A federal appeals court ruled Friday that a Mississippi law allowing mail-in ballots to be counted if they are postmarked before Election Day — but received up to five days after Election Day — is pre-empted by federal law. It does, however, pave the way for a possible challenge that could go up to the U.S. Supreme Court, which could have ramifications for states that do allow ballots postmarked before Election Day to be counted. The appeals court ruling says that no such ballots should be counted. "Federal law requires voters to take timely steps to vote by Election Day. And federal law does not permit the State of Mississippi to extend the period for voting by one day, five days, or 100 days," the ruling said.

CNN —A panel of three Donald Trump-appointed judges said Friday that Mississippi was violating federal law by counting mail ballots that arrive after Election Day, but stopped short of blocking the policy before the election, in a ruling that could nevertheless impact voting-related lawsuits this fall. The ruling from the 5th US Circuit Court of Appeals is a victory for the Republican National Committee and others who brought the case in Mississippi, a non-battleground state with very little mail-in voting, seeking a ruling by a far-right circuit court friendly to their arguments. “Voters deserve nothing less than a fair and transparent election which ends on November 5th. “Congress statutorily designated a singular ‘day for the election’ of members of Congress and the appointment of presidential electors,” the 5th Circuit panel said. “That is not to say all the ballots must be counted on Election Day,” the opinion states.

Behind the scenes, the conservative justice sought to put a thumb on the scale for states trying to restrict how social media companies filter content. The states enacted their laws in 2021 and, with variations, restricted the ability of social media platforms to filter third-party messages, videos and other content. Greg Abbott signed that state’s measure, he said, “there is a dangerous movement by social media companies to silence conservative viewpoints and ideas.” In Florida, Gov. Kagan added a footnote to her majority opinion buttressing that point and reinforcing Barrett’s view. CNN —An attorney defending Texas’ controversial immigration law told a federal appeals court on Wednesday that state legislators may have gone “too far” when they passed the law last year. The law, known as SB4, makes entering Texas illegally a state crime and allows state judges to order immigrants to be deported. Nielson sought to downplay how sweeping the law was and argued it did not interfere with federal authority on immigration. An attorney for the Justice Department, which brought one of the lawsuits challenging the Texas statute, urged the appeals court not to depart from its previous ruling blocking the law. “Of course, we know that presidents come and go, and different administrations might very well enforce federal law differently,” he said, arguing that the law may not be necessary under a different presidential administration.

CNN —The biggest inferno in Texas history is being fueled by winds and high temperatures as it rages Sunday, threatening to incinerate more buildings, cattle and livelihoods across the Texas Panhandle while residents sift through ashes of what used to be homes. The fire, which is just one of five blazes currently scorching the Texas Panhandle, has already killed two people and destroyed over 500 structures, state officials said Saturday. Texas A&M Forest Service spokesperson Jason Nedlo told CNN Saturday that the blaze could grow over the weekend due to the weather conditions. Because the Texas Panhandle had higher-than-average rainfall this winter, there is more grass – fuel – to burn. A “red flag” warning, which indicates critical fire weather conditions, remains in effect for Oklahoma and the Texas Panhandle through midnight Sunday.

Some 8 million people across the Central Plains are under “red flag” warnings and temperatures are above normal in the Texas Panhandle. So far, the Smokehouse Creek Fire has spread across more than 1 million acres and has become the biggest Texas wildfire on record. And the fire is just one of five blazes currently scorching the Texas Panhandle, destroying as many as 500 structures. Sunday’s fire weather threat will be greatest for the Texas Panhandle and western Texas, according to the Storm Prediction Center.

WASHINGTON (AP) — The Supreme Court is hearing arguments in a challenge to the Securities and Exchange Commission's ability to fight fraud, part of a broad attack on regulatory agencies led by conservative and business interests. Circuit Court of Appeals ruled in favor of Jarkesy and his Patriot28 investment adviser group on three separate issues. And it said laws shielding the commission’s administrative law judges from being fired by the president are unconstitutional. Jarkesy's lawyers noted that the SEC wins almost all the cases it brings in front of the administrative law judges but only about 60% of cases tried in federal court. A decision upholding the 5th Circuit's ruling could sweep far more broadly, calling into question the authority of administrative law judges at numerous federal agencies, the Justice Department said.

In October, Consolidated Communications agreed to be bought by an investor group comprising Searchlight Capital Partners And British Columbia Investment Management Corp, months after the group had first submitted an offer to buy the company. Reuters reported in July that Wildcat asked Consolidated Communications to reject the offer. Consolidated Communications did not immediately respond to a request for comment. Wildcat argued that mature fiber and cable operators have historically been valued at 10 to 15 times earnings before interest, taxes, depreciation and amortization (EBITDA) by acquirers, whereas Consolidated Communications' take-private deal valued the company at about six times of cash flow.

Lidl sued Tesco in 2020 shortly after Tesco adopted a yellow circle against a blue background to promote its "Clubcard Prices" discount scheme. However, the judge rejected Lidl's argument that Tesco had "the deliberate subjective intention of riding on Lidl's coat tails". A Lidl spokesperson said in a statement: "We are pleased that the court has agreed with us and that it will now order Tesco to stop using the Clubcard logo." Tesco said it intends to appeal against the ruling, which a spokesperson described as being "just about the colour and shape of the Clubcard Prices logo".
CNN —Supreme Court Justice Samuel Alito on Friday extended a hold on a lower court ruling that would have imposed restrictions on access to an abortion drug, a temporary move meant to give the justices more time to consider the issue. The case is the most important abortion-related dispute to reach the high court since the justices overturned Roe v. Wade last term. Alito issued a so-called administrative stay on the ruling while the high court considers an emergency appeal filed by the Biden administration and a manufacturer of the drug, mifepristone. Alito issued the order because he has jurisdiction over the federal appeals court involved in the case. Prelogar, the solicitor general, argued in her filing to the Supreme Court that the FDA’s expert judgment should not be challenged.
A federal appeals court has allowed the abortion pill mifepristone to remain on the U.S. market for now, but it imposed major restrictions on the medication that will significantly limit access. The order bars mail delivery of the abortion pill. "If allowed to stand, the consequences of this decision will be catastrophic not just for medication abortion access, but the entire drug approval system." The Alliance Defending Freedom, the anti-abortion group that sued the FDA, said the appeals court decision restores critical safeguards while the litigation proceeds. The order does not impact misoprostol, which is commonly used as a standalone abortion medication in other parts of the world.
