KFC sues Church’s over ‘Original Recipe’

Last week, KFC accused Church’s Texas Chicken of violating its trademark rights when its fried chicken competitor began using the words “Original Recipe” in its advertising and promotions. KFC claimed in a lawsuit that beginning September 30, it noticed Church’s “abruptly” began using the phrase and ignored KFC’s October 24 letter objecting to the ads. In the disputed promotions, Church’s posted photos of its fried chicken deals with text above reading: “our original recipe is back.”The phrase, which KFC has been using for over half a century, “is likely to create confusion in the marketplace and dilute the ORIGINAL RECIPE® Mark,” the lawsuit, which was filed in US District Court in Texas, said. But when it comes to fried chicken, KFC also has to compete with Church’s Texas Chicken, Popeyes, Raising Cane’s, Zaxby’s and more. KFC’s “Original Recipe” trademark, which it says is a secret blend of 11 herbs and spices, has long been part of the company’s branding.

A new Burger King restaurant under construction in Tortosa, Spain, following the current expansion of Restaurant Brands International Inc. - the parent company of BK- in new and existing markets. Restaurant Brands International on Tuesday reported quarterly earnings and revenue that missed analysts' expectations as domestic same-store sales growth for all four of its chains fell short of Wall Street estimates. Burger King, Firehouse Subs and Popeyes all reported same-store sales declines in their home markets. But the Canadian coffee chain still fell short of Wall Street's same-store sales growth expectations of 4.1%, based on StreetAccount estimates. Outside of the U.S. and Canada, Restaurant Brands' international same-store sales rose 1.8% in the quarter, just shy of estimates of 2.2%.

Yum Brands on Tuesday reported quarterly earnings and revenue that missed Wall Street's expectation as same-store sales at KFC and Pizza Hut slid more than expected. Yum's worldwide same-store sales fell 2% in the quarter, dragged down by weaker performances at KFC and Pizza Hut, which both reported same-store sales declines of 4%. KFC's U.S. same-store sales slid 5% this quarter. The pizza chain saw its international same-store sales shrink 6%, while U.S. same-store sales fell just 1%. Taco Bell, the gem of Yum's portfolio, reported same-store sales growth of 4%.

People have died after drinking tea brewed from unwashed poppy seeds. Members of the House of Representatives and Senate have proposed legislation “to prohibit the distribution and sale of contaminated poppy seeds in order to prevent harm, addiction, and further deaths from morphine-contaminated poppy seeds.” The bill was one of several on the agenda for a September 10 House hearing. On the other hand, tea made from large quantities of unwashed poppy seeds could lead to addiction and overdose, doctors said. The US Drug Enforcement Administration said unwashed poppy seeds can kill when used alone or in combination with other drugs. The US Department of Justice has brought criminal prosecutions over the sale of unwashed poppy seeds.

For the second consecutive year, the fast food giant is discounting one of its most popular menu items on National Cheeseburger Day. On Sept. 18 only, customers will be able to buy the chain's famous Double Cheeseburger for 50 cents. The offer is available to customers who use the fast food chain's smartphone app, and is limited to one burger per customer. Users who open the app will be prompted to take advantage of the National Cheeseburger Day promotion, and the discount will be automatically applied at checkout. Restaurant Brands International on Thursday reported quarterly revenue that beat analysts' expectations, fueled by better-than-expected sales at Tim Hortons and the company's international restaurants. Shares of Restaurant Brands rose 3% in morning trading. Out of Restaurant Brands' four chains, Tim Hortons performed the best, with same-store sales growth of 4.6%. To win penny-pinching customers back, some say they're planning smaller price increases for the rest of the year. Wendy's CFO Gunther Plosch told investors on Thursday that consumers are "still under pressure" — especially those with household incomes under $75,000. Chains raised prices drastically during the pandemic to offset rising labor and food costs, and it's coming back to bite them. For some restaurant chains, comparable sales even fell. McDonald's would "certainly" be "prudent and thoughtful" about any further price increases in the rest of 2024, Borden said.

Issa Rae is adding to her business ventures with a new company, Ensemble, to connect brands with diverse creators. The company seeks to attract ad spending by connecting brands with a network of 50 up-and-coming creators, including Leo Gonzalez, Mark Phillips, and Drew Afualo. I’ve never really understood why people enjoy eating chicken.
