Law enforcement missed critical opportunities to prevent a 2022 mass shooting at an LGBTQ+ nightclub in Colorado, a pair of lawsuits filed over the weekend allege. The suits claim that the massacre at Club Q in Colorado Springs, which killed five people and injured at least 19, could have been averted if authorities had enforced Colorado’s red flag law. The El Paso County Board of County Commissioners and former El Paso County Sheriff Bill Elder are named as defendants in the suits, which accuse them of negligence and, in the case of the deceased victims, wrongful death. A spokesperson for El Paso County declined to comment on the allegations, citing the pending litigation. The El Paso County defendants “willfully and wantonly ignored the shooter’s warning signs,” the legal documents say.

Severe weather is set to hit opposite ends of the country this week, with a powerful low pressure system — followed by an atmospheric river — set to bring damaging winds, heavy rain and snow to the Pacific Northwest, while storms and possible flooding are headed for the Gulf Coast. ET update that a "rapidly strengthening and extremely powerful" weather system could bring winds of 70 mph across northern California and parts of Washington and Oregon from Tuesday. Satellite images show a weather system approaching the Pacific Northwest on Tuesday morning. Further south, the eastern and central Gulf Coast is due to receive heavy rain and possible flash floods, with eastern Louisiana to the western Florida Panhandle the area most at risk, the NWS said. Elsewhere, a deep low pressure system will bring moderate to heavy rain across the Plains region, with a marginal risk of severe thunderstorms.

CNN —Victims and family members of those killed in the 2022 mass shooting at the LGBTQIA+ Club Q in Colorado Springs have sued the El Paso County Board of Commissioners and others, alleging authorities could have prevented the shooting if they had enforced the state’s “red flag law” against the gunman. One was filed by the families of the dead victims and five victims themselves – a second was filed by Barrett Hudson, who sustained seven gunshot wounds. “The shooter had a history of violent threats and behavior that clearly warranted intervention,” the suits say. The suits allege that, despite the shooter’s “history of violent threats and behavior that clearly warranted prevention … El Paso County law enforcement failed to invoke the Red Flag Law, in light of policies against its use.”In 2019, a year before the law came into effect, the Board of El Paso County Commissioners approved a resolution to designate the county a so-called Second Amendment Sanctuary. CNN reached out to El Paso County, the El Paso County Sheriff’s Office, Elder and Club Q for comment.

The man accused of killing Georgia nursing student Laken Riley has waived his right to a jury, paving the way for his bench trial, which is expected to begin Friday morning. Clark described Riley’s killing as a "crime of opportunity, where he saw an individual and bad things happened," and said the killing appeared to be a solo act. The University of Georgia said Riley had been a student through the 2023 spring semester before she transferred to Augusta University. At the time of Riley’s killing, Ibarra was living in an apartment complex less than a mile from the University of Georgia campus. Riley’s killing and Ibarra’s arrest set off a political firestorm, with Republicans, including Donald Trump, pointing to Riley’s death in calls for tougher border policies as part of a broader crackdown on immigration.

Here are five takeaways on the voters Trump won and what it means moving forward:The Latino realignmentA trend with the potential to remake the American political landscape is the huge shift in Latino voters toward Trump. Trump’s 1.5-point win in Osceola County flipped a location that President Joe Biden won by 14 points four years earlier. Trump’s performance similarly improved in Orange County, home of Orlando, where Biden won by 23 points in 2020 but Harris won by just 5.6 points this year. Trump’s gains are explained in part by his appeals to Black men, and his efforts to reach out to Arab American voters. Harris won by 10 points and 85,000 votes — short of the 14-point, 114,000-vote win Biden had notched there in 2020.

Pursuant to a 2013 Supreme Court decision, DOJ monitors only go inside polling places with the agreement of local officials, unless they have a court order. In their federal lawsuits, Missouri and Texas officials argued that their state laws did not permit federal officials to be present at polling places. Florida did not file a lawsuit, but Secretary of State Cord Byrd told the Justice Department in a letter Friday that state law does not allow DOJ officials in polling places. The DOJ was allowed to monitor polling places, he wrote, but was not allowed to send observers inside without a federal court order. Armed federal law enforcement officers are generally prohibited from entering polling places, which are secured by local law enforcement agencies.

Texas Attorney General Ken Paxton sued an El Paso doctor on Tuesday, accusing him of providing transition-related medical care to nearly two dozen minors in violation of state law. Texas enacted a law, Senate Bill 14, last year banning gender-affirming care for anyone under 18. Laws restricting access to transition-related care for minors exist in 26 states, according to the Movement Advancement Project, an LGBTQ think tank. The Texas lawsuits come just ahead of the presidential election, where transition-related care has become somewhat of a flashpoint. SUNLAND PARK, N.M. — In each of the last two summers, Laura Mae Williams, who recovers bodies for the New Mexico Medical Investigator’s Office, has had to visit the U.S.-Mexico borderlands multiple times a week. The Medical Investigator’s Office, part of the University of New Mexico Health System, used to recover only a handful of bodies a year. First responders, elected officials and advocates in New Mexico attribute the spike in deaths largely to Texas Gov. Officials, including the New Mexico Medical Investigator’s Office, also blame smugglers for the deaths, noting that in many cases they abandon people who fall behind — but only after they take their phones. “It raises an important question,” said Dr. Heather Jarrell, the chief medical examiner at the Medical Investigator’s Office, whose office marks the deaths as accidental.

Trump has made the border and immigration a centerpiece of his pitch for the presidency, making multiple visits to the southern border during the campaign. Friday's visit to Douglas, Arizona, will be Harris' second trip to the southern border during her term as vice president. NBC News reported in August that shelters on the southern border and in some major cities experienced sharp declines in migrants seeking shelter over the past several months. When Roberta Gabaldon was ready to share news of her pregnancy with her colleagues at Customs and Border Protection in 2015, she brought in pink and blue doughnuts with a sign that read: “Pink and blue. Pink and blue. Somebody’s pregnant, guess who?”But her palpable excitement, particularly after a miscarriage months earlier, quickly dissipated. Her experience reflects that of hundreds of female employees at the agency who have filed suit against Customs and Border Protection, saying that since at least 2016, they were denied equal treatment once they disclosed they were expecting. The policy, they say, hurt their opportunities for advancement, and others add that they weathered pay cuts because light duty meant no more overtime.
