“Nevertheless, the magazine and Nuzzi agreed that the best course forward is to part ways.”“Nuzzi is a uniquely talented writer and we have been proud to publish her work over her nearly eight years as our Washington Correspondent,” the magazine added. Nuzzi said her relationship with Kennedy “turned personal” the following month and ended in August. “The relationship was never physical but should have been disclosed to prevent the appearance of a conflict. I deeply regret not doing so immediately and apologize to those I’ve disappointed, especially my colleagues at New York,” she said in a statement. In a court filing, Lizza said Nuzzi told him that Kennedy had manipulated her and that he wanted to “possess,” “control” and “impregnate” her.

Washington CNN —Gateway Pundit, the far-right conspiracy site, has settled a defamation lawsuit from two Georgia election workers who were falsely accused of rigging the 2020 results. The Gateway Pundit, infamous for publishing extremely partisan and sensationalized material, often dabbles in baseless right-wing conspiracy theories. The company tried to declare bankruptcy in April, saying the 2020 defamation cases were threatening its solvency. Gateway Pundit is appealing that ruling. Republican former Rep. Liz Cheney will campaign with Vice President Kamala Harris in Wisconsin on Thursday, touting her endorsement of the Democratic presidential nominee in the crucial battleground state, a senior campaign official told CNN. The campaign event marks the latest effort from the former Wyoming congresswoman to move undecided voters away from former President Donald Trump with less than five weeks until Election Day. Cheney, who previously told CNN she was committed to doing what was necessary to stop Trump from returning to the White House, endorsed Harris last month in North Carolina, another swing state. She later said she expected to campaign against Trump in battleground states throughout the fall. At the Thursday campaign event in Ripon – home to a schoolhouse known as the birthplace of the Republican Party – Harris will make a direct appeal to Republican and independent voters, according to the campaign official.

Smith, in the 165-page document, provides the fullest accounting yet of evidence in his 2020 election conspiracy case against Trump, Pence’s former boss. Increased pressure on PenceTrump, after Pence told him he did not have the authority to decertify the election, began to up the intensity of his request, prosecutors say. On the call, Trump told Pence that “hundreds of thousands” of people “are gonna hate your guts” and “people are gonna think you’re stupid,” also calling Pence “too honest,” according to the filing. Hours before January 6On January 5, 2021, according to the filing, Trump once again met with Pence to allegedly try to pressure him not to certify the electoral college votes. Nonetheless, Trump told his advisers that he would claim victory before the ballots were fully counted, prosecutors say. One private political adviser, three days before Election Day 2020, described Trump’s plan as: “He’s going to declare victory. When Trump told the staffer he would not pay the private lawyer spearheading his legal challenges unless the challenges were successful, the staffer told Trump that the private attorney would never be paid. The situation has prompted Hunter Biden to add noted defense attorney Mark Geragos, who runs his firm out of Los Angeles, for the tax trial. The Delaware trial lasted seven days, but a tax trial is expected to last much longer, meaning at a far greater cost for the defendant. A previous deal between Hunter Biden and special counsel David Weiss to avoid trials and potentially prison time a year ago fell apart in dramatic fashion. Lunden Roberts, the mother of one of Hunter Biden’s children whom he had a child support battle over, has also been subpoenaed to testify, her lawyer says. Judge Sean Lane of the federal bankruptcy court in White Plains, New York, is expected to issue a ruling any day on how to move forward. Lindell told CNN on Tuesday that he paid for Giuliani’s travel because the former New York mayor was hired on July 1 as a host for Lindell’s right-wing broadcast platform, FrankSpeech TV. CNN —The Biden-Harris campaign on Sunday formally amended filings with the Federal Election Commission to rename its principal committee and declare Kamala Harris a candidate for president. The move means that should she remain on the ticket for the general election, according to the Campaign Legal Center, Harris could assume control of the Biden-Harris campaign account, which had nearly $96 million cash in hand at the end of June. It’s possible the Biden campaign will need to ask the Federal Election Commission for guidance, in the form of an advisory opinion, in the coming weeks, Engle added. That could allow Harris to start a new campaign account, revisit donors who had already maxed out contributions to the Biden-Harris campaign and hit them up again, one election attorney said. “I think the general consensus view is, because Harris’s name is already on the paperwork, she can accept it for the general election.

Trump adviser Steve Bannon started serving his four-month sentence earlier this month at a federal prison in Connecticut. Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. “It’s very lonely,” Senior Judge Paul C. Huck told CNN of Fort Pierce, a small fishing and citrus community on the edge of the Southern District of Florida where Cannon is the only federal judge. They also said Cannon’s lack of trial experience, both as a lawyer and a judge, is apparent. In her seven years as a Justice Department attorney, Cannon participated on the trial teams of just four criminal cases. And on the bench, she’s only presided over a handful of criminal trials — and Huck took over one of them.

CNN —A federal judge on Monday dismissed the classified documents case against Donald Trump, a shock ruling that clears away one of the major legal challenges facing the former president. In a 93-page ruling, District Judge Aileen Cannon said the appointment of special counsel Jack Smith violated the Constitution. She did not rule on whether Trump’s alleged mishandling of classified documents was proper or not. Even though a trial before the presidential election was considered highly unlikely, many legal experts had viewed the classified documents case as the strongest one of the four cases that were pending against the former president. Smith had charged Trump last year with taking classified documents from the White House and resisting the government’s attempts to retrieve the materials.

CNN —The Supreme Court handed down a landmark decision Monday granting Donald Trump partial immunity from special counsel Jack Smith’s election subversion case, handing the former president a significant win during his reelection bid. For starters, the Supreme Court ruled that for “core” presidential activity, Trump has the absolute immunity he had sought. The analysis about what’s immune and what isn’t “ultimately is best left to the lower courts to perform,” Roberts wrote. Immune, immune, immune,” she wrote. In a significant break from the court’s other conservatives, Barrett seemed to suggest Trump should go to trial quickly.

CNN —The biggest question now that the Supreme Court has decided Donald Trump is entitled to some immunity from prosecution: What happens next in special counsel Jack Smith’s election interference case against the former president? Those are likely to come in the days after the Supreme Court hands the opinion down formally to the federal courts in DC. The Supreme Court said that that Trump’s pressure campaign on Vice President Mike Pence to help him overturn the election is “presumptively” immune, and put the burden on the prosecutors to rebut the presumptive immunity. The Supreme Court’s ruling strongly suggests that those appeals would need to be resolved pre-trial, making it unlikely this case goes to a jury before Americans cast their ballots for president. Jack Smith’s options going forwardIt’s also possible that Smith’s office winnows down his case to bring it in line with the Supreme Court’s opinion.

Charges against Trump not likely affectedThe people who pushed their way into the Capitol aren’t the only ones who are facing the obstruction charge. But even before the court’s decision was handed down, Smith made clear that the charge was based on different circumstances in Trump’s case. The Supreme Court’s opinion did not address the fake electors scheme specifically. What is far more important for Trump is the Supreme Court’s pending decision on immunity. The Justice Department has taken steps for months in its prosecutions of rioters to shore up the obstruction charges.

CNN —Federal Judge Aileen Cannon said Tuesday she had “a hard time seeing” any problems with the warrant the FBI obtained to search former President Donald Trump’s Mar-a-Lago estate in the summer of 2022. Trump’s attorney Emil Bove had argued that the warrant was overly broad and unjustly allowed agents to search the entire Mar-a-Lago premises. Bove, like in other recent hearings in the classified documents case, wants the judge to hold even more hearings that could probe into the investigators’ work. “They purported to look for classified documents in a gym and a kitchen,” he added. Investigators say they found classified documents in various places at the resort, including a public ballroom, a bathroom and a bedroom.

Special Counsel Jack Smith delivers remarks on a recently unsealed indictment including four felony counts against former President Donald Trump on August 1, 2023 in Washington, DC. Drew Angerer/Getty ImagesAttorneys for Donald Trump will continue their legal efforts to throw off special counsel Jack Smith and the classified documents case against the former president in Florida on Monday. Trump’s attorneys will battle prosecutors in court on the second part of Trump’s argument that Smith’s appointment was illegitimate, focusing on how he’s being funded. On Friday, prosecutors, defense attorneys and third parties fought over whether Smith was legitimately appointed as special counsel, an argument district Judge Aileen Cannon seemed skeptical of during the hearing. “President Biden’s DOJ is paying for this politically motivated prosecution of Biden’s chief political rival ‘off the books,’ without accountability or authorization,” Trump’s attorneys argued in their filing earlier this year.

CNN —Months before Donald Trump was indicted for mishandling classified documents, a federal judge said that investigators had “strong evidence” that the former president “intended” to hide classified documents at his Mar-a-Lago resort, according to newly released court documents. Judge Beryl Howell cited, among other things, the discovery of additional classified documents found at Mar-a-Lago months after the FBI’s search of the property in the summer of 2022. The ruling was among hundreds of pages of previously sealed filings that were publicly docketed Tuesday in the criminal classified documents case against Trump. Nauta has been charged alongside Trump and Mar-a-Lago property manager Carlos De Oliveira in the case, facing charges of mishandling sensitive or classified materials and obstruction. The case against Trump, brought last summer, is currently in front of Judge Aileen Cannon in Fort Pierce, Florida.

CNN —Judge Aileen Cannon has indefinitely postponed former President Donald Trump’s classified documents trial in Florida, citing significant issues around classified evidence that would need to be worked out before the federal criminal case goes to a jury. In an order Tuesday, Cannon cancelled the May trial date and did not set a new date. By indefinitely postponing the classified documents trial, Cannon’s order pushes it closer to the 2024 election – and potentially afterward. Although Trump’s attorneys have continuously asserted in court filings that a pre-election trial would be “unfair.”The further delayed trial also could put Trump’s two federal cases on a collision course. Trump is charged in the Florida case with mishandling classified documents and with working with two co-defendants, Walt Nauta and Carlos De Oliveira, to obstruct the Justice Department’s investigation.

Trump himself has continued to lobby for absolute immunity, including before his appearance at a New York court where he’s on trial for business fraud. Dreeben told Barrett that the indictment against Trump is substantially about private conduct, meaning that a trial could proceed even if the Supreme Court finds some immunity for Trump’s official actions. Liberal justices weren’t impressed with Trump’s absolute immunity claimsIt was pretty clear where the court’s three liberals will be when the opinion lands. With arguments over, focus shifts to timing for decisionThe arguments about Trump’s immunity claim are over. If Trump were sent to prison, would he still have his presidential Secret Service protecting him in jail? The judicial process is built around the idea that defendants are there to answer charges, and New York law requires that a defendant be present at trial. The felony charge here, which is the lowest level felony under New York law, is falsifying business records to further some other crime. His federal trial on classified documents is proceeding slowly in Miami. While Trump, under New York law, has a right to know their names, their identities will be kept from public view.
