said. In the current bull market, dating back to the fourth quarter of 2022, however, the VIX has been largely "well behaved," Colas argued.
