While Gaetz’s ability to be confirmed appears on the rocks among Senate Republicans, President-elect Donald Trump’s team remains confident he will eventually be confirmed, even if it’s after an ugly battle. Gaetz and Trump attorney Todd Blanche are moving full speed ahead on trying to fill out the Justice Department, according to sources familiar with the planning. In his few terms in the House, Gaetz has often been embroiled in controversy. The attorney, John Clune, also called for the release of a House Ethics Committee report detailing the committee’s investigation into Gaetz, which has been ongoing for several years. Since the Truth Social post, Trump has not asked for any specific Cabinet pick, including Gaetz, to be confirmed via recess appointment.

Pennsylvania’s Senate race is heading to a recount, which the narrow margin between Republican Dave McCormick and Democratic Sen. Bob Casey triggered automatically under state law. Secretary of the Commonwealth Al Schmidt announced Wednesday that the unofficial results showing a narrow race have led to a recount. Any margin under 0.5 percentage points triggers a recount in Pennsylvania. But the current vote count shows a sizable drop-off between Trump and McCormick, with Trump winning more than 100,000 more votes than McCormick. NBC News projected that Democratic Senate candidates in Arizona, Michigan, Nevada and Wisconsin won their races even as Trump carried the states.

But some are pointing to an issue with far less power in American politics: transgender rights. Bomb threats sent to polling places and ballot-counting locations in at least five battleground states across the U.S. Tuesday targeted mostly Democratic counties, an NBC News analysis has found. Of the 67 locations, 56 were in 11 counties that voted for Joe Biden in the 2020 election, including the eight most populated. Those high-population Democratic counties include voting locations for Milwaukee, Wisconsin; Detroit, Michigan; Phoenix, Arizona; Atlanta, Georgia; and Philadelphia, Pennsylvania. Maricopa County, Arizona, which Biden won by a slim margin, has consistently been the subject of election denialism conspiracy theories. Some of the threats also included counties that voted heavily for Donald Trump in 2020, including the comparatively smaller Blair and Clearfield Counties in Pennsylvania.

Dots above the dotted black line are precincts where Trump out-performed his vote percentage four years ago. Most precincts in Pennsylvania shifted toward Trump, with the biggest shifts coming in areas where he won 20% to 30% of the vote in 2020. While Harris and Biden both won this region comfortably, Harris’ vote margin was nearly 120,000 votes smaller than Biden’s. Next door in the 7th District, GOP state Rep. Ryan Mackenzie defeated Democratic Rep. Susan Wild, who had flipped a GOP seat in a 2018 special election. Republicans also flipped an open seat in Michigan’s 7th District, after Democratic Rep. Elissa Slotkin decided to run for the Senate. Because California is notoriously slow in counting ballots, some of the half-dozen hyper-competitive races there — critical to which party wins the House majority — likely will take days. In the 27th District, GOP Rep. Mike Garcia was narrowly beating Democrat George Whitesides with 65% of the vote in. In another California battleground race, NBC News projected Wednesday that GOP Rep. Kevin Kiley has defeated Democrat Jessica Morse.

The data make it clear that most provisional ballots are likely to come from voters with outstanding mail ballots, rather than voters who’ve already returned deficient mail ballots. And they also make it clear that those provisional ballots may favor Vice President Kamala Harris and the Democratic Party. Voters who have returned deficient mail ballots and have yet to fix them can vote on Election Day, typically by provisional ballot. Meanwhile, as mentioned above, an estimated 35,000 might cast provisional ballots after having not returned their mail ballots at all. There may well be future litigation revisiting, yet again, whether to count provisional ballots cast by people who previously returned deficient mail ballots.

Challenges filed in Bucks County – which includes Philadelphia’s northeastern suburbs – were all filed by Pennsylvania state Sen. Jarrett Coleman, O’Malley said. Coleman also filed 519 challenges to overseas voters in Lehigh County, according to Tim Benyo, that county’s elections chief. Republicans and outside conservative groups have launched legal assaults against overseas ballots in multiple battleground states, including Pennsylvania, after Democrats touted efforts to turn out citizens who live abroad. Pennsylvania officials said that the lawsuit risked disenfranchising “tens of thousands” of overseas voters, including those in uniform. “In the absence of a registration requirement that applies to (overseas voters), election officials are required to fill their timely submitted absentee ballot requests,” Morley said.

With Pennsylvania expected to be a close and crucial state in the 2024 race for the presidency, it's unusual election laws are again under the microscope. Election experts say Pennsylvania's laws make it fertile ground for rigged election claims to flourish. “The Pennsylvania legislature had multiple opportunities to clarify and improve the state’s election law,” said Nate Persily, an NBC News election law expert and professor at Stanford Law School. Last week, a video popped up on social media falsely claiming to show someone ripping up ballots in Bucks County, Pennsylvania. Instead of relying on flagging suspected foreign disinformation posts to social media companies, U.S. authorities are declassifying information about foreign election interference in an unprecedented way, seizing web domains and issuing indictments that have exposed the mechanics of Russian and Iranian information warfare, officials and researchers said. U.S. intelligence officials later said Russian “influence actors” were behind the false story. And social media companies, under intense legal and political pressure from Republican critics, have scaled back or scrapped teams in recent years that used to take down inflammatory or conspiratorial content. The combination of homegrown falsehoods about “stolen” election conspiracies, surging foreign disinformation campaigns and a laissez-faire approach by tech firms threatens to undermine the foundations of American democracy, experts and lawmakers said.

Together, Pennsylvania’s mail ballot rules have generated an entire vocabulary for rejected mail ballots — ballots that are unsigned, undated or misdated, or even “naked,” if they are not clothed in a secrecy envelope. The latest update from Oct. 31 — after the general statewide deadline to request a mail ballot — shows there were 2,193,578 mail ballot applications ever approved. Combined with the deficient returned ballots that we already know about referenced above, that comes to about 8,000 deficient mail ballots that have been returned to date. Although this general election will likely see more mail ballots returned than the previous midterm, the trend so far suggests we might have fewer mail ballots rejected. Moreover, the experience in 2022 suggests there will also be thousands of provisional ballots cast by voters who return deficient mail ballots.
