CNN —The Fulton County Jail in Atlanta unconstitutionally subjects inmates to “inhumane, violent and hazardous conditions” that threaten their safety, a US Justice Department official said Thursday, announcing the results of a 16-month investigation. “We cannot turn a blind eye to the inhumane, violent and hazardous conditions that people are subjected to inside the Fulton County Jail,” Clarke said. CNN —Emotional accounts from relatives of the victims and survivors of the partial collapse of a boat dock gangway on Georgia’s Sapelo Island and a newly released video of the frantic rescue efforts paint a dramatic picture of Saturday’s incident. The seven victims were among the dozens of people who traveled to Sapelo Island last weekend to celebrate the Gullah-Geechee, a community of descendants of Africans who were enslaved on coastal plantations in the South. Yvette Jackson, one of the seniors on a family trip visiting Sapelo Island, barely made it across the gangway before the collapse and said at Tuesday’s news conference, “It was the most horrific thing I have ever experienced.”A portion of the gangway that collapsed Saturday afternoon remains visible on Sapelo Island in McIntosh County, Georgia, on October 20, 2024. “I just stood there, looking down in that water and saw all those people.”“And then it hit me, Regina, Regina, where’s Regina? “Nobody knows what it’s like to go under the water and let somebody help you out and bring you out.

CNN —A record number of early votes have been cast in Georgia on Tuesday as residents headed to the polls in a critical battleground state that is grappling with the fallout from Hurricane Helene and controversial election administration changes that have spurred a flurry of lawsuits. More than 300,000 ballots were cast Tuesday, Gabe Sterling of the Georgia secretary of state’s office said on X. Georgia election officials say absentee ballots went out by the US Postal Service as scheduled and were not impacted by the storm. It’s also possible that the state could continue to see high numbers of early votes given that Georgia law now mandates two Saturdays of early voting and allows for two Sundays of early voting if a county desires. Legal fights continueMeanwhile, state judges are scrutinizing a number of new rules passed by the Trump-backed Republican majority on the State Election Board that Democrats warn could inject post-election “chaos” into the Georgia.

CNN —Two federal judges have rejected requests to immediately reopen voter registration in Georgia and Florida as the southeast continues to grapple with significant storm damage ahead of the November election. Brian Kemp and Secretary of State Brad Raffensperger — both of whom are Republicans — argued there would be a significant “administrative burden” on the state’s elections offices if the voter registration deadline were to be extended. Ron DeSantis told reporters that there’s “nothing inhibiting” unregistered voters from registering ahead of the deadline later that day. But we’re not going to change any registration deadline. You can register today, and there doesn’t need to – there’s no reason to open that up,” the governor said.

Fulton County, meanwhile, has sued the board, objecting to the push to force it to use election deniers as monitors. “The State Election Board has no statutory authority to force the Fulton County BRE [Board of Registration and Elections] to accept, and Fulton County to pay for, election monitors hand-picked by the State Election Board,” the lawsuit states. But GOP members of the state-election board told CNN neither Germany nor the Carter Center should be allowed to be a monitor because of bias. Fellow election board Republican Janelle King alleged that Fulton County is operating in bad faith. CNN —A judge on Thursday threw out three charges in the sweeping Georgia election subversion case, including two charges that former President Donald Trump faces. In a separate ruling, Fulton County Judge Scott McAfee also upheld the marquee racketeering charge in the case, which Trump is also facing. In the ruling, McAfee also threw out a separate count of filing false documents, which Trump was charged with. Trump was only named in two of the three charges that McAfee threw out Thursday. The awkward ruling from McAfee comes as he has only partial jurisdiction over the 2020 election meddling case.

CNN —A second former Memphis police officer facing federal civil rights charges in the violent arrest and beating death of Tyre Nichols changed his plea to guilty on Friday in federal court. Mills and Martin are among five former officers charged in the death of Nichols, a 29-year-old Black man. He admitted he “willfully used unreasonable force against Tyre Nichols,” “aided and abetted” other officers in assaulting Nichols and “failed to intervene” in other officers’ use of force. Police said the unit was permanently deactivated shortly after Nichols’ death. The beating and Nichols’ death led to protests and vigils in Memphis and other major US cities, reigniting the contentious debate over policing and the ways that law enforcement treat Black people.

CNN —Former President Donald Trump and several of his co-defendants in the Georgia election subversion case are appealing a judge’s ruling that let Fulton County District Attorney Fani Willis remain on the election subversion case. The defense attorneys on Friday asked the Georgia Court of Appeals to overturn Judge Scott McAfee’s initial decision that allowed Willis and her office continue to pursue the case but only if Nathan Wade, the special prosecutor with whom she had a romantic relationship, resigned. While Wade has since left the case, defense attorneys still want the appellate court to disqualify the entire Fulton County DA’s office. “DA Willis has covered herself and her office in scandal and disrepute, as she has squandered her credibility and repeatedly and flagrantly violated the heightened ethical standards demanded of her position,” the appeal states. However, the judge added, “Georgia law does not permit the finding of an actual conflict for simply making bad choices – even repeatedly.”The district attorney’s office declined to comment.

CNN —Fulton County District Attorney Fani Willis can stay on and prosecute the Georgia 2020 election interference racketeering case against former President Donald Trump and 14 of his co-defendants, Judge Scott McAfee ruled Friday, but only if she removes the special prosecutor with whom she engaged in a romantic relationship. CNN has reached out to the district attorney’s office regarding the next steps in the case. Wilis chose to dedicate much of her energy on what she believed was the most important case: prosecuting Trump for his attempts to steal the Georgia election in 2020. But the next 40 non-racketeering charges stemmed from roughly a dozen key incidents after the 2020 election. Trump and 14 of his allies have pleaded not guilty to all the charges in the sprawling racketeering case.

CNN —The presiding judge in the Georgia criminal case against Donald Trump and his allies has thrown out some of the charges against the former president and several of his co-defendants. The partial dismissal by Georgia Superior Court Judge Scott McAfee leaves most of the sprawling racketeering indictment intact. Trump was named in three of the counts specifically, meaning the former president is now facing 88 charges over the four criminal indictments in Georgia, New York, Washington, DC, and Florida. Prosecutors alleged that Trump and some of his co-defendants violated the law by pressuring members of the Georgia legislature to unlawfully appoint presidential electors. “It was interesting that the judge made room for the possibility of an appeal by the state.

CNN —The presiding judge in former President Donald Trump’s Georgia election subversion case says he is on track to order this week on whether to disqualify Fulton County District Attorney Fani Willis. And I’ll tell you that an order like this takes time to write,” McAfee said in the interview. McAfee told the court at the end of the Willis disqualification hearings that he would take at least two weeks to decide. A longtime Democratic stronghold and home to the city of Atlanta, Fulton County will present an uphill challenge for Kramer, a vocal Trump supporter. I’m very passionate about making sure the citizens of Fulton County feel confident in their DA,” he added. He lost the primary to Willis and former District Attorney Paul Howard, whom he later endorsed in a runoff. Asked if he believes that Willis has the support of Fulton County after her testimony, Dickens told CNN: “Yes. In that case, like she’s attempting to do with Trump and his allies, Willis used the racketeering statute as a tool to build a broad conspiracy case.

CNN —A Georgia state Senate committee investigating allegations of wrongdoing by the Fulton County District Attorney Fani Willis heard more than three hours of testimony from defense attorney Ashleigh Merchant that largely went unchallenged by the mostly Republican committee and offered little to no new information about the claims. Merchant is representing one of Donald Trump’s co-defendants in the sprawling 2020 Georgia election interference racketeering case and is seeking to have Willis, a Democrat, removed from the case, possibly endangering the entire prosecution. Republican state Sen. Bill Cowsert, chairman of the committee, told CNN that endgame of the panel is, “to determine whether there has been improper behavior. They’re going hear the evidence…and I’m sure both sides will actually do their role in that particular situation,” Jones said. The panel can amend Georgia law or create new legislation but lacks the power to directly sanction Willis.

The text messages raise questions about Bradley’s credibility, and the degree to which Merchant appeared to rely on his claims that she was then unable to substantiate elsewhere. Wade and Willis have admitted to being romantically involved, but both have testified their relationship started after Willis appointed Wade lead prosecutor in the Trump case. Merchant had said that he would contradict testimony from Willis and Wade once he took the stand. “Why would you speculate when she was asking you a direct question about when the relationship started?” Sadow pushed. The additional text messages show Bradley calling Merchant his “friend,” offering unsolicited advice, and also bashing Willis and Wade, Bradley’s former law partner.

CNN —A Georgia lawyer who had been billed as a star witness in the effort to disqualify Fulton County District Attorney Fani Willis did not deliver damaging testimony Tuesday on her romantic relationship with prosecutor Nathan Wade. “I do not have knowledge of it starting, or when it started,” Bradley said at one point. That filing leveled allegations that Willis and Wade engaged in an improper romantic relationship from which Willis financially benefited. “Why would you speculate when she was asking you a direct question about when the relationship started?” Sadow pushed. That means attorneys can use it to bolster their legal arguments about whether Willis should be disqualified without witness testimony.

Friday’s filing from Steve Sadow, Trump’s lead attorney in the Georgia case, included an affidavit from a criminal defense investigator who said he relied on subpoenaed cell phone information and cell tower data. The investigator, Charles Mittelstadt, said he generated a report that isolated “all interactions,” including calls and text messages between Wade and Willis. (Trump’s attorney submitted a new filing Friday afternoon to clarify the types of exchanges between Wade and Willis.) In addition, Willis and Wade exchanged phone calls late into the evenings during this time, the investigator says, citing Wade’s subpoenaed cell phone data. This story has been updated with the revised filing from Trump’s attorneys, referring to 12,000 “interactions” between Wade and Willis.

A judge will continue to hear testimony Friday in a hearing that could derail the election subversion case against Donald Trump and others. Judge Scott McAfee is considering whether Fulton County District Attorney Fani Willis should be disqualified from the case based on allegations that she and Nathan Wade, the special prosecutor she hired to lead the case, engaged in an improper romantic relationship which financially benefitted the district attorney. Here's what to watch:The allegations against Wade and Willis: The alleged affair was first raised by Trump’s co-defendant, former 2020 campaign official Mike Roman. Last month in a court filing he accused Willis of financially benefiting from selecting Wade to lead the case. Roman alleges that Wade took Willis on lavish vacations, paid partly with what he billed her office for work on the case.

CNN —A hearing that could derail the election subversion case against Donald Trump and others in Georgia is underway as a judge considers whether Fulton County District Attorney Fani Willis should be disqualified. It’s unclear if another prosecutor in Georgia would even be inclined to take up the case from Willis, given its political and legal challenges. Wade and Willis acknowledged in court filings that they had a personal relationship but deny any wrongdoing. McAfee called for the hearing Thursday to “establish the record on those core allegations” against Willis and Wade and their relationship. “We are focusing on what the judge asked us to show him – the personal and financial benefits that Willis got from Wade,” Merchant told CNN.

CNN —The judge presiding over the Georgia election subversion case against Donald Trump and several co-defendants said Monday that the district attorney who brought the case could be disqualified if she financially benefitted from a personal relationship with her lead prosecutor on the case. Trump and his co-defendants are also seeking to get the entire case dismissed. “The state has admitted a relationship existed,” McAfee said. “The issues at point here are whether a relationship existed, whether that relationship was romantic or non-romantic in nature, when it formed and whether it continues,” McAfee said. While McAfee said Willis may not be the first witness called on Thursday, he did not rule out the possibility of Willis taking the stand.
