WASHINGTON — Republicans are gearing up to lock in their remake of the judiciary under President-elect Donald Trump and a new Senate majority, including potentially installing several more conservative Supreme Court justices. Conservatives are prepared for Supreme Court retirements, with the most attention on Justice Samuel Alito, 74. GOP won't pursue Supreme Court ethics rulesTrump already transformed the federal courts in his first term, appointing 54 appeals court judges and 174 district court judges, many of whom are closely linked with the Federalist Society, a conservative legal group. Biden has made his own mark on the judiciary, appointing 210 district and appeals court judges in total, including 44 appeals court judges, falling just short of Trump’s total. “We’ll quit beating up the Supreme Court every time we don’t like the decision they make,” he said.

WASHINGTON — Americans are poised to elect a new Congress, with control of both chambers at stake as every seat in the House of Representatives and one-third of the Senate is up before voters on Election Day. Republicans favored to win the SenateIn the Senate, Democrats currently have a 51-49 edge, but Republicans are favored to capture the majority. They’re all but guaranteed to win an open seat in ruby-red West Virginia, with Democrat-turned-independent Sen. Joe Manchin retiring. If Harris wins, Republicans will need one more seat in addition to West Virginia to capture the Senate. In New York, Republicans are defending four seats they flipped in 2022, propelling them to win the House majority.

And although Republicans are well positioned to win the majority, Democrats cannot be counted out entirely. Senate seats in the three states that Donald Trump won twice (West Virginia, Montana and Ohio) have always been the most likely to flip. Democrats aren’t trying to defend West Virginia. The three “blue wall” states of Michigan, Pennsylvania and Wisconsin – which are also crucial presidential battlegrounds – started the cycle looking more comfortable for Senate Democrats. Abortion is the most-mentioned topic in Democratic closing ads, followed by immigration, health care, bipartisanship, and taxation, according to an analysis of more than 300 TV ads from candidates and joint ads they ran with party committees. The analysis looked at ads, tracked by AdImpact, that aired Wednesday in competitive House and Senate races. Immigration is the top topic in Republican ads, followed by Vice President Kamala Harris, taxation, President Joe Biden, and candidate character. Larry Hogan and Wisconsin businessman Eric Hovde — had TV ads mentioning the issue on Wednesday. A Democratic super PAC is hitting the airwaves in Texas, looking to boost Rep. Colin Allred by focusing on abortion in his underdog but increasingly competitive race against GOP Sen. Ted Cruz. Democrats haven't won a statewide race in Texas in 30 years, though they have forced some close contests in recent elections. “In such an important election, Senate Majority PAC is determined to make sure Texans understand the choice facing them this November. Rep. Colin Allred, D-Texas, at an early voting center in Dallas, Texas, just before he voted. Cruz and McConnell have a tumultuous history in the Senate, particularly after Cruz called McConnell a “liar” on the Senate floor in 2015.

Republicans are making a last-ditch effort to flip Nevada's Senate seat, optimistic that a strong performance from former President Donald Trump in the state could boost Republican Senate candidate Sam Brown. Senate Leadership Fund, the main GOP super PAC involved in Senate races, is planning to spend $6.2 million on TV, radio and digital ads in Nevada, according to ad spending figures shared first with NBC News. SLF has spent tens of millions of dollars in other Senate battlegrounds in recent months. “It might be the best environment Republicans have seen in a presidential year in 20 years,” Nevada GOP strategist Jeremy Hughes recently told NBC News. Since Labor Day, Democrats have spent a combined $38.3 million on ads in Nevada, while Republicans have spent $27.6 million.

And they are long-shot races, especially during a presidential election, when ticket-splitting isn’t as common as it used to be. In Florida and Texas, Democrats are focusing on state abortion bans to try to push beyond their recent losses in those states. Cruz’s campaign spent almost $5 million on ads in September and $4 million in the first 10 days of October. The spending disparity is less stark in Florida, where in September Mucarsel-Powell’s campaign spent $8.6 million and Scott’s campaign spent $2.1 million. In Maryland, the Senate race features a similar dynamic, with the race rated by Cook as “Likely Democrat,” even though Harris is expected to win there easily.

By comparison, from Ohio’s March primary through August, Democrats held the edge, dropping $78.5 million on ads to Republicans’ $59 million. “Bernie’s special interest allies are dumping hundreds of millions of dollars into this race to try and defeat Sherrod because they know Sherrod will always stand up to them to do what’s right for Ohio,” Brown spokesperson Matt Keyes said in a statement. Democrats, who hold a one-seat majority in the Senate, are growing increasingly nervous about Sen. Jon Tester’s re-election bid in Montana. Democrats had a clear advertising advantage coming out of a contentious March primary that cost Moreno’s campaign millions of dollars to win. Close behind is WinSenate, a political action committee affiliated with the Democrats’ Senate Majority PAC, which has spent more than $22 million this month.

Senate Democrats (including independents who caucus with them) hold 23 seats up for election this year; Republicans hold 11. Positive signs for DemocratsBut is the race for the Senate really over if Republicans just win West Virginia? Democratic Senate candidates seem to be at least tied or ahead in Arizona, Michigan, Montana, Nevada, Ohio, Pennsylvania and Wisconsin.
