June 1 (Reuters) - Outdoor clothing retailer Patagonia Inc has settled its lawsuit accusing Gap Inc (GPS.N) of illegally copying the "iconic" snapped flap pocket that the company has long featured on its fleece outerwear. The outfitter alleged the jackets were intended to confuse shoppers into believing they were Patagonia products or that Patagonia let the retailer use its trademarks. Gap denied the claims and argued in court filings that Patagonia had waited too long to bring the lawsuit. Gap also filed a counterclaim asking a judge to rule that the design of Patagonia’s Snap-T pullover fleece is not legally protected. Patagonia filed a lawsuit against Nordstrom in California federal court on Tuesday accusing the retailer of selling 'counterfeit' Patagonia products. Patagonia had a "years-long dealer relationship" with Nordstrom, but after Patagonia chose to end the agreement Nordstrom sold "counterfeit" Patagonia items in its off-price Nordstrom Rack stores in 2023, according to the suit filed Tuesday in the US District Court for the Central District of California. In a Tuesday night complaint filed in San Francisco federal court, Patagonia said Gap is willfully and deliberately selling fleece jackets that mimic its flap pocket and rectangular "P-6" logo without permission. The lawsuit includes a one-star review posted online by a Gap customer who called a Gap product an "Obvious Pata*gonia ripoff. Patagonia said it introduced its Snap-T pullover fleece in 1985 and added the flap pocket four years later.
