Legal experts told NBC News that the disclosure could have legal fallout for Musk across multiple jurisdictions under laws designed to protect consumers from deceptive practices. Chris Gober, a lawyer for America PAC, made the disclosure at a hearing about the giveaways. Elon Musk awarded Kristine Fishell a $1 million check at a town hall in Pittsburgh on Oct. 20. The handful of Americans who have won $1 million checks from tech billionaire Elon Musk’s super PAC have a few things in common. He said he didn’t know the process the super PAC used to pick his name and didn’t ask. He said he believes Democrats are not ideologically predisposed to sign Musk’s petition in support of the First and Second Amendments. NBC News asked the super PAC to share the process Oct. 22 and did not receive a response. All 14 winners have either recorded videos for Musk’s super PAC, been photographed for the super PAC or both.

NEW YORK — A new lawsuit accuses Subway of “grossly misleading” customers by advertising sandwiches that contain at least three times more meat than it delivers. According to a proposed class action filed Monday in federal court in Brooklyn, Subway ads for its Steak & Cheese sandwich show layers of meat piled high, reaching about as high as the surrounding hero bread. In reality, according to several photos in the complaint, the fast-food chain’s sandwiches are far more bread than filling. Her lawsuit seeks unspecified damages for New Yorkers who bought the sandwiches in the last three years, for Subway’s alleged violations of the state’s consumer protection laws. Subway previously defended for more than four years against a lawsuit claiming its “footlong” sandwiches were too short.

CNN —Philadelphia’s district attorney asked a state judge on Monday to shut down tech billionaire Elon Musk’s controversial $1 million giveaway to registered voters, calling it an “illegal lottery scheme.”Philadelphia District Attorney Larry Krasner, a Democrat, filed the civil lawsuit against Musk and his pro-Trump group, America PAC. “America PAC and Musk are lulling Philadelphia citizens – and others in the Commonwealth (and other swing states in the upcoming election) – to give up their personal identifying information and make a political pledge in exchange for the chance to win $1 million,” the lawsuit alleges. A federal judge on Thursday issued a temporary restraining order against Florida’s surgeon general, the latest development in a legal battle over a television ad supporting the state’s abortion rights ballot measure. Earlier this month, the Florida Department of Health sent cease-and-desist letters to multiple broadcast stations that had aired the ad, threatening criminal charges against stations that didn’t stop playing it. The restraining order against Florida Surgeon General Joseph Ladapo lasts through Oct. 29. Sean "Diddy" Combs wants to go to trial on sex trafficking charges next spring, the embattled hip-hop mogul's lawyers informed a judge Wednesday. "Mr. Combs continues to assert his right to a speedy trial and intends to request a trial date in April or May 2025, and as consistent with the Court’s trial schedule," the jailed rapper's lawyers wrote. Combs was charged last month with sex trafficking, racketeering and transportation to engage in prostitution in a sweeping indictment by the Southern District of New York. Combs' preference was mentioned in a joint letter from his lawyers and prosecutors. New York CNN —Home Depot will pay nearly $2 million to settle a civil enforcement claim from California district attorneys that the home improvement company was engaging in false advertising and unfair competition. Such violations are called “scanner violations,” the Los Angeles County District Attorney’s office said in a press release Thursday. “False advertising and unfair competition are serious offenses that undermine consumer trust and distort the marketplace,” Los Angeles County District Attorney George Gascón said in a statement. The Los Angeles DA’s office said the company was cooperative in the investigation. The civil penalties are a drop in the bucket for the nation’s fifth-largest retailer.
